Sub: Notional Promotion in the grade of Tax Assistant - Regarding.
Consequent to the Annual DPC for the Year 2022 held on 27.12.2021, Shri K.
Mohan (Emp Code: 8121), Lower Division Clerk, is notionally promoted to the grade of
Tax Assistant (Group ‘C’ Ministerial) on In-situ basis in Level 4, Index: 1, Rs. 25,500/- in
the Pay Matrix of 7th Pay Commission with effect from 01.01.2022.
2. The seniority of the promoted officer in the grade of Tax Assistant will be fixed as
per the orders in force.
3. The promoted officer should exercise his option for fixation of pay in terms of F.R.
22(I)(a)(1) within one month from the date of joining as Tax Assistant. The officers
who have already been granted financial upgradation under Assured Career
Progression Scheme / Modified Assured Career Progression Scheme are not entitled
for pay fixation benefits now.
4. The promotion now ordered is subject to the outcome of the following:
i) Writ Petition in W.P.C.T. 261/2008 filed by Shri Samiran Roy & Others
pending before the Hon’ble High Court, Calcutta, in terms of Board’s
letter F.No.C-18012/6/2009 Ad IIIB dated 16-09-2010.
ii) Jarnail Singh batch in SLP(C) NO.30621 of 2011 pending in Hon’ble
Supreme Court of India.
iii) Other cases, if any, pending before any judicial fora.
5. The compliance report about the joining / non-joining of the officer should be sent to
this office by the concerned Commissionerate by 01-02-2025.
