Article 1: Scope and Limitations
Section 1:
All institution shall offer quality education. This
Code shall apply to all teachers in all schools in
the Philippines.

A teacher is a facilitator of learning. He shall render
the best services by providing an environment
conducive to such learning and growth.

When the best interest of the learners, the school, or
the profession is at stake in any controversy, teachers
shall support one another.

A teacher is not entitled to claim for not of his own
and shall give due credit for the work of others.

Before leaving his position, a teacher shall organize
and leave to his successor such records and other data
as are necessary to carry on the work.

yet been officially released or remove records from the

correctives for what may appear to be an
unprofessional and unethical conduct of any
associates.

writing, without violating any right of the individual
concerned.

policies of the school and the administration
regardless of professional feeling or private opinion
and shall faithfully carry them out.

A teacher shall not make any false accusation or
charges against superiors especially under anonymity.
However, if there are valid charges, he should present
such under oath to competent authority.

contractual obligation to live up to his contract
assuming full knowledge of the employment terms
and conditions.

courtesy, helpfulness, and sympathy towards teachers
and other personnel.

shall consider it their cooperative responsibility to
formulate policies or introduce important changes in
the system at all levels.

rules and private schools are issued contracts
specifying the terms and conditions of their work.

A teacher has the right and duty to determine the
academic marks and the promotion of learners in the
subjects they handle.
Section 2:
A teacher shall recognize that the interest and welfare
of the learners are his first and foremost concern.

Under no circumstances shall a teacher be prejudiced
nor discriminator against any learner.

A teacher shall not accept any favor or gifts from
learners, their parents or others in their behalf in
exchange of requested concession.

tutorials other than what is authorized for such
service.

work and quality of academic performance.

love develop between the teacher and the learner, the
teacher shall exercise utmost professional discretion to
avoid scandal, gossip, and preferential treatment of
the learner.

make deductions from their scholastic rating as a
punishment.

Section 11: Married Teachers
Whenever possible, the proper authorities shall take all
steps to enable married couples, both of whom are public
school teachers, to be deployed in the same locality.
Section 12: Academic Freedom
Teachers shall enjoy academic freedom in the discharge
of their professional duties, particularly with regards to
teaching and classroom methods.

▪ Engaged in classroom instruction – NOT MORE THAN 6
hours
That where the exigencies of the service require, any
teacher may be required to render more than 6 hours but
not exceeding 8 hours of actual classroom teaching a day
upon payment of additional compensation at the same
rate as his regular remuneration plus at least 25% of his
basic pay.
Section 16: Salary Scales
Salary scale of teachers shall provide for a gradual
progression from minimum to a maximum salary by
means of regular increments, granted automatically after
three years.
Section 19: Special Hardship Allowance
In areas in which teachers are exposed to hardship such
as difficulty in commuting to the place of work or other
hazards peculiar to the place of employment, as
determined by the Secretary of Education, they shall be
compensated by special hardship allowances equivalent
to at least 25% of their monthly salary.
Section 22: Medical Examination and Treatment
Compulsory medical examination shall be provided free
of charge for all teachers and shall be repeated bit not
less than once a year.
Section 24: Study Leave
❑ Teachers shall be entitled to study leave not exceeding
one school year after seven years of service.
❑ Teachers shall be entitled at least 60% of their monthly
salary
❑ No teacher shall be allowed to accumulate more than
one year study leave unless he needs additional
semester to finish his thesis for a graduate study

❑ The compensation allowed for one study leave
provided shall be subject to the condition that the
teacher takes regular study load and passes at least
75% of his courses.
❑ Study leave for more than one year may be permitted
by the Secretary of Education but without
compensation.
Section 25: Indefinite Leave
An indefinite sick leave of absence shall be granted to
teachers when the nature of the illness demands a long
treatment that will exceed one year at the least.

❑ For teachers in preschool, a bachelor’s degree in early
childhood education or its equivalent
❑ For teachers in elementary grades, a bachelor’s degree in
elementary education or its equivalent
❑ For teachers in secondary grades, a bachelor’s degree in
education or its equivalent with a major and minor OR a
bachelor’s degree in arts and sciences with at least 18 units
in professional education
❑ For teachers of vocational and two-year technical courses, a
bachelor’s degree with at least 18 units in professional
education
❑Professional teachers who have not practiced their
profession for the past 5 years shall take at least 12
units of education courses. (6 units in pedagogy and
6 units in content courses)
❑Those who failed the examination with rating of not
lower than five percentage from the passing general
average rating, shall be eligible as para-teachers.
❑Para-teachers shall be assigned to areas with
teachers’ shortage
❑A special permit may also be issued to a person who
has excelled and gained international recognition
and is widely acknowledged expert in his or her
respective field of specialization.
