1. That the above quoted Appeal No. G 60/87-MAS

filed by the Applicant/Appellant was dismissed vide order

No.429/1987 dated 30.06.L987 tn terms of Section 82-

A of tJ:e Gold (Control)Act 1968,

 A true copy of the order dated 30.06.1987 is
annexed to this Application marked as Annexure No. 1.

2, That the Applicant/Appellant had already filed a

Restoration in 1987 itself immediately after

the dismissal of the Stay Application but the said

Application has not been listed for hearing till date and

the was also dismissed for non-compliance of the

stay order _ without taking into account the Restoration

Application Iiled by the Applicant/Appellant.

A true copy of the Restoration Application filed in

1987 is annexed to this Application marked as Annexure

3. That the Applicant/Appellant in 1995 filed another

Application for restoring the Appeal to its original

number praying to allow the Applicant/Appellant to

the amount adjudged by the Honble Tribunal in

its exparte stay order but as ill luck would have it even

the said application has not been listed so for:

A true copy of the said Application is a:irnexed to

this Application marked as Annexure No. 3.

 4. That it is also important to mention here that no
orders has been received by the t /Appellant till
date in respect of the Appeal filed under the Customs

Act, t962.

5 That since the gold seized in the ihstant case was

absolutely confiscated holding that the same belonged to

the Applicant/Appellant by the Collector of Customs &

Central Excise, Hyderabad; without grring any option to

redeem the same hence it will be in the interest ofjustice

to recall the order No. 429/ 1987 dated 30.06.1987 and
pass such and further order'as tl:is Honble Court may

deem fit and proper under the circumstances of the case.

It is, therefore, Most Respectfully prayed that this

Honble Court may be graciously please to recall the

order No. 4291L987 dated 30.06.1987 and pass such

other and further orders as this Honble Court may deem
