PREAMBLE

In pursuance of the National Youth Wing’s duties under Articles 15(4)(vii)


and (c) of the NPP’s Constitution 2017 as amended;

Towards creating a nation-wide organization within the Party to cater for


activities and interest of young members;

In recognition of the Youth as the fulcrum for the sustainability of the Party;
and

In promotion of Youth participation in activities of the Party and Ghana’s


democratic process as a whole, these regulations are hereby adopted to
govern the activities of all TESCON branches.

iv TESCON REGULATIONS
REGULATION 1 - TESCON
(1) This Association shall be known as and called TERTIARY STUDENTS’
CONFEDERACY of the New Patriotic Party, herein after referred to as “TESCON”
(2) The motto of the Association shall be, “COMMITMENT WITHOUT
INDUCEMENT”

REGULATION 2 - THE REGULATION


(1) This Regulation shall be the National TESCON rules and regulations and
shall, subject to the laws of Ghana and the Party’s Constitution, govern all
TESCON branches.
(2) Any member who alleges that:
(a) a rule, regulation, directive or guideline contained in, given by or done
under the authority of any Member, Members in a general meeting, the
Executive Committee, or by a Committee established by this Regulation or
the Executive Committee or Members in a general meeting; or
(b) any act or omission of any Member, Members in a general meeting,
the Executive Committee, a Member of the Executive Committee or by a
committee established by this Regulation or the Executive Committee or
Members in a General meeting; is inconsistent with, or is in contravention of a
provision of this Regulation, shall in writing, petition the Judicial Committee.
(c) The Judicial Committee upon receipt of a petition shall within seven (7)
days hear and determine the matter.

REGULATION 3 - ESTABLISHMENT OF A TESCON BRANCH


(1) A TESCON branch may be established in a tertiary institution by the
Regional Youth Wing at where the institution is located.
(2) Notwithstanding sub-regulation 1 of this Regulation, a TESCON branch
shall not be established in any tertiary institution unless:
(a) It has at least two (2) persons who have agreed to become patrons of that
TESCON branch;
(b) It has at least twenty students recognized by the institution as such.
(c) A certificate of recognition has been issued by the National Youth Wing.

The Regional Youth wing upon satisfying itself that a branch has met the
requirements stated in sub-regulation 2 (a) and (b), shall recommend to the
National Youth Wing for the issuance of a Certificate of Recognition
(3) Upon receipt of the certificate of recognition, the inauguration of a new
branch shall take place on the campus of that branch except the rules of the
institution prohibit such activities on campus.
(4) Without prejudice to sub-regulation (2)(a), the Regional Youth wing in
consultation with the National Youth wing shall take appropriate steps to
establish a branch in an institution where there exist difficulty in finding a
staff or lecturer to serve as Patron.
(5) Without prejudice to sub-regulation (1) and (2), a TESCON branch upon
coming into existence shall not cease to exist though the number of patrons
may be less than the requirement.
(6) A branch can only be granted voting right(s) at both Regional and National
Conferences when it has been in existence for not less than one year since
receipt of its certificate of recognition from the National Youth Wing.
(7) Without prejudice to sub-regulation 2(c) and 6, a branch may operate prior
to the receipt of its certificate of recognition but shall have no voting rights
until the issuance of the certificate and in accordance with these regulations.
(8) In order to promote mass participation and enhance operational efficiency
of TESCON, each branch shall:
(a) Have a Cell to operate in Halls, Hostels and places of residence for
students of that branch.
(b) A Cell shall have a Leader and Deputy whose function is to constantly
engage cell members and mobilize them for TESCON activities.
(c) For the purpose of this provision, Cell leaders shall be part of the
Organising Committee captured in Regulation 14(1)(a)

REGULATION 4 - AIMS AND OBJECTIVES OF TESCON
The aims and objectives of TESCON shall subject to the Party Constitution,
the regulations governing students’ activities in that institution and directives
that may be given by the Regional Youth Wing or the National Youth Wing
include:
(1) Serve as branches of the Youth Wing in the tertiary institutions
(2) To promote the party’s name on campus(es), articulate the party’s ideology
to like-minded students and get them to become members of the party
(3) To foster and actively promote unity among students in the tertiary
institutions.
(4) To provide an avenue for its members to deliberate and contribute to
issues affecting the youth of the Party and the nation in general.
(5) To provide political, social and economic education and awareness to
the people of Ghana.
(6) To provide an avenue for training, support and grooming potential and
future leaders for the party.
(7) To ensure that there are equal opportunities for all citizens without
discrimination on any grounds whether of gender, age, position, politics,
religion or status.
(8) To identify like-minded lecturers, tutors and other staff who share the
same ideology and work with them.

REGULATION 5- TESCON COORDINATOR


(1) National TESCON Coordinator
(a) There shall be a National TESCON Coordinator and two (2) deputies
(b) The National TESCON Coordinator and deputies shall be appointed by
the National Youth Organiser in consultation with the National Youth wing.

(2) Regional TESCON Coordinator
(a) There shall be a Regional TESCON Coordinator and a deputy
(b) The Regional TESCON Coordinator and the deputy shall be appointed
by the Regional Youth Organiser in consultation with the Regional Executive
Committee.
(3) Duties and Responsibilities:
The Office of the National TESCON Coordinator and Regional TESCON
Coordinator shall under the directives given by the National and Regional
Youth Wing respectively perform the following functions:
(a) Monitor, supervise and coordinate the activities of all TESCON branches.
(b) Keep an up to date register of all TESCON branches and members
(c) Perform any other functions that shall be assigned by the Regional and
the National Youth Wing as the case may be.

