NAMELY SH. SHAILENDER PRASAD BADONI.
MOST RESPECTFULLY SHOWETH:
1. That abovementioned matter is pending adjudication before this
Hon’ble court and fixed for today i.e. 09.08.2023.
2. That the accused is unable to attend today on account of severe pain
in his muscles due to covid infection and despite his best effort.
3. The exemption for 09.08.2023, is neither actuated with any mala fide
intent or to evade the court proceedings and the applicant further
undertakes to present before this Hon’ble court on the next date of
hearing and abide by all the conditions in the larger interest of
justice.
4. That the identity of the accused has been established and there is no
scope of being enlarged from the jurisdiction of this Hon’ble court.
5. That the applicant undertakes to appear before this Hon’ble court on
next date of hearing and further undertakes to be regular in his
appearance in future before this Hon’ble court.
6. That reason of absence of accused is neither wilful nor deliberate,
but all because of health condition only.
PRAYER
It is, therefore most respectfully prayed before this Hon’ble court
that accused may be granted exemption from his personal appearance
only for today to be the same in the interest of justice. It is prayed
accordingly.
