Bl:The said Samuel Victor, i.e., Land owner No.1 became owner of the said eastern
portion of the property by virtue of the above said WILL. The said Rose Sumitra
also registered a Will dated 12-03-1999 bearing Document No.38/B-1I/1999
registered at SRO Marredpally, Secunderabad, bequeathing her half share i.e.,
western portion of the said property in favour of Solman Thomas and Mr.Mano
Anand. The said Rose Sumitra died on 14-11-2002 leaving behind the said
registered will deed dated 12-03-1999. The said Mano Anand and Solomon
Thomas, thus became absolute owners of the western portion of the said
property.
AND WHEREAS, the said Mr.Mano Anand also died on 20-09-2016 leaving
behind his wife i.e., Land owner No.2 and Daughter ie., Land Owner No.3 and
Son ie., Land owner No.4 as his legal heirs, thus the Land owners No.2 to 4
herein succeeded to the 1/4 share of the said MrMano Anand in the said
property. The said Solomon Thomas died on 01-02-2009 leaving behind the Land
owners No.5 and 6 as his legal heirs, thus they succeeded to his 1/4" share in
the said property.
AND WHEREAS, the Land owners herein decided to entrust the eastern
portion of land admeasuring 315 Sq.yards belonging to Land Owner No.1 and
157.5 sq.yards (western portion) belonging to the Land owners No.2 to 4 and
157.5 sq.yards (western portion) belonging to the Land owners No.5 and 6, thus
in all 630 sq.yards, bearing Plot No.214, situated at Marredpally, Secunderabad,
which is morefully described in the Schedule mentioned hereunder and
hereinafter referred to as the Schedule property, to the developer herein for
development of the sald plot into building into a complex comprising of
apartments.
NOW THIS AGREEMENT WITNESSES AS FOLLOWS:
PERMISSION FOR DEVELOPMENT : -
1). That the Land Owners hereby declare that the Land Owners are
the absolute owners and possessors of the schedule property. The
schedule property is free from all encumbrances, charges, liens,
mortgages, court attachments and acquisition proceedings and the Land
Owners have not entered into any agreement whatsoever in respect of the
schedule property with any other third parties.
2). The Land Owners are at liberty to make inspection of the
construction work during the course of the work at all reasonable times.
However, the Land Owners shall not cause any hindrance or obstruction
whatsoever to the construction work. The Developer being in actual
possession of the schedule property by virtue of these presents shall be
exclusively in charge of the entire construction of the proposed Building
without any let or hindrance or interference by the Land Owners or any

Brel3). The Land owners hereby authorize and empower the Developer
herein to develop the schedule property along with the adjacent land into a
single building and obtain a joint sanction and permission with the adjacent
land.
PLANS:
ENCES :-
1). The Land Owners hereby authorise and empower the
Developer to develop the Schedule Property into a Building comprising of
Stilt for parking and Five Upper Floors and for that purpose to apply and
obtain a sanctioned plan from Greater Hyderabad Municipal Corporation
and the Concerned authorities. The Developers shall also obtain the
necessary Occupancy Certificate from the concerned authorities after
completion of the construction of the Building.
2). The Land Owners shall sign the plan and other necessary
documents as may be required for the purpose of obtaining the proposed
plan. The Land owners further hereby declare and confirm that the Land
owners hereby grant irrevocable rights of development to the Developer for
the development of the Schedule property. The Land owners further hereby
undertake and covenant that the development rights granted hereunder
shall not be revoked under any circumstances.
CONSTRUCTION
1). The Developers shall carry out the construction of the proposed
Building in the Schedule property based on the working plans/drawings as
decided between the parties. The Land owners constructed share shall be
in accordance with the specifications contained in the Annexure hereto.
However, the construction of the entire Building shall be of good quality as
per the agreed specifications enclosed to this Agreement.
2). The Developers will be entitled to engage Architects, Engineers,
Contractors and others, as they deem fit to execute the construction work:
however in case of disputes between the Developers and it's Contractors,
Architects, Engineers and other workmen, suppliers of materials and other
persons who are engaged by the Developers in the development of the
schedule property, the same shall be settled by the Developers and the
Land owners shall have no liability of any nature whatsoever nor will the
Land owners be deemed to be the Principal Contractor
3). Any internal changes without any additions required to be carried
out by the Land owners, the Developers shall execute the same, if feasible
and brought to the notice before commencement of the work and any extra
amount for such modifications and alterations shall be paid by the Land