(4) Eligibility
A Person shall not be eligible to be appointed as National TESCON Coordinator
or Regional TESCON Coordinator unless:
(a) He is of sound mind
(b) He has graduated from an accredited TESCON Institution
(c) He served as TESCON Executive and was awarded a Certificate of Service
or:
(d) He was an active TESCON Member and shows proof of membership by
either TESCON ID validly issued or letter of recommendation given under
the hand of the Chief Patron of his former branch.
(e) He has no proven record of embezzlement or misappropriation of
funds or has not behaved in a manner capable of bringing the good name
of TESCON or the Party into disrepute or public ridicule.
(f) He has no proven record of having committed an electoral offense or
disobeyed a decision of the hierarchy of the TESCON and the Party
(g) He has no proven record of being guilty of a deliberate violation of the
party constitution or TESCON Regulations.

(h) He has not been convicted and sentenced by a court of competent
jurisdiction in respect of any offence involving high treason, or an offence
involving the security of the state, dishonesty, fraud or moral turpitude

(5) Grounds for Removal from Office


The following shall constitute grounds for the removal of National and
Regional TESCON Coordinators from office:
i. Dereliction of duties
ii. Violent, dangerous or intimidating conduct against another Patriot
iii. Falsification of report, account or expense claim or other fraudulent
conduct
iv. Wilful damage of TESCON/Party property
v. Breach of the duty to uphold publicly TESCON/Party policies
vi. Creation of disorder or factionalism within TESCON/ Party
vii. Bringing the name of TESCON/Party into disrepute or public ridicule
viii. Defection to another Party
ix. Supporting a candidate who is not a TESCON member in an SRC elections
x. Insubordination to TESCON and party hierarchy
(6) Removal Procedure
(1) A National TESCON Coordinator or Regional TESCON Coordinator shall
not be removed from office except on grounds contained in this Regulations.
(2) A National TESCON Coordinator or Regional TESCON Coordinator shall
be removed from office in accordance with the procedure specified in this
Regulations.
(3) In the case of National TESCON Coordinator or deputy, the National
Youth Organiser upon receipt of a petition for removal from office, shall
appoint a Committee made up of three (3) Regional Youth Organisers, who
shall determine within one (1) week, whether there is a prima facie case.
(4) Where the body mentioned in sub-regulation (3) establishes a prima facie
case from the petition, the National Youth Organiser shall within 48 hours
forward the petition to the National Youth Wing Disciplinary Committee
for final determination.

(5) The National Youth Wing Disciplinary Committee shall be constituted by
the National Youth Organiser upon assuming office and shall within one (1)
week upon receipt of a petition for removal, summon the affected TESCON
Coordinator to hear and decide on the matter.
(6) In the case of Regional TESCON Coordinator or deputy, the Regional Youth
Organiser upon receipt of a petition for removal from office, shall within 24
hours, forward it to the Regional Youth wing Disciplinary Committee who
shall within one (1) week determine the case.
(7) The Committee mentioned in sub-regulation (6) shall be constituted by
the Regional Youth wing at its first meeting.
(8) The National Youth wing Disciplinary Committee shall have appellate
jurisdiction to review decisions taken by the Regional Youth Wing Disciplinary
Committee.
(9) An aggrieved Regional TESCON Coordinator who is dissatisfied with the
decision of the Regional Youth Wing Disciplinary Committee shall, within
one (1) week of the decision, appeal to the National Youth Wing Disciplinary
Committee.
(10) The National Youth wing Disciplinary Committee shall be chaired by
the Dean of Regional Youth Organisers and its decision shall be final and
binding on all parties.
(11) A TESCON Coordinator who is the subject to such a petition may be
suspended by the National Youth Organiser or Regional Youth Organiser, as
the case may be, upon the determination of a Prima Facie case.

REGULATION 6 - PATRONS
(1) A patron is a staff, lecturer or any person appointed by the TESCON
Executives Committee with the prior approval of the Regional Youth Organiser.
(2) At least one of the Patrons shall be a lecturer at the institution where the
TESCON branch has been formed.
(3) Members of Parliament are automatically Patrons of branch(es) within
their respective constituencies.
(4) When the Party is in government, Metropolitan, Municipal and District
Chief Executives (MMDCEs) shall become Patrons of branch(es) within
their assembly.

(5) There shall be a Chief Patron who shall be appointed by the patrons from
among themselves
(6) Duties and Responsibilities;
(1)
i. Provide advise to the Executive Committee on issues related to TESCON
and its members
ii. Provide financial and logistical support
iii. Assist and support the activities of the TESCON branch
iv. Perform any such functions that may be assigned by the Regional Youth
Organiser or National Youth Organiser.
(2) The mandate of Patrons shall be strictly advisory.

REGULATION 7 - MEMBERSHIP
(1) Membership:
(a) Membership of TESCON shall be open to all citizens without regard to
gender, ethnic affiliation, origin, religious affiliation or status.
(b) Without prejudice to sub-regulation (1) of this Regulation, a person shall
not be registered as a Member of a TESCON branch unless:
i. he is a student of that tertiary institution and has;
ii. Completed an application form containing the name of that tertiary
institution, his full name, region, constituency, year of enrolment into that
tertiary institution and year of expected completion, Contact, Whatsapp
number and other social media handles, Email address and Digital Address.
(c) Every person whose application is accepted shall have his name entered
into the TESCON register of Members of that branch and may be issued
with a TESCON Card.
(d) A copy of an up to date TESCON register of Members of each branch shall
be sent to the office of the National TESCON Coordinator and the Regional
Youth Wing at the end of every semester.
(2) Dues and Donations:
(a) Every Member shall pay such dues and levies as may be directed by the
National Youth Wing.

