PETITION FOR DISSOLUTION OF MARRIAGR BY A DEGREE OF DIVORCE


UNDER SECTION 13 OF THE HINDU MARRIAGE ACT,1955

Most Respectfully Showeth:

1. That the marriage was solemnized between the parties according to Hindu rites and
ceremonies after the commencement of the Hindu Marriage Act on 17-01- 2017 at
Delhi. The said marriage is registered with the Registrar of marriage. A certified copy
of the relevant extract from the Hindu Marriage Register is filed herewith.
2. That the status and place of residence of the parties to the marriage before the
marriage and at the time of filing the petition are as follows:

3. That the respondent came to know that the petitioner was jobless and was completely
dependent upon his parents for money. After three months of marriage, petitioner
asked respondent to bring Rs. 5,00,000/- (Five Lakh Rupees) from her parents as he
wanted to book a new car for himself. Respondent refused, upon which she was
tortured by petitioner. This pestering and harassment for bringing money continued
over a period of seven months and once she was hospitalized. When she got
discharged from hospital, she left her matrimonial house to live with her parents. No
one came to get her back. One day she went to her matrimonial house along with her
brother to collect her jewellery and other belongings. Both of them were insulted and
she was not allowed to take anything back, Shraddha is now looking to seek divorce
for cruelty meted to her and she wants to start a new life as she is well qualified.

4. That the petition is not presented in collusion with the respondent.

5. That there has not been any unnecessary or improper delay in filing the petition.

6. That there is no other legal ground why relief should not be granted.

7. That there have not been any previous proceedings with regard to the marriage by or
on behalf of any part.

8. That the marriage was solemnized at Delhi.

9. The parties last resided together at Rajouri Garden.

10. The parties are now residing at Rajouri Garden and Punjabi Bagh. (Within the local
limits of the ordinary original jurisdiction of this Court).

11. That this Hon’ble Court has jurisdiction to try and entertain this petition.
PRAYER:

In view of the above facts and circumstances, it is, therefore, most respectfully and humbly
prayed that this Hon’ble Court may be pleased to grant a decree of divorce under Section 13
of HMA in Favor of petitioner.

Any other relief/order/Direction this Hon’ble Court may deem fit in the interest of justice and
equity.
