Negative List – Constituents of Process Materials

Foreword

This DBL is intended to put concrete specifications in place with regard to the employer's test
requirements in accordance with the German Hazardous Materials Ordinance ("Gefahrstoffverordnung")
and to facilitate the avoidance of disproportionate or inadmissible environmental impacts.

This edition supersedes the previous edition 2013-07 of this Standard.

Application note:
In line with the scope, application of the present version of this Standard is binding for new vehicle
projects or components for which no concept/basic specifications or component requirement specifications
have been approved yet at the date of issue of this version.
The respective contract documents regulate the mandatory application of the present version
of this Standard by the supplier.

Changes

In comparison with edition 2013-07, the following changes have been made:

1 Scope

This Supply Specification governs specific requirements with regard to the following process materials
in particular:

- Water-miscible process materials:


Water-miscible cooling lubricants/metal-forming lubricants, anti-corrosion additives,
cleaning agents, water-based hydraulic fluids, quenching media

- Non-water-miscible process materials:


Non-water-miscible cooling lubricants/metal-forming lubricants, lubricants for machine lubrication
(oils, greases), hydraulic oils, lubricants for materials handling technology, quenching oils,
spray oils

- Preservatives and disinfecting cleaning agents:


Water-miscible preservatives for post-conservation of cooling lubricants, as constituents of cooling
lubricants and skin cleaning agents (pre-conservation); disinfecting cleaning agents, disinfectants

- Temporary anti-corrosion agents, cold cleaning solvents

- Solvents in process materials, but also as constituents of other working materials

- Process materials: includes all substance groups indicated above

This DBL also applies to non-process materials or other working materials provided that the application
restrictions and environmental and work safety requirements are not governed in other specifications.

4 General requirements

For safety requirements, homologation (in particular, exhaust emissions) and quality, the existing statutory
requirements and laws shall be complied with. In addition, the relevant requirements of the Daimler Group
apply.

All materials, procedures, processes, components, and systems shall conform to the current statutory
requirements regarding regulated substances and recyclability.

With respect to its delivery or services, the supplier shall comply at all times with all the latest versions
of applicable statutory regulations regarding environmental protection, hazardous substances, dangerous
goods, work safety, and transportation. The supplier confirms that it has read the environmental protection
guidelines of the Daimler Group and shall comply with their contents in all its activities.

General: Substances and mixtures subject to German or European statutory restrictions or prohibitions
shall only be contained in accordance with these specifications in supplied or employed products.

The latest applicable edition of DBL 8585 shall be observed.

4.1 General clause

The concentrations of the elements/compounds listed in the table under Section 5 are limited for reasons
of environmental protection, protection of health and process technology.

The hazardous substances classified in the latest edition of Regulation (EC) No. 1272/2008
(CLP Regulation) as

- carcinogenic, mutagenic, toxic for reproduction, acute toxic category 1, 2 and 3,


specifically target-organ toxic (single exposure) category 1 and specifically target-organ toxic
(repeated exposure) category 1, and

- acute aquatic toxic, chronic aquatic toxic and hazardous to the ozone layer

shall be avoided on principle.

The hazardous substances classified in the latest version of Regulation (EC) No. 1907/2006 (REACH)

- as PBT (persistent, bioaccumulative, and toxic), vPvB (very persistent and very bioaccumulative),
and materials with similarly alarming properties (e.g. endocrine disruptors)

shall be avoided on principle.

In authorized exceptional cases, the substance shall be declared in each case irrespective
of the concentration.
The points indicated above apply even where the hazardous substances are not listed explicitly
in the following negative list (table in Section 5).

The supplier shall comply with the requirements contained in this negative list in combination
with the requirements of the relevant material DBLs. In case of any change
to the composition/classification, the decisive constituents shall be reported without further request.

Process materials shall not contain a larger quantity of prohibited substances than the contamination
generated during their production process. Deviations from the limits specified in Section 5 shall
be approved as part of the approval process for already approved and newly sampled products
by the Materials Engineering department and the environmental and work safety units of the concerned
plants or the Daimler Group environmental protection unit. For any process materials not regulated
by a DBL, approval shall be granted in accordance with rules and regulations specific to the plant,
e.g. by the work safety or environmental protection departments of the plant where the materials are used.
Limit values shall apply to process materials in their as-supplied condition. All substances contained
as part of a formulation which are governed by the laws on hazardous substances/environment
(e.g. German Hazardous Materials Ordinance, water legislation) or which require special care in handling
shall be declared, irrespective of the concentration of the respective substances in the mixture.