(b) Any person or group of persons who agree with the aims, objectives,
policies and programmes of TESCON may make donations to TESCON.
(3) Rights of Members:
A Member shall have the right to:
(a) Participate in all activities of TESCON subject to rules and regulations
governing such activities
(b) Be heard whenever his or her activities and conduct are in question and
under consideration.
(c) Contest for any position or office within TESCON subject to this Regulation
and other rules and regulations governing the elections.
(4) Duties of a Member:
A Member shall:
(a) Protect and promote the good name of TESCON
(b) Protect the unity of TESCON
(c) Be loyal and truthful to TESCON
(d) Abide by and publicly uphold the decisions of TESCON
(e) Carry out his duties faithfully and with honesty to the best of his ability.
(f) Fully participate in the activities of TESCON
(g) Pay every semester, dues and levies as may be directed by the National
Youth Wing
(h) Not to initiate, commence or prosecute any legal proceedings whatsoever
against the New Patriotic Party, the Youth Wing, TESCON and any member
of TESCON relating to affairs concerning TESCON without first having
exhausted all procedures laid down in this Regulation.
(5) Misconduct:
The following acts by a member constitute a misconduct and may be grounds
for expulsion of that member from TESCON:
i. Violation of the duties of a member
ii. Violent, dangerous or intimidating conduct against another member
iii. Falsification of reports, accounts or expense claims or other fraudulent
conduct.

iv. Wilful damage or unlawful possession of property of TESCON.
V. Creation of discord or factionalism within TESCON
vi. Bringing the name of TESCON, the Youth Wing or the Party into disrepute
or public ridicule.
vii. Deliberate violation of the TESCON Regulation.
vii. Obtaining a membership status of another political party or a student
movement affiliated or sympathetic to another political party
(6) Suspension of a Member:
(a) A member may be suspended by the Executive Committee pending an
enquiry into his conduct by the Judicial Committee.
(b) Without prejudice to paragraph (a) of this sub-regulation, an Executive
Committee member may be suspended by the Regional Youth Organiser in
consultation with the National Youth Organiser pending an enquiry into his
conduct by the Judicial Committee.
(c) Any decision to suspend a member or an Executive Committee member
shall be communicated to him in writing and copied to the Judicial Committee.
(d) An enquiry into the conduct of an executive member SHALL be concluded
within two weeks upon suspension.
(7)Expulsion of a Member:
(a) A member may be expelled from TESCON by the Judicial Committee on
grounds of misconduct in accordance with this Regulation upon a petition
by any member supported by ten (10) members of good standing or three
(3) members of the Executive Committee.
(b) Any person who is expelled, accordingly ceases to be a member and shall
return to the Secretary any TESCON property in his or her custody and shall
forfeit any monies, dues, levies, or donations made to TESCON
(8) Resignation of a Member:
(a) A member shall cease to be a member by writing and signing a letter
addressed to the President declaring his or her intention to cease to be a
member and forthwith surrendering his or her TESCON membership card
if any.

(b) Any person who, accordingly ceases to be a member of TESCON shall
return to the Secretary any property of TESCON in his or her Custody and
shall forfeit any monies, dues, levies and donations made to TESCON.

REGULATION 8 - ELECTORAL COMMISSION


(1) There shall be an independent Electoral Commission (EC) in each branch
which shall consist of:
(a) A Chairman
(b) Deputy Chairman
(c) Secretary
(2) The Chairman, deputy Chairman and Secretary of the Electoral Commission
shall be appointed by the Executive Committee with the approval of the
General Assembly
(3) If a member of the Electoral Commission ceases to be a member, the
commission shall continue its work, until such vacancy is filled in accordance
with this Regulation.
(4) The Chairman of the Commission SHALL in consultation with the members
of the Commission appoint such persons or create an ad-hoc committee(s)
as he deems necessary for the fulfillment of the mandate of the Commission.
(5) Without prejudice to clause (1), the Electoral Commission shall work
under the direct supervision of the regional elections committee.
(5) Functions
The Electoral Commission shall have the following functions:
(a) Conduct and supervise all elections of that TESCON branch;
(b) Formulate and implement rules and regulations for conducting elections;
(c) Perform such other functions as may be prescribed by the General
Assembly or by the Executive Committee.

(6)Removal and Resignation from Office


a) A petition for the removal of the EC Chairperson or Deputy Chairman
or secretary shall be signed by at least 20 members of good standing
and sent to the Judicial Committee and a copy given to the executive

committee and the Regional Youth Organiser through the Regional
TESCON Coordinator.
b) Such petition must be determined within one week of submission.
c) When a commissioner resigns, the Executives must within two weeks
appoint replacement with strict adherence to Regulation 8 (2).

REGULATION 9 - ELECTIONS
(1) General Provisions:
(a) The Electoral Commission shall, one (1) month to the general elections, provide
an electoral timetable together with rules and regulations to govern the elections.
(b) A breach of paragraph (a) above, shall not nullify the election results if the
justification of the Electoral Commission is upheld by the Judicial Committee upon
a petition by a TESCON member. Such a petition must be disposed off within 3
days of receipt with a further right of appeal in accordance with Regulation 15 (7).
(c) The Electoral Commission shall compile the electoral register and make same
available to all aspirants, at least, one week to the election.
(d) For the purpose of elections of Executive Committee members, only members
in good standing at the TESCON branch shall have voting rights.
(e) A simple majority shall be required to win an election. Candidates who stand
unopposed shall require a 50% + 1 of the total votes cast to win the position thereof.
(f) In the event of a tie, there shall be a re-run of elections for that position between
the first two candidates with the highest votes and the one with the simple majority
shall emerge the winner.
(g) The Electoral Commissioner shall declare provisional results soon after counting
the ballots cast and unless such results are challenged, the Electoral Commission
shall declare the final results within forty-eight (48) hours after counting.
(h) Provisional results of the elections can be challenged within forty-eight (48)
hours after the results have been made public. No complaints shall be entertained
after the expiration of the stipulated period and the results shall be declared final
by the Electoral Commission.
(i) Any election petition shall be addressed and presented to the judicial committee,
in person or via available electronic means, and copied to the Electoral Commission

