David Dickerson called the meeting to order at 10:01 a.m.

Mr. Voecks. Motion carried unanimously with a 6-0 vote.

a. Establishing Boating Restriction


Ms. Eby presented to the Lake Killarney Board, the process of establishing slow speed
zones for feedback showing specific areas in the cove and canal of Lake Killarney. The
Florida Uniform Waterway Marker (FUWM) is a permit application process through the
Florida Fish and Wildlife Conservation Commission (FWC) that establishes boating
restriction/slow speed zones. Ms. Eby explained the flowchart in sequential order. The
city produces an ordinance that is adopted, which then goes through the FWC
permitting process. The ordinance, if approved, goes through public hearings for
adoption at the legislative level. Staff is currently coordinating with FWC.
Florida Statute Section 327.46 was displayed, which is the chapter where boating
restriction is legislatively enacted. Ms. Eby explained the flowchart reflects all the

regulations and terminology available to apply for a slow speed ordinance. Each marker
has to match one of the boxes labeled in section 1a, 1b or 1c. Section 1a is the easiest
to enact because it deals with specifics. Section 1b will come into fruition for Lake
Killarney because it deals with shoreline that is shore to shore less than 75 feet. Section
1c is the most difficult to enact because it requires unsafe boating documentation
related to the reasoning; specifically, citations.
Staff is attempting to conjoin the City’s current ordinance language on boat speed with
FWC regulations through legislature and adoption so the City will have fortified
enforcement capabilities. On Lake Killarney, staff would like to establish a slow speed
zone 150 ft from the shoreline, however staff was advised by FWC yesterday that
without citation documentation the city will be unsuccessful in establishing a slow speed
150 ft from the shoreline within the Lake Killarney. If permit is accepted by FWC, then
city will establish uniform accepted markers at the entry of the cove and entry of the
canal. The goal is to get safety markers throughout the city waterways. Ms. Eby
reiterated the purpose of going through the city's current boating code is to get FWC
approval in order to harden enforcement capabilities for boat speed.
Discussion opened to public comments:
Robert Kunzweiler, 2000 Lake Dr. asked if Lake Killarney will get the buoys in the two
canal areas as requested. Ms. Eby explained that the city is in the pre-application
process with FWC and explained the next steps. Mr. Kunzweiler advised he can provide
documentation on an accident to help implement the 150 ft. request. Ms. Eby explained
that FWC does not consider Boating Under the Influence (BUI) supportive
documentation for a specific marker location. Adding, a 150 ft buffer zone would have
to demonstrate habitual citations such as swimmer involved accidents to deem the
location applicable to 1c. Mr. Kunzweiler expressed his support for the marker at the
entrance to the canal.
Jeanne Wall, 2110 Lake Dr., read text messages from Conrad Necrason who stated
there used to be markers on the canal entrance and the little lake entrance. There was
also a speed limit sign and white buoys off the shore about 100 or 150 ft. on the Winter
Park side of the lake. Ms. Eby advised that the city was cited by FWC for having these
no wake buoys because they were not permitted and were removed. There is an option
to create informational buoys in certain key locations.
Michael Barko, 2064 Lake Dr., stated he lives at the pinch points on Lake Killarney and
the sign on the canal for the speed is still there. He asked if there is an environmental
approach rather than the documentation of accidents. Coming out of the cove at high
speed tears up the eelgrass, causing it to accumulate. This leads to a call to the city for
removal. Ms. Eby advised that this approach is specifically excluded. The speed cannot
be regulated without going through the permitting process with FWC. Mr. Ellison
offered the Board’s assistance with the establishment of the boating restrictions.

Ms. Volpe announced Conrad Necrason and David Hunter are no longer on the Board,
replaced with new members John Mitchell and Ian Bennett. The next meeting is
December 12, 2024 at 5 pm at the Winter Park Police Department. At the request of Mr.
Voecks, one of the new board member's address was given by Ms. Nidia.

• Aquatic Plant Treatments – Pondweed treatment was postponed because of wind
speeds and subsequent cold weather / minor spot treatments for Hydrilla was
conducted.
• Maintenance and Efforts: 200 gallons of debris removed, 30 gallons of trash
removed. Board member asked for a graph representing debris and trash
removed. Pictures of the debris are photo documented specifically around storm
events. Definition of debris and trash followed.
• Ms. Eby provided a brief review of the Prioritization list. The updates are tracked
in red.

Ms. Monahan briefly displayed the full CIP, no major updates on the Killarney projects
on the full CIP. Staff submitted the information that the district requested for the
ongoing Killarney Drive project. The timeframe for a response is between 30 and 60
days. The information was submitted before Thanksgiving, the exact date was not
available. Approval is expected and construction takes approximately two months. Ms.
Monahan agreed to include the application and approval notice in next month's agenda
packet if she hears from St. Johns Water Management District.
The City street sweeping schedule was displayed, divided into 4 quadrants. Killarney is
in the northwest quadrant and is typically scheduled the 2nd and the 4th week of every
month. Additionally the city is going through the process of selecting a new street
sweeping contractor. Mr. Marcotte advised that the new contractor will provide all of
their GPS tracking. Start date for the new contractor is unknown at this time.
Included in the packet is the letter that will go out before the holiday break to all the
properties with underground exfiltration systems that have not kept up with their
reportings to the city. If a response has not been received by the due date of January
31, 2025, penalties will begin for those properties. Per Board request, Ms. Monahan will
provide, in an upcoming agenda packet, the locations receiving the letters in Lake
Killarney and whether if in compliance or not. When a new exfiltration system or
underground stormwater management system is installed, the property owner is
required to sign an agreement with the city. The agreement is notarized by the
property owner and the city manager and then it is recorded with the property with
Orange County Records. The agreement explains the different maintenance
requirements, the expectations of the reporting that the city will receive and also the
penalties. With each letter that’s sent, a copy of the original signed agreement will be
provided.
8. Board Comments
Mr. Ellison asked the status of the docks that need to be torn down. Mr. Cordell
responded that one is left and will go before the code enforcement board in December.
A follow-up was requested for the next meeting.
The board discussed upcoming meeting dates. The next meeting will be January 7,
2025 at 10 am. The future meetings will follow the regularly scheduled first Wednesday
of the month through April.
Mr. Voecks asked for information about Mr. Marcotte's meeting with Mr. Necrason at
Nicolet pond. Mr. Marcotte advised there wasn’t a meeting at the pond and the
discussion with Mr. Necrason was held after the last LKB meeting regarding the
functions and dryness of the pond.

Killarney Drive pipe replacement engineering drawings along with the St. John’s permit
information.
Ask Dave Zusi to speak on the status of the lift station, answer questions on the
ordinances that currently exist, his stance on the letter, and address Mr. Voecks’
comments.

Provide the Code Board update related to the dock violation.
Include graph for debris and trash.
Provide the St. Johns River Water Management permit packet with engineering
drawings and information for the Killarney Drive pipe replacement.
Provide the private exfiltration maintenance systems locations within the vicinty of Lake
Killarney and those listed as non-compliant.
Mr. Voecks asked if the flood prone area map was updated as requested at the last
meeting. Ms. Monahan explained the flood prone area was updated, but not before it
was presented to the Commission. During the Western basin study, it was found that
the property at 2118 Lake Dr., the lowest final floor elevation, received some kind of
water intrusion due to Hurricane Nicole.
The buoy item was for educational and awareness purposes. The board will be updated
as the process is moved forward to City Commission.
Provide street sweeping vendor update when the solicitation process is complete, which
will likely be in February.