An EC safety data sheet for the mixture in accordance with Annex II of Regulation (EC) No. 1907/2006
(REACH) and BekGS 220 shall be submitted. Constituents shall be declared in accordance
with the requirements of DBL 6565, even if no notification is required according to Regulation (EC)
No. 1272/2008 (CLP Regulation) and the rules of the TRGS series. As part of the approval process
with regard to environmental and work safety impact, complete information on the formulation shall
be reported to the units responsible for environmental protection and work safety. Refer to DBL 6565
for the procedure. In the case of biocides, indicate whether approval has been granted
for the corresponding product type (indicate approval number).

The omission of a substance from the following list in Annex A does not imply that this substance
has general approval; rather, its status shall be checked on a case-to-case basis.

The classification and labeling of substances and mixtures shall be performed according
to the specifications of Regulation (EC) No. 1272/2008 (CLP Regulation).

Regulation (EC) No. 1907/2006 (REACH)


Daimler AG assumes that suppliers are aware of their obligations under Regulation (EC)
No. 1907/2006 (REACH), and that these obligations are fulfilled.

Registration and non-authorization of substances


The supplier shall ensure that substances, and substances in mixtures, requiring registration
or authorization are only supplied to Daimler if they have been registered according to Art. 5 and Art. 6
or Art. 7(1) of the Regulation (EC) No. 1907/2006 (REACH) for use at Daimler, or have been authorized
in accordance with Art. 55 ff.
If substances requiring registration/authorization have not been registered or substances in Annex XIV
of Regulation (EC) 1907/2006 (REACH) have not been registered/approved for the contractually intended
uses, the supplier shall contact the REACH representative of Daimler AG directly:
reach-kontakt@daimler.com.

Rule for substances listed in Annex XIV of Regulation (EC) No. 1907/2006 (REACH),
as such or in mixtures
In general, substances listed in Annex XIV of Regulation (EC) No. 1907/2006 (REACH) shall be avoided
when considered for use for the first time or when a mixture is newly developed.
Where the use of such substances is indispensable, such use is subject to the prior approval in writing
by the department responsible for the product at Daimler. The supplier shall provide evidence
of the approval by ECHA for the specific use and of the safe handling to the department responsible
for the product no later than at the time when the sunset date is reached.

The use of substances on the REACH candidate list should also be avoided, if possible, as a precautionary
measure when a substance or the new development of a mixture is considered for use for the first time,
provided that alternatives exist under the technical and economic constraints.

Where a currently supplied substance is listed in Annex XIV of Regulation (EC) No. 1907/2006 (REACH)
or where a currently supplied mixture contains a substance listed in Annex XIV, the supplier shall inform
the department responsible for the product directly in order to initiate plans for substitution or, if applicable,
authorization of the respective substance and provide evidence of safe handling. In the case
of a substitution, the supplier shall supply an updated safety data sheet in each case.
Suppliers of sales products shall liaise with the responsible sales contact of Daimler AG in this respect.

Other rules
Where process materials are classified as classes 1 to 9 of the Ordinance on the Domestic
and International Transport of Dangerous Goods by Road, Rail and Inland Waterways (GGVSEB,
in its latest version) as a result of their constituents, the specified measures with regard to packaging,
labeling, declaration, and transportation shall be observed.

Process materials of water contamination class 3 are prohibited in principle. Any exceptions are subject
to the approval of the departments in the plants or headquarters with responsibility for health,
environment and material-related approvals.

Any constituents recognized as sensitizing in accordance with TRGS 907 and skin-absorbent materials
in accordance with TRGS 900 shall be revealed. Animal raw materials shall be declared.

In addition, the latest version of the VKIS-VSI-IGM List of Substances for Metal Working Fluids According
to DIN 51385 shall apply. This can be downloaded from www.vkis.org.

4.2 Obligations to provide documentation and evidence

On request, the supplier shall provide Daimler AG with information regarding compliance with statutory
obligations to provide documentation or evidence (e.g. VOC values).

4.3 Time frame for product adjustments

Where product adjustments are required due to changes in laws, classifications, technical specifications
etc., the following deadlines shall apply:

Samples of all products shall be submitted after notification of a required product adjustment
within the following periods:

"to be targeted in the short term" within 12 months


"to be targeted" within 24 months
"to be targeted in the long term" within 48 months

Declaration = A substance indicated with “Declaration” shall be declared irrespective of the concentration. The indicated concentrations in the column "Limit value"