and the Regional Youth Organiser through the Regional TESCON Coordinator within
48hrs after the declaration of the provisional results.
(j) The Judicial Committee shall sit within 48 hours on receipt of the petition to
determine the matter.
(k) In the case of an appeal against the decision of the Judicial Committee in an
election matter, the appeal shall be made to the Regional Elections Committee
via electronic or physical means within twenty four (24) hours and same shall be
determined within 48 hours.
(l) A further appeal may be lodged to the National Election Appeals Committee
against the decision of the Regional Elections Committee in electoral matters via
electronic or physical means within twenty four (24) hours of the decision and same
shall be determined within 48 hours.
(m) If a challenge is upheld, fresh elections for the affected position(s) shall be held
at a date determined by the Judicial Committee or the Regional Youth Wing, as the
case may be.
(n) In the event that elections cannot be held, interim executives shall be appointed
by the Regional Youth Organiser in consultation with Patrons, Regional TESCON
Coordinator and current/outgoing executives with the approval of the National
Youth Organiser.
(o) The Regional Youth Organiser in consultation with the Regional TESCON
Coordinator and Patron(s) shall periodically review the situation and give informed
directives for the conduct of elections as soon as practicable.
(p) Candidates who are elected to various positions at the TESCON branch shall have
no powers except that provided under Regulation 16 until handing over is done in
accordance with this Regulation
(q) The tenure of office of Executive Committee Members shall be one (1) academic
year after which the executive may seek re-election in accordance with this Regulation.

(2) Regional Elections Committee


There shall be an Elections Committee in all the 16 regions which shall
exercise supervisory role over the conduct of elections at branches within
their respective regions. The Regional Elections Committee shall consist of:
i) Regional Youth Organiser as Chairperson
ii) Deputy Regional Youth Organiser as a member

iii) Regional TESCON Coordinator as a member and Secretary to the
Committee.
iv) One representative from the Constituency Youth Organisers appointed by
the Regional Youth Organiser in consultation with the Regional Youth Wing
v) One representative from the region’s TESCON Patrons appointed by the
Regional Youth Organiser in consultation with the Regional Youth Wing.

(3) National Elections Appeals Committee


i) The National Youth Organiser or a Deputy or a representative shall be the
Chairperson of the Appellate body should there be any matter arising from
the conduct of the elections within the various regions;
ii) The National Tescon Coordinator or a deputy shall be a member and
Secretary to the Appeals Committee.
iii) The Dean of the Youth Organisers shall be a member of the Committee
iv) One representative from among TESCON Patrons appointed by the
National Youth Organiser in consultation with the National Youth Wing
shall be a Member of the Committee
v) One person appointed by the National Youth Organiser in consultation
with the National Young Wing shall be a member of the Committee.
(4) Vetting and Report:
(a) There shall be a Vetting Committee to vet all aspirants into any of the
Executive Committee positions. The Committee shall consist of:
i. The National Youth Organiser or his Representative
ii. The Regional Youth Organiser or his Representative
iii. The Regional TESCON Coordinator or his Deputy
iv. The Electoral Commissioner who shall be secretary to the Committee
v. One Executive Member, preferably the President, who is not an aspirant.
(b) Before the presentation of manifesto by the aspirants, the Electoral
Commissioner shall submit a report from the vetting committee to the
General Assembly by way of announcement and such report shall not give
the ranking of the candidates.
(c) Vetting of candidates shall concern the eligibility or otherwise of candidates
as provided by this Regulation.

(d) Any candidate who wishes to contest for office shall submit himself to the
Vetting Committee for thorough vetting in accordance with the provisions
of this Regulation.
(e) The vetting committee shall have the power to recommend any candidate
based on the eligibility of the candidate as stated in Regulation 9(5).
(f) For the avoidance of doubt, any candidate(s) not recommended shall not
be presented to the General Assembly for voting.
(5) Eligibility of Candidates:
Any candidate for election to the Executive Committee of the TESCON
branch shall:
(a) Be a member of the TESCON branch.
(b) Not be a final year student
(c) Be of sound mind
(d) Have the ability to convince the vetting committee that he is competent
to hold that Executive Committee position.
(e) Not have a proven record of embezzlement or misappropriation of funds
or have behaved in such a manner as can be described as detrimental to the
good reputation of the student population or tarnish the prestige of the
Association in particular or the institution as a whole.
(f) Not be eligible if it is proven that he has committed an electoral offence
or has disobeyed a decision of the hierarchy of the Branch
(g) Not be eligible if it is proven that he has been guilty of a deliberate violation
of the TESCON Regulations.
(h) Not be eligible if he has been convicted and sentenced by a court of
competent jurisdiction in respect of any offence involving high treason, or an
offence involving the security of the state, dishonesty, fraud or moral turpitude

(6) Electoral Offences:


Contravention of any of the procedures and rules specified by the Electoral
Commission for the conduct of elections shall constitute an offence and the
offender(s) shall be disqualified from contesting in that particular election.

