 TERMS & CONDITIONS
1. Manak Waste Management Private Limited (Cashify) is a Company incorporated under the Companies Act, 1956. The
Customer) has approached and represented to Cashify with an intent to sell his/her/its Gadget.
2. The Customer represents, acknowledges and declares to Cashify as follows:
a. That the Customer is the bonafide purchaser/Legal owner and/or has a valid authorization from the owner of the
Gadget, the details of which have been mentioned on the front page of this Application Form and is legally competent
to sell the Gadget. In case of A.R., the A.R. represents that he/she is fully authorized and competent to act for and on
behalf of the owner for the sale of the Gadget including entering into the transaction with Cashify and hereby
indemnifies Cashify in case of any contest/falsity to the said extent, if identified or comes to the knowledge of
Cashify even at a later stage.
b. That as on date there are no violations under any laws/rules/regulations, including but not limited to any act of theft
/stolen/misappropriation/cheating/superdari/any pending case /orders in or of any court/law enforcement authorities
involving and/or pertaining to the Gadget. The Customer/AR acknowledges and indemnifies Cashify for any pending
violations or offenses, or otherwise involving the Gadget and in case Cashify has to incur or suffer any cost(s)/loss
(es) for the same then all the consequence(s) and expense(s) shall be borne by and shall be the sole responsibility of
the Customer/AR and Cashify which shall include its employee(s), official(s), Director(s) or assigns and/or the future
buyer shall not be liable for the same in any nature whatsoever.
c. That the Mobile is free from any kind of encumbrances, including but not limited to any liability such as superdari,
theft, arrears of GST, sales tax,value added tax, government dues, blacklisted in government records or similar
liabilities as on date. In case any such encumbrances, and/or liabilities are identified or come to the knowledge of
Cashify and/or future buyer then the same shall be borne solely by the Customer/AR. The Customer/AR also
understands that if any discrepancies are identified and/or found in the ownership of the Gadget then all related cost
(s) /expense (s) to rectify the same shall be borne solely by the Customer/AR.
d. That there are no loans of any nature whatsoever and in case any such loan is identified or comes to the knowledge of
Cashify thereby restricting any transfer of the ownership of the Gadget, then any amount of such loan if required to
be cleared or settled by Cashify then the Customer/A.R. shall be under a strict liability to make the payment of such
amount including any ancillary expenses incurred by Cashify for the same and Cashify shall possess all rights to
claim the same from the Customer/AR and the Customer/AR shall be liable to pay the same in favour of Cashify on a
simple demand notice and without any demur or protest.
e. The Customer/A.R. Acknowledges that Cashify is purchasing the Gadget for re-sale and the Customer relinquishes
all his rights on the Gadget after the delivery of the Gadget is taken by Cashify and wherein after Cashify shall
possess all rights to further sell the Gadget to any third party for any price.
f. The Customer/AR acknowledges that he/she shall be liable for any tax/levy/cess/statutory payments as may be
applicable to the transaction with Cashify.
g. The Customer/A.R. declares and represents that there has been no blocking effected by the Customer/A.R. pertaining
to and involving the Gadget of any nature whatsoever thereby making the Gadget redundant to be operated upon. In
case of any such discrepancy or misrepresentation is identified or comes to the knowledge of Cashify then the
Customer/A.R. shall immediately cure the said deficiency on a simple notice from Cashify and failing which Cashify
shall be entitled to the entire refund of the amount paid to the Customer/A.R. along with an interest of 24% p.a. till
realization of full amount by Cashify from the date of this Application Form including , wherever required, to file
appropriate complaint with competent / law enforcement authorities for the same.
h. The Customer/A.R. acknowledges and accepts to be immediately available in person on intimation by Cashify in case
of any law enforcement authority summons / calls/ investigates / enquires into the ownership of the Gadget. The
absence or avoidance by the Customer/A.R. shall be treated as an intentional act on behalf of the Customer/A.R. and
Cashify shall be fully competent to lodge a case of cheating against the Customer/A.R. Further, in case of Cashify or
its employees, officials or directors stand to face any adverse consequences because of the absence or avoidance of
the Customer/A.R. then Cashify shall also be entitled to claim all and/or any expenses incurred by Cashify including
damages & litigation expenses including lawyer fee etc. from the Customer/A.R. and which shall be immediately to
be paid by Customer/A.R. in favour of Cashify on a simple notice by Cashify to the Customer.
3. The Customer/AR represents and declares that the Customer is the real owner of the Gadget and possess all requisite
authority to sell the Gadget and has submitted genuine documents of his/her identity along with the identity of the Gadget.
4. In case of held-back amount:
In cases wherein Cashify has withheld an amount to be payable to the Customer/AR (referred as held-back amount) then
upon satisfaction of Cashify as for the clearance to the contingency of the purpose of holding back said amount; Cashify shall
process the payment of the said held-back amount in full or in part and the transfer of the said amount in the bank account of
the Customer/AR shall be deemed to be a final receipt of the said payment by the Customer/AR and Cashify shall not be
required to issue any further receipt thereof. The Customer/AR acknowledges and agrees that the amount held-back by the
Company shall be forfeited in full or in part if the Customer/AR fails to satisfy/close/comply with any of the contingencies of
the purpose of holding-back amount within 7 (Seven) days from the date of delivery of the Gadget. It shall be the customer’s
responsibility to collect the debit note of the amount forfeited from the office of Cashify.
5. The Customer/AR shall keep Cashify and the future buyer, indemnified and exonerated from all losses, claims, liabilities,
risks, responsibilities, damages arising on or before the delivery of the Gadget with Cashify.
6. The Customer/AR understands and acknowledges that any misrepresentation by the Customer/AR of any facts with Cashify
shall result into Cashify taking appropriate action under the relevant provisions of law with the concerned statutory
authorities and/or before the competent Courts/Tribunals.

 7. In case of any difference and/or dispute between the Customer/AR and Cashify then the same shall be referred to an
Arbitration Tribunal consisting of a sole arbitrator to be appointed by Cashify and the award so passed by the Arbitration
Tribunal shall be final and binding upon the parties. The venue of Arbitration shall be at Gurugram - Haryana and language
shall be English.
8. The Customer/AR understands and acknowledges that in case of any change/ amendment in any applicable law if required
and mandated, the Customer/AR shall comply with any such change/amendment and Cashify shall not be liable for any
resultant effect thereof in any nature whatsoever including but not limited to any further re-sale.
9. Cashify may offer services which shall be chargeable at the sole discretion of Cashify and in case the Customer/AR prefers
to avail such services and/or benefits and/or offers then the Customer/AR shall be liable to make the payment of such charges
as shall be applicable to such services, benefits and offers and which shall be non-refundable. Any amount of such services,
benefits and offers shall be exclusive from the Final Quote/Offer Price of the Mobile.
10. The Customer/AR hereby acknowledges and affirms that the Customer/AR shall be solely liable for any and all
consequences for the payment made by Cashify as mentioned in the Payment Details overleaf. The Customer/AR shall be
solely liable to indemnify and compensate Cashify in case of any claim arising due to the instructions of payment as made by
the Customer/AR.
11. The courts situated at Gurugram (Haryana) shall possess exclusive jurisdiction.
