RESOLUTION NO. __, SERIES OF 2025
“A RESOLUTION PETITIONING THE MUNICIPAL GOVERNMENT OF SAN RICARDO THRU
ITS SANGGUNIANG BAYAN AND OTHER RELEVANT AGENCIES TO RESOLVE THE
BOUNDARY DISPUTE BETWEEN BARANGAY POBLACION AND BARANGAY SAN
ANTONIO AND INOLINAN”
WHEREAS, it is the mandate of the barangay to safeguard its territorial integrity for effective
governance, equitable resource allocation, and service delivery to its constituents;
WHEREAS, a long-standing issue between and among Barangay Poblacion, San Antonio and
Inolinan boundary dispute exists, causing confusion and affecting the efficient implementation of
development programs and services in the disputed area;
WHEREAS, the Sangguniang Barangay of Poblacion recognizes the need to address and
resolve this issue amicably and in accordance with existing laws and procedures;
WHEREAS, the resolution of this dispute will ensure harmony between neighboring barangays,
promote good governance, and foster equitable development;
NOW, THEREFORE, on mass motion duly seconded, the Sangguniang Barangay of Poblacion
resolves as follows:
1. To formally petition the Municipal Government of San Ricardo thru its Sangguniang
Bayan to facilitate the resolution of the boundary dispute between Barangay Poblacion
(Petitioner Barangay) and Barangay San Antonio (Respondent Barangay) and Barangay
Inolinan (Respondent Barangay) in accordance with the provisions of the Local
Government Code of 1991 (Republic Act No. 7160) and other relevant laws and
regulations.
2. To request the assistance of the Municipal Land Survey Team, the Department of
Environment and Natural Resources (DENR), and other appropriate agencies in
conducting a technical survey to delineate and establish the boundaries of the
barangays in dispute.
3. To urge the disputing barangays to engage in dialogue, negotiation, and mediation to
amicably resolve the conflict, with the assistance of the Municipal Government and other
neutral parties as necessary.
4. To authorize the Punong Barangay of Barangay to represent the barangay in all
negotiations, hearings, and other activities related to the resolution of this boundary
dispute.
In support of its petition, the sangguniang Barangay hereby rests its claim on the following legal
grounds and facts:
1. The Barangay of Población is one of the 15 barangays of San Ricardo with strategic
significane both in economic and governance development. Originally, there are 12
barangays when San Ricardo was enacted into a municipality thru Republic Act 6360 on
July 22,1971. Over time and several administrative issuances and changes later
issued, three (3) barangays were added to the municipality (Barangays Looc, Esperanza
Dos and Poblscion) establishing their boundaries and their barangay officials.
2. The Barrio Charter Act (Republic Act 2370) particularly Section 3, paragraph 3 provides
among others;
SEC. 3. The creation of new barrios. — All barrios existing at the time of the passage of this Act
shall come under the provisions hereof.
Barrios shall not be created or their boundaries altered nor their names changed except under the
provisions of this Act or by Act of Congress.
3. Batas Pambansa 337 (Local Government Code of 1983) and Republic Act 7160 (The
Local Government Code of 1991) both provides for the manner and creation of
barangays and their metes and bounds or boundaries.
Being one of the central barangay, the administrative boundaries of Poblacion should have
never been reduced but at the moment, the available administrative map although unofficial,
shows that barangay población has the smallest size in terms of land area in the entire
municipality despite the fact that it is the Población, the center of trade and commerce and the
seat of the municipal government is located. This petition is therefore filed and initiated to
determine the proper and legal administrative boundary of Barangay Población and for its
adjacent barangays namely Inolinan and San Antonio to theirs, Barangay población strongly
disagrees with the present administrative boundaries and the proper way to settle this matter is
thru the Sangguniang Bayan as provided under Section 118 of RA 7160. To support its claim,
the following are hereby presented;
A. Barangay Cadastral Map certified by the DENR LMB
B. Copy of RA 6360
C. Copy of RA 2370
D. Provincial Ordinance creating the barangays of Inolinan, Looc, Esperanza Dos
E. Other related maps of significant value
RESOLVED FURTHER, that copies of this resolution be furnished to the Municipal Mayor, the
Sangguniang Bayan, the Municipal Planning and Development Office, the DENR, and the
Barangay Council of Inolinan and San Antonio for their information and appropriate action.