REGULATION 10 - GENERAL ASSEMBLY
(1) The General Assembly shall concern itself with matters of general policy
and any other matter(s) brought by National or Regional Youth Wing,
National TESCON Coordinator, Executive Committee, Judicial Committee
or motions standing in the names of not less than ten (10) members of the
Branch. Decisions taken and resolutions passed by the General Assembly at
their meeting on any matter shall be regarded as a decision of that TESCON
branch.
(2) There shall be at least three (3) General Assembly meetings within a
semester.
(3) A notice to convey a General Assembly meeting shall explicitly state the
matters to be discussed.
(4) The Executive Committee may convene an extra-ordinary General
Assembly meeting as circumstances may dictate.
(5) The President shall be obliged to convene an extra ordinary General
Assembly meeting if the Executive Committee or twenty (20) members of
that TESCON branch make a request stating the agenda for that meeting. The
failure of the President to convey an extra-ordinary meeting in accordance
with this sub regulation shall be a ground for impeachment.
(6) The Executive and General Assembly may invite any person(s) to address
the General Assembly on any matter affecting the interest of the Branch,
students or the general interest of the Nation.
(7) The General Assembly may ratify or reject any decision taken or any motion
initiated by the Executive Committee or Committees acting on its behalf.
(8) There shall be 3 executive members and at least 20 members to form a
quorum for General Assembly meetings and in the absence of the president
or vice one of the executive members shall chair.
(9) Without prejudice to the power of the General Assembly, no decision
of the General Assembly of any TESCON branch which involves embarking
on an activity outside their institution or holding a programme which will
bring dignitaries from outside their institution shall be implemented without
prior consultation with the Regional Youth Organiser.
(10) The decision of the general assembly shall be by simple majority

REGULATION 11 - EXECUTIVE COMMITTEE
(1) There shall be an Executive Committee which shall direct the affairs of
a TESCON branch.
(2) The Executive Committee shall consist of the following members
(a) President
(b) Vice President
(c) Secretary
(d) Assistant Secretary
(e) Organiser
(f) Women’s Commissioner
(g) Communication officer
(h) Nasara Coordinator
(i) Treasurer
(3) Without prejudice to paragraph (f) of sub regulation (2), there shall not
be a Women’s Commissioner in a single sex TESCON branch.
(4) The Executive Committee shall, at its first meeting, appoint qualified
persons to the following positions:
(i) Research Officer
(ii) Deputy Organiser
(iii) Deputy Women’s Organiser
(iv) Deputy NASARA coordinator
(5) The Executive Committee shall meet at least once every two (2) weeks.
(6) The President shall hold an emergency meeting upon a request made
in writing stating the proposed agenda and signed by not less than Seven
Members of the Executive Committee. A failure of the President to hold an
emergency meeting in accordance with this section shall be a ground for
impeachment.
(7) The Executive Committee may constitute a Sub-Committee or appoint
such persons to assist the Committee in the performance of its functions
subject to the approval of the General Assembly.
(8) The quorum for Executive Committee meetings shall be seven (7)
members.

(9) Without prejudice to the powers of the Executive Committee, no decision
taken by the Committee shall have effect unless at the time of taking the
decision, more than seven of the members of the Committee voted in
support of the decision.
(10) The Executive Committee shall at each General Assembly meeting
present a report on its operations.

REGULATION 12 - FUNCTIONS OF THE EXECUTIVE


COMMITTEE MEMBERS
(1) President:
There shall be a President who shall perform the following functions:
(a) Be the chief spokesperson of the TESCON branch
(b) Chair all Executive Committee and General Assembly meetings.
(c) Through directives to the Secretary convene Executive Committee
meetings and General Assembly meetings.
(d) Supervise and co-ordinate the activities of members of the Executive
Committee.
(e) Together with the Chief Patron and Treasurer, be a signatory to the bank
account of the TESCON branch.
(f) Perform any other functions that may be assigned to him by the National
Youth Wing, Regional Youth Wing, National TESCON Coordinator or the
Patrons.
(2) Vice President:
There shall be a Vice President who shall perform the following functions:
(a) Assist the President in the performance of his functions
(b) Act in the absence of the President and when acting, shall be vested with
all the powers of the President.
(c) Chairman for the Research Committee
(d) Perform any other function as may be assigned by the President or
Executive Committee.

(3) Secretary:
There shall be a Secretary who shall perform the following functions:
(a) Keep records of correspondence, register of members, assets, and shall
take minutes of meetings.
(b) Take directives from the President, the Executive Committee, the Regional
Youth Wing to fix date and venue for meetings.
(c) Perform any other functions that may be assigned by the President or
the Executive Committee.
(4) Assistant Secretary:
(a) The Assistant Secretary shall assist the Secretary in the performance of
his functions.
(b) Assistant Secretary shall be the secretary for the Research Committee.
(c) Perform any other functions as may be assigned by the President or the
Executive Committee.
(5) Organiser:
There shall be an Organiser who shall perform the following functions:
(a) Responsible for the organizational work of the TESCON branch
(b) Responsible for organising membership drive, establishing contacts at
all levels among members
(c) Mobilise people and Members for all TESCON programmes except where
invitation is restricted.
(d) Select TESCON representatives, supervise and monitor their activities
at the Halls, Hostels, faculties, departments and other facilities as may be
necessary.
(e) Chair the Organising Committee
(f) Perform any other function as may be assigned by the President or the
Executive Committee.

(6) Women’s Commissioner:
There shall be a Women’s Commissioner who shall perform the following
functions:
(a) Responsible for organising membership drives that will enroll females
into TESCON.
(b) Set up TESCON Ladies Club (TLC) that will assist in the membership
drive and to organise programmes for the females.
(c) As member of the Organising Committee, she shall assist the Organiser
in the performance of his duties.
(d) Perform any other functions as may be assigned by President or the
Executive Committee.
(7) Communication Officer:
There shall be a Communication Officer who shall perform the following
functions:
(a) Act as the spokesperson for the TESCON branch in all forms of
communication
(b) Disseminate positive information about the New Patriotic Party and
TESCON to the members, the student population and the general public.
(c) Perform any other functions as may be assigned by the President, the
Secretary and the Executive Committee.
(8) Nasara Coordinator:
There shall be a Nasara Coordinator who shall perform the following functions:
(a) Responsible for membership drive that will recruit students from the
minority groups, religious groups and the Zongo communities.
(b) Provide an up to date information on the activities of the students from
the various minority groups, religious groups and the Zongo communities.
(c) As member of the Organising Committee, he shall assist the Organiser
in the performance of his duty.
(d) Perform any other functions as may be assigned by the President and
the Executive Committee.

