Instructions:
a) This is a group assignment consisting of 5 or 6 members.
b) The submission should be in the form stated in the tasks by using good English.
c) Each member of the group shall be part of the group’s written report.
d) Issue: Week 9 and Submission: Week 11
e) Submission of hardcopy or softcopy written report via the platform as required by the respective
lecturer.
Write a REPORT on a Construction Case Law:
1.0 CRITERIA FOR CASE LAW
1. Must be ONE (1) Malaysian construction case law
2. The case must be selected from the period of 2019 to 2024
3. The case must be related to construction disputes on matters regarding the following:
(i) formation of a contract
(ii) validity of the contract
(iii) terms of the contract
(iv) discharge of contract, or
(v) remedies for breach of contract
4. All groups should refer to different case law when discussing the findings.
2.0 WRITTEN REPORT should include the following:
1. Name of case law – i.e., Plaintiff v Defendant
2. Identification of case, e.g., MLJ 1 2024, CLJ…
3. Facts of the case
4. The decision by the court in the context of:
(i) Legal precedent used by the court
(ii) Impacts of the decision on the existing contract terms
(iii) Impact on each disputing party’s contractual responsibilities
5. Lessons learned on how the findings from the case law provide best practices for
construction practitioners when managing construction contracts in the future.
Clauses should be referred from the PWD Standard Form(s) of Contract (Rev.1/2010) / PAM Contract 2018,
Contracts Act 1950 or other contractual reference used in the case law.
