Ganage Prin, Bhausaheb Jadhav Founder President President Exe - President Date: 2/ 5/2023 Report of Visit to Labour Court and Industrial Tribunal Purpose of Visit Labour & Industrial Law deals with rules that regulate the relationship between employer, employee & labour unions. Its purpose is to protect the rights of workers & promote fair and equitable working conditions. It establishes legal procedures for resolving disputes between employers & employees, such as through labour courts or negotiations. The labour court serves as an impartial forum to hear both sides of the dispute and make a decision based on the facts and applicable laws. Thus, it becomes important for lawyers or low students to know the working & other intricacies of labour court as they are the ones who would be representing litigants. With this view, a visit to a Labour Court was organized for students. On Tuesday, 2" May 2023, students of class BA LLB IV, Shankarrao Chavan Law College, Pune, visited Labour and Industrial Tribunal situated at Swargate, Pune. The duration of visits were 2 hrs each for two time slots. During the visit, students observed the court proceedings relating to issues with respect to Labour laws & Industrial Law. Some of them had an opportunity to interact with litigants, Registrars of the court directly. Students got the opportunity to observe the infrastructure of the court and courtrooms along with other details such as a list of names of parties, Registrar's office, Typewriter's work ete: Objectives and subject Accomplished 1. The role of the lawyer on the point of framing the charge. 8. The role of lawyer in the plea- bargaining 9. The way, judge, prosecutors and defence lawyers handle the cases. 10. Other miscellaneous work done by the public-labour prosecutor. Courtroom Observation © The setting of the Labour Court was formal, with a judge presiding over proceedings. Parties involved in the case were sitting in front of the judge’s bench who were either employers or employee. © Counsels of the parties were presenting their arguments before the court based on facts of the case and evidence produced. Judge was listening to the counsel patiently. Here courts were open to the public, but in some cases the court may be closed to the public or certain parts of the proceeding may be confidential to protect the privacy of the parties involved. Case proceeding- Details © One of the counsels who were arguing in court said that the opposite party has filed the suit which has no valid grounds. Evidence produced by the opposite party is not sufficient to cite the judgement by HC, Mumbai. He said that only citing judgement does not increase the weightage of the argument facts of the case are not similar to it. He argued that the party shall not be allowed to appeal as the case has no valid base and thus asked the court to compel a party to give compensation to his clients as well as to himself for wasting his time. The facts of this case were that 2 employees were expelled from the before the court. Observation in Registrar's Office © Mr. Sunil Hinge was the Registrar of Judge Aargade Sir, who explained the procedure to file case in labour court. The essential documents are as follows 1. Complaint application 2. Application for Interim Relief. 3. Affidavit by both parties stating their facts to be true -The person needs to be physically present. 4. Documents relating to the subject matter. 5. Vakalat nama - Letter authorizing the Advocate to represent the client. 6. Address memo - Address proofs of parties. 7. Process Memo - Court fees to be paid by parties. © The examples given by the registrar with respect to instances when the case is filled in labour court are as follows:- a. In case of harassment to labour - unnecessary transfer to remote area, no payment of wages b. Incase of death, injury to labour ete. Conclusion In this way, a visit to the labour court was conducted. The Subject In-charge ‘Asst. Prof. Dr, Gajendra Dhamal had given us insights while teaching the theory part in the classroom, which helped us to get better understanding during the visit. Around 105 students participated in this visit and observed the court proceedings in group of 10 in each courtroom. The visit was organised by prior permission and guidance of Hon’ble principal Dr. Kranti Deshmukh Ma’am. Subject teacher Asst.