(9) Treasurer:
There shall be a Treasurer who shall perform the following functions:
(a) Be responsible for handling the funds of the TESCON branch and shall
see to their proper disbursement.
(b) Shall be secretary to the Finance Committee
(c) Be responsible for the receipt of all monies and revenues accruing to the
TESCON branch
(d) Keep and maintain proper records of accounts of all moneys and revenues
to which the TESCON branch is entitled to.
(e) Present a statement of accounts covering such periods as may be specified
to the General Assembly or the Executive Committee upon a request in
writing by a Member or an Executive Committee Member at least ten (10)
clear days before a meeting. A breach of this provision shall be a ground for
impeachment.
(f) Be a signatory to the bank account of the TESCON branch.
(g) Perform any other functions as may be assigned by the President or the
Executive Committee.
(10) Research Officer
(1) He shall be appointed by the Executive Committee.
(2) His duties shall be determined by the executive committee.

REGULATION 13 - REMOVAL OF EXECUTIVE COMMITTEE


MEMBER
(1) Impeachment:
(a) Any Member shall by notice in writing addressed to the Judicial Committee,
and stating grounds for removal, commence impeachment proceedings
against any Member(s) of the Executive Committee
(b) Such a proceeding shall be authenticated by the signatures of at least 20
members of the branch or at least nine (9) Executive Committee members.
(c) A copy of the notice shall be served on the member(s) of Executive
Committee whom such a proceeding has been instituted against at least 2

days before the hearing of such a case.
(d) The Chairman of the Judicial Committee shall within 7 days on the receipt
of such a notice of impeachment, convene Judicial Committee meeting
and ascertain the merits of the matter.
(e) The decision of the Judicial Committee shall be copied to the Executive
Committee and in a case involving all Executive Committee Members to
the Regional Youth Organiser through the Regional TESCON Coordinator.
(f) An Executive Committee member(s) so impeached shall forthwith cease
to be a member of the Executive Committee.
(g) Any vacancy created by virtue of impeachment shall be filled in accordance
with Regulation 13(3).
(2) Resignation:
(a) Any member(s) of the Executive Committee apart from the president who
desires to resign shall communicate his/their resignation, in writing, to the
President and copied to the Chief Patron and Regional TESCON Coordinator
at least four (4) days before the formal date of resignation
(b) Any member(s) of the Executive Committee relinquishing his/their
office under paragraph (a) shall hand over all documents and property of
the Branch in his/their custody to the President within three (3) days of his/
their formal resignation.
(c) Should the President desire to resign, his intention shall be made known
in writing, to the Regional Youth Organiser through the Regional TESCON
Coordinator and copied to the Chief Patron and Executive Committee at
least one (1) week before the formal date of resignation.
(d) Upon resignation of the President, the Vice President shall take over and
the Secretary shall issue a circular, informing the General Assembly about
the resignation.
(e) Any member(s) of the Executive Committee who absents himself from
three (3) consecutive Executive Committee meetings without reasonable
justification shall be deemed to have resigned from his office.
(f) Should the entire Executive Committee desire to resign, the decision shall
be made known to the General Assembly at least seven (7) days before the
date of resignation.

(g) Where a vacancy is created as a result of resignation of a member(s)
of the Executive Committee, the vacancy shall be filed in accordance with
Regulation 13(3).

(3) Vacancy at the Executive Committee


Where an Executive Committee position becomes vacant, the position shall
be filled by:
(a) In the case of the President, by the Vice President
(b) In the case of the Vice President, by the Organiser
(c) In the case of the Secretary, by the Assistant Secretary
(d) In the case of both the President and the Vice President, the Secretary
shall become the President.
(e) In the case of any other position, an appointment shall be made by the
Executive Committee members and approved by the General Assembly.
(f) Where more than three (3) vacancies are created on the Executive
Committee including the President, the Vice President and the Secretary, the
Judicial Committee Chairman shall act as President of the TESCON branch
and other vacancies shall be filled by the General Assembly.
(g) On the Judicial Committee Chairman assuming the office of President,
the General Assembly shall appoint a new Judicial Committee member. The
Judicial Committee shall meet within twenty (24) hours to appoint Chairman
of the Judicial Committee.

REGULATION 14 - COMMITTEES STANDING


(1) There shall be the following Standing Committees for every TESCON
branch:
(a) Organising Committee
(b) Finance Committee
(c) Research Committee
(d) Publicity Committee
(2) The Executive Committee shall appoint the Members of the Standing
Committees subject to the approval of the General Assembly.
(3) The composition of a Standing Committee shall not be more than nine (9)
and composition shall at all times be an odd number.

(4) The decisions of the Standing Committees shall be by simple majority.
(5) The functions and mandate of the Standing Committees shall be
determined by the Executive Committee.
(6) The Executive Committee may remove any member of the Standing
Committee based on a stated ground(s)

REGULATION 15 - JUDICIAL COMMITTEE


(1) Composition:
(a) Each TESCON Branch shall have a Judicial Committee which shall be
composed of members of the TESCON Branch appointed by the Executive
Committee and approved by at least 2/3 of members of the General Assembly
present at the first meeting convened by the Executive Committee.
(b) The Judicial Committee shall consist of a Chairman and a Secretary who
shall be Law Students, in the case of institutions with a Law Faculty, and
three (3) other members.
(c) The Judicial Committee shall be duly constituted for its work by not less
than three members except where the matter involves the impeachment of
an Executive Committee Member or the expulsion of a Member where all
the Members of the Judicial Committee must sit.
(d) Without prejudice to paragraph (c), if a member of the Judicial Committee
fails to or is unable on three occasions to sit on the case involving either
impeachment of an Executive Committee member or the expulsion of a
member, other Members shall carry on with their duty and their decision
shall be binding.
(e) The Chairperson of the Committee shall have the power to empanel for
the hearing of any case before it except otherwise contained in this regulation.

