Introduction
The aim of this report is to make suggestion on the Nepal prison, defamation
and protection (legal system). It was the surveyed of more than 133 students.
Although the high number of students they had managed the high concern and
protection to us. The collage was much wised for this matter and I would like
to appreciate this to my administration.
In spite of high risk, the successes of this visit to the prison were also goes to
big applause to sunsari guard and officer. The purpose of this visit was
successful only with their great management and enthusiastic thought of them
for the bright future of young students(us). The knowledge that I grab on this
day was very mighty and unforgettable. I might have entered there with high
expectation with unrealistic thoughts but I guaranteed the inspiration that I got
is may unhaveable but with high fever of ambition.
Objective
Rules and regulation are made for the security and development of citizens of
the particular country. These things also work as two side of parallel line. laws
are written to balance the conflicting interest of the nation. It provides
responsibility and duty with rights which obliges to an individual. Law gets
evolved through the citizens behavior. As new illegal activities trace down new
laws or new way of providing justice to the victim were established. And
punishment to the perpetrator(accused).
Mostly this visit was for the study of people who were convicted, who were
isolated from the world after going against the rules, laws of the country, rights
of the citizens. And also, that whether their human rights were violated or
enforce in the prison.
Nepal has evolved from many more ain, codes and laws. New laws were
revised and promulgated with the increasement of illegal activities. Muluki
Penal Code 2074, Muluki Criminal Procedural Code 2074 and The Criminal
Offences (Sentencing and Execution) Act 2074 were the laws that are after the
illegal behavior of people.
Criminal case court procedural;
Law punished only those who unfollow the rules or those who disobliged the
other rights. And as we know everything has its own process. Law has legal
procedural for the issue. An accused to be convicted with bullet proof evidence
has its own procedural. For example, of murder case: first the victim must fail
the case as affair in the police station then the police will investigate the
situation and collect the evidence, or you can case on government. As it is case
against human rights, it directly hit the life to right. The government will take
over the case.
After this court will start its procedures. Such as, application, Case institution,
notice time, Judicial custody, Date for presence, Date and summons, Pleading
and advocacy, Interim order, taking evidence, documentary evidence, stay,
hearing, witness examine and finally execution of the decision of the case. And
after completing this phase the convicted person will be exile. The court order
the criminal for imprisonment. The criminal will also be protected by the law.
In spite of this judgement the accuser also has the right to appeal and review
in another higher bench.
Observation;
The excitement end when we reached our destination. Everyone was so
nervous as we meet a lot of police officer at the same time. They were also
look excite to meet us. The ashai sahab instructed us to form several lines for
the proper description about the jail. According to him there were 45 police
officer around the surrounding of jail which means high security. And around
1700 prisoner inside the jail and all of were men.
He informed that according to their survey there were 1613 prisoner both the
convicted and trailed. He also adds that prisoner was very discipline and
obliged.
Sakha adhikrit was recognized as head of the prison house when the real head
officer takes leave.
He also makes us aware about the crime that are committed by the prisoner
inside the cell and we must be very careful about the situation.
The crime. viz,
Rape
Murder
Drug abuse
Theft and others,
we also got to know that they were facilities 700 grams fat rice and rs.80
wages as daily service.
Terms of administration;
The responsibility of inner administration would be governed by Chaukidaar
and Naike and head counts would be conducted every night and was reported
to the head. There was tower for inspection and CCTV. After attaining such
information, we headed towards the actual captive area where on the way
inspected some greenery, police quarters, bushes and majorly the High walls
that couldn’t be escaped in any way. After heading toward the actual prison
area, the meet-up room was on the way and through a small gate we
concluded toward the prison, there it was highly interesting and stupendously
clean. There near the entrance, temples, mosque, gumba and other religious
institutions could be seen where the prisoners could preach.
We could observe the playground and ludo players side by it, marching
forward kitchen and small shops for grocery could be noticed and then the
interesting part, the Reformation I always wanted to know about, there were
sections for practicing different skills, they seemed to have built furniture,
muda, ash trays, flower vase and other wood related products, and even
electrical equipment mending was being practiced. Passing through, we
noticed the barber shop and the telephone line center. This was all outside the
main building.
In the building on entrance, was a Snooker Pool where there was a melodious
music roaming around the building, peoples were watching TV simultaneously,
some even had small shops within the building. Several rooms were filled with
Land beds for the prisoners, we discovered a music room too and gym Centre
was also available within. A library for educational purpose and we got to know
than one could eve attend exams being in the prison.
I was so mesmerizing by these facilities that I was in a zoon is this the prison?
Why is this so wonderful? But as our prison act 2079 it was. Although I didn’t
expect this but I was also very satisfied with this visit and observation.
Conclusion
The knowledge, the scenery that I had on the very day was unerasable. I could
never believe that the innocent face would have committed such illegal
activities. And also, the question in my head. As I heard there were also some
actual innocent people who came there by misfortune. The evaluation about
prison and prisoner were very different on my head after this day.
The imagination of prison and criminal are very hazard. The loop hole that
happens inside the person head is unpredictable. The youth they give-up inside
the prison is twist of fate to their life. But hoping that they also get lights on
their dark path to bloom one day is all I wish.
