Subject: Hindrances Faced During Execution of Works on Khowai-Teliamura Section of NH-208
Dear Sir,
We would like to bring to your attention several significant hindrances affecting the progress of the improvement
and widening project for the Khowai-Teliamura section (Km 101+300 to Km 127+319) of NH-208, which is being
executed under the EPC contract.
Below are the key hindrances along with their relevant locations:
1. Structure Removal: The shifting of utilities and execution of the project is getting significantly delayed,
particularly in sections like Dwarikapur, Kunjaban, Purbo-Kalyanpyur, Kamalnagar due to issues related to
non-payment for structures and shops by the CALA as well as delay in shifting of logs by the forest
department. According to Clause 3.1 (iii)(a) of the EPC contract, the Authority is obligated to provide 90%
of the Right of Way (ROW) free from encumbrances within 30 days of the agreement. However,
continuous working fronts are unavailable due to compensation issues for private structures, violating this
clause. Moreover, a re-assessment of missing structures needs to be completed on an immediate basis
for all the mouzas within the project highway zone.
2. Tree Cutting Issues: In many sections, tree cutting on private lands remains incomplete due to
compensation issues. This has hampered our ability to proceed with roadworks. As per Clause 9.4, the
Authority is responsible for felling trees and obtaining necessary permissions. The delay in executing this
obligation is causing substantial disruption in project activities. As per clause 9.5, in the event of any delay
in dismantling of structures for reasons beyond the control of the contractor, the contractor is entitled to
damages and time extension. The removal of logs by the forest department has been extremely slow and is
hampering the project significantly.
3. Culvert Hindrances: We are currently not able to execute the construction of 7 culverts owing to the
existence of structures as mentioned in the enclosure.
At present, we still have approximately 10 kilometers of total stretches affected by hindrances owing to structure,
tree log shifting, and tree-cutting related issues. We request your urgent intervention in resolving these issues.
Without clearing these hindrances, the work progress will continue to be severely hampered, risking delays in the
overall project completion. The uninterrupted availability of work fronts is essential for maintaining the project
schedule as per the agreed terms under the EPC contract.