(2) Jurisdiction:
(a) The Judicial Committee shall have exclusive and original jurisdiction in
all matters relating to the interpretation and enforcement of this Regulation.
(b) The Judicial Committee shall have jurisdiction in all matters affecting
discipline within the TESCON branch.

TESCON REGULATIONS 29
(c) The Judicial Committee in exercise of its judicial authority shall have the
power to make all necessary orders including but not limited to injunctions,
certiorari, prohibition, quo warranto.
(d) The Judicial Committee shall have original jurisdiction in all matters
relating to electoral disputes at a branch.
(3) The decisions of the Judicial Committee shall be by a simple majority
except in the case of the expulsion of a member or impeachment of an
Executive Committee Member where the decision has to be unanimous.
(4) The Judicial Committee shall have the power to summon any member(s)
of the TESCON branch to appear before it for the purpose of enhancing the
course of justice.
(5) The failure of a member(s) to appear before the judicial committee without
any reasonable excuse shall be a ground for expulsion and in the case of an
Executive Committee Member, ground for impeachment.
(6) The term of office of members of the Judicial Committee shall be for
one (1) academic year, but may be re-appointed subject to this Regulation.

(3) Appeals:
(a) An appeal against the decision of the Judicial Committee shall be made
within forty eight (48) hours after the decision is given.
(b) An appeal against a decision of the Judicial Committee shall be made
to the Regional Youth Wing through the Regional TESCON Coordinator,
through either electronic means or physical presentation
(c) An aggrieved member shall make a final appeal to the National Youth
Wing through the National TESCON Coordinator within forty eight (48)
hours after the decision of the Regional Youth Wing, through either electronic
means or physical presentation.
(d) The National Youth wing or Regional Youth wing, as the case may be,
shall constitute a three (3) member committee to hear and determine the
appeal within five (5) days on receipt of the appeal except in electoral matters
where the provisions of Regulations 9(k) and (l) shall apply.
(e) The decision of the National Youth Wing shall be final.

(4) Removal of Judicial Committee Member
(a) Any member shall by notice in writing addressed to the President, and
stating grounds for removal, commence removal proceedings against any
member(s) of the Judicial Committee
(b) Such a proceeding shall be authenticated by the signatures of at least 20
members of the branch or at least nine (9) Executive Committee members.
(c) A copy of the notice shall be served on the member(s) of the Judicial
Committee whom such a proceeding has been instituted against at least 2
days before the hearing of such a case.
(d) The President shall refer the matter to the General Assembly for voting
and 2/3 of the Members of the TESCON branch must vote in favour of the
removal.
(e) Without prejudice to paragraph (d), no voting shall take place unless the
member(s) of the Judicial Committee is heard.
(f) Where a Judicial Committee member is removed, the vacancy shall the
filled by the General Assembly in accordance with this Regulation

REGULATION 16- AUDIT COMMITTEE


(1) There shall be an Audit Committee composed of five (5) members who
shall be appointed by the newly elected Executives Committee members
prior to handing over.
(2) The Audit Committee shall audit the accounts of the TESCON branch
and take inventory of all the assets of the TESCON branch.
(3) The Audit Committee shall furnish the newly elected Executives with its
findings which shall be copied to the National / Regional TESCON Coordinator
and the outgoing Executive Committee of that branch.
(4) An Executive Member(s) or person(s) against whom adverse findings are
made by the Audit Committee shall forfeit his/their certificate(s) and any
other courtesies and benefits including holding any TESCON Office or being
appointed to any TESCON position, including the Regional and National
TESCON Coordinator positions.
(5) An Executive Member(s) or person(s) against whom adverse findings
have been made by the Audit Committee may set aside the findings by

appealing to the Regional Youth Organiser through the Regional TESCON
Coordinator who in turn shall constitute a three member body to deal with
the matters arising from the audit.
(6) Where for some reason(s) the Audit Committee is unable to perform
its functions, the newly elected Executives shall write to the Regional Youth
Organiser indicating the reasons.
(7) The Regional Youth Organiser shall make a determination on the matter.

REGULATION 17- GENERAL CLAUSES


(1) Party Activities:
The selection of TESCON representative(s) to Party elections and programmes
shall be determined by the directives that shall be given by the Regional
Youth Wing in consultation with the National Youth Wing.

(2) TESCON Certificates:


(a) Official Certificate under the hand of the rightful persons so stated in
this regulation shall be issued to the following:
I. TESCON Executives
II. Members of the Judiciary
III. Members of the Electoral Commission
IV. Members of Other Committees
(b) Certificates of Executive Committee Members shall be signed by the
Chief Patron, the Regional Youth Organiser and the National Youth Organiser
(c) Any other certificate shall be signed by the Regional Youth Organiser,
Chief Patron and the President of that TESCON branch.
(d) There shall be a uniform TESCON Certificate template issued by the
National TESCON Secretariat for use by all branches nationwide.

(3) National TESCON Card:


Without prejudice to the Party Card, the National Youth Wing may issue
National TESCON cards.

REGULATION 18 - RESIDUAL POWERS
Where on any matter whether arising out of this Regulation or otherwise,
there being no provision, express or by necessary implication of this Regulation
which deals with the matter that has arisen, the Regional Youth Wing in
consultation with the National Youth Wing shall provide for how that matter
should be dealt with.

REGULATION 19 - INTERPRETATION
(1) This Regulation shall be given a broad and liberal interpretation to reflect
the fundamental values of the Party and the exigencies of the time.
(2) In this Regulation, unless the contest otherwise requires:
“Good standing” means a Member whose name has been entered into the
register of a particular TESCON branch and has paid all his dues;
“he” means both male and female;
“his” means both male and female;
“Party” means the New Patriotic Party;
“Regulation” means “Rules” and vice versa;
“Student” means a member of a recognized Tertiary Institution pursuing a
certificate programme, Diploma, Degree, Masters or PhD.
“Cell” refers to a Hall or hostel or place of residence for members of TESCON.

REGULATION 20 - AMENDMENT OF THE REGULATIONS


(1) All or any of the provisions in this Regulation may be altered, deleted,
added to or otherwise amended by the National Youth Wing in accordance
with this Regulation.
(2) A Member of TESCON who wishes for any provision of this Regulation
to be amended shall submit a petition for amendment to the National
Youth Wing through the Regional Youth Wing and copied to the National
TESCON Coordinator.
(3) The petition for amendment must be circulated among all Regional
Youth Wings at least two (2) weeks before a National Youth Wing meeting.

(4) An amendment shall be made if at least 2/3 of Members of the National
Youth Wing vote in favour of the Amendment.
(5) The National Youth Wing may by itself amend this Regulation in accordance
with this Regulation.
(6) An amendment to this Regulation shall be communicated to all TESCON
branches.

REGULATION - 21 REPEALS AND SAVINGS


(1) TESCON Rules and Regulations 2018 is hereby repealed.

(2) Any act or direction done under TESCON Rules and Regulations 2018
shall be lawful despite the repeal.

SCHEDULES
First Schedule

STANDING ORDERS
(1) Voting:
(a) Voting on decisions at meetings shall be by members only. Each member
of that TESCON branch shall be entitled to one vote only;
(b) Voting privileges shall include the right to delegate and to make or second
motions or nomination;
(c) Voting on motions shall be carried by a simple majority of members
present;
(d) The casting of votes shall be in the following order: vote(s) for, against,
abstentions;
(e) If the number of votes for and against a motion is equal, the Chairman
shall exercise the casting vote. Delegates abstaining shall be considered as
non-voting.

(2) Motions:
(a) All members shall have a right to file motions or proposals;
(b) All motions shall be addressed to the Chairman;
(c) No motion or amendment shall be opened for discussion until it has been
seconded, but the proposer shall have the right to speak on the motion for
two (2) minutes in order to find a seconder;
(d) No matter shall be discussed until it concerns an approved subject on
the agenda, except with the permission of the house;
(e) A motion shall only be opened for discussion or amendment after the
proposer and seconder have been given the opportunity to speak in support
of the motion;
(f) After the proposer and seconder have spoken for the motion, the Chairman
shall invite other speakers in the following order: For the motion, against
the motion;
(g) The proposer of an original motion shall have the right to reply at the
close of the debate on his motion;
(h) A motion cannot be amended until consent is given by the Chairman;
(i) Discussion of a motion (including amendments) may be curtailed in time
by a procedural motion from the floor or by the Chair, with the approval
of the house;
(j) The Chairman shall have the power to limit debate on any motion
(including amendments).

(3) Amendments:
(a) No amendments shall be moved, which by the Chairman’s ruling rescinds,
negates or destroys the original motion;
(b) No other amendments shall be moved until the first amendment has
been disposed of, but notice of further amendments may be given;
(c) If an amendment is rejected, other amendments may be moved on the
original motion. If an amendment be carried, the motion as amended shall
become the motion, and shall be the question on which any further discussion
may be made, or upon which the final vote is taken;

(d) An amendment, like the motion, must be moved, seconded and discussed
in accordance with the procedure for motions outlined above;
(e) When several amendments are presented on any one item, the amendment
first tabled and supported will be voted upon first. However, discussions on
subsequent amendments will be opened before a vote is taken on the first
amendment.

(4) Interventions:
(a) In addition to a motion, the Chairman shall allow the following points
in order of precedence:
i. Point of Order,
ii. Point of Correction;
iii. Point of Information.
(b) A point of order must be heard at all times, and the Chairman shall give
his ruling before the issue is further discussed. Points of order shall deal with
the conduct of procedure of the debate. The member rising to put the Point
of Order shall prove one or more of the following:
i. That the speaker is traveling outside the scope of the motion under
discussion;
ii. That he is using improper language;
iii. That he is infringing upon the Regulations or Standing Orders.
(c) A point of correction shall be factual presentation seeking to correct a
statement made by the last speaker. It must be strictly related to the subject
under immediate discussions.
(d) A point of information is a question or a brief statement of a relevant
fact concerning the matter under discussion. It should be directed to either
the last speaker or the Chairman.

(5) Conduct of meetings:


(a) A speaker shall direct his speech strictly to the motion or amendment
under discussion. If there is no definite motion or amendment before the
meeting, the speaker shall direct his speech strictly to the point on the agenda
under discussion. Every member shall address himself solely to the Chair,

(b) No member shall be allowed to speak more than once on a motion as
long as a member who has not spoken on that motion desires the floor. No
member shall speak for longer than ten (10) minutes at one time without
permission of the Chair;
(c) The Chairman shall interpret the Standing Orders, subject to approval
of the General Assembly;
(d) Any or more Standing Orders may, in case of urgency, or after notice duly
given, be suspended, so far as regards business at that particular meeting
provided that there is a two-thirds (2/3) majority in favour.
