Conditions of Probationer Trainee
Short title and commencement
• In exercise of the powers vested in him
under the proviso to Article 309 of the
Constitution, the Rajpramukh of
Rajasthan is pleased to make the
Rajasthan Service Rules
• The conditions of service of persons
appointed to services and posts in
connection with the affairs of Rajasthan
is regulated with these rules.
Fundamental conditions of Service
• The whole time of a Government servant is at the
disposal of the Government
• He/She may be employed in any manner required by
proper authority, without claim for additional
remuneration, whether the services required of him are
such as
– would be remunerated from the consolidated
Fund or
– from a body incorporated or not, which is wholly or
substantially owned or controlled by the
Government or
– from a Panchayat Samiti/Zila Parishad Fund.
FUNDAMENTAL CONDITIONS OF LIEN
• Two or more Government servants cannot
be appointed substantively to the same
permanent post at the same time.
• A Government servant cannot be appointed
substantively except as a temporary
measure, to two or more permanent posts at
the same time.
• A Government servant cannot be appointed
substantively to a post on which another
Government servant holds a lien.
Probationer/Probationer
Trainee
▪ Probationer:
▪ means a person appointed provisionally against a
substantive vacancy in the cadre of a service or on a
substantively vacant post.
▪ Probationer Trainee
▪ means a person appointed through direct recruitment
against a clear vacancy in the cadre of service and
placed under training on fixed remuneration for a period
of two years or extended period, if any
Conditions of Probationer
Trainee
• All appointments on or after 20.1.2006 shall
be made as a probationer trainee for a period
of 2 years or extended period.
• During this period, he/she will be paid fixed
remuneration as prescribed by the
Government from time to time.
• After successful completion of probation
training he/ she will be allowed minimum pay
in the Pay Level of the post
• The period of probation training shall not
count for grant of annual grade increment(s).
Conditions of Probationer
Trainee
• The Probationer-trainee shall be entitled only to
fixed remuneration.
• He/ She will not be entitled to Special Pay,
Dearness Allowance, House Rent Allowance.
CCA or any other allowance(s) called by
whatever name.
• No Deputation Allowance shall be admissible to
a Probationer-trainee, if, deputed to 'Foreign
Service" for training etc.
• Similarly, he/she will not be eligible for grant of
Ad-hoc Bonus and uniform/liveries except
wearing of uniform is a legal compulsion under
the rules.
Travelling Allowance to Probationer
Trainee
• No Travelling Allowance shall be admissible for
joining as a probationer-trainee.
• In case journey on duty, he/she shall be
allowed T.A. as on tour.
• in case of transfer only Mileage Allowance on
the basis of fixed remuneration shall be
admissible.
• In case of transfer only the actual period
required for travel will be treated as on duty.
Medical Facility to Probationer
Trainee
• Mediclaim insurance coverage for the Probationer-
trainee during the period of probation shall be
applicable, as applicable to Government servants.
• Employees who were recruited on or after 1-1-2004 will
have option either to continue with Raj Mediclaim Policy
or to register themselves In RGHS as new beneficiary.
– Cashless IPD/ DAY Care, OPD (Upto Rs.20,000), Medical Care facilities as per
CGHS rates or other rates as decide by competent authority.
– Treatment up to 5 lacs per family on floater basis.
– Additional expenses relating to catastrophic illness up to Rs 5 lacs per family.
– Travelling allowance for journeys undertaken for medical treatment as applicable TA
Rules.
– Ambulance Charges.
Subscription related to Probationer
Trainee
• No deduction towards GPF and SI shall be made
from the fixed remuneration.
• In case they opt to register themselves in RGHS, then
they will have make subscription on the rates as
mentioned below:
– Employees drawing basic pay in the Pay Matrix above RS.33500/- but upto
Rs.54000/- - Rs 330/-PM
• Contribution towards New Pension Scheme (NPS) @
10% of fixed remuneration shall be made by the
Probationer-trainee and employer both.
Leave to Probationer Trainee
• Rule-122 A:
• Probationer-trainee shall not earn any leave during the period of
probation. However,
– Maternity Leave: Female Probationer-trainee shall be
granted Maternity Leave as per Rule 103 and 104 of
Rajasthan Service Rules, 1951
– Paternity Leave: Male Probationer- trainee shall be granted
Paternity Leave as per Rule 103A of Rajasthan Service
Rules, 1951
– Child Care Leave: It shall ordinarily not be granted to a
Probationer trainee during the probation period. However, in
special circumstances if the leave is granted during the
probation period then the probation period shall be extended
by the period equivalent to the period for which the leave
has been granted.
Casual Leave to Probationer Trainee
• Probationer-trainee shall be eligible for Casual
Leave of 15 days in a calendar year and for period
of less than a calendar year, it shall be admissible
in proportion on the basis of completed months.
Extra Ordinary Leave to Probationer
Trainee
• Extraordinary Leave upto one month may be sanctioned
by the appointing authority during the entire period of
Probation Training.
• Beyond one month in exceptional and unavoidable
circumstances by the Administrative Department.
• In case of extraordinary leave applied for critical illness of
self, wife/husband, mother, father and children,
extraordinary leave can be sanctioned on the basis of
certificate of authorized medical attendant.
• Those who proceed on extraordinary leave without prior
sanction shall be treated as cases of willful absence and
liable to disciplinary action.
Extra Ordinary Leave to Probationer
Trainee
• In all cases where extraordinary leave period is exceeding
one month, the probation period shall be extended for the
entire period of extraordinary leave.
• In all cases where extraordinary leave period is exceeding one
month, the probation period shall be extended for the entire period
of extraordinary leave.
• Probationer trainee who was / is continuing any course of study or
preparing for nearby competitive examination before joining of
service as probationer-trainee and applied for grant of extra
ordinary leave before proceeding on leave may be allowed
extraordinary leave for the period of continuing any course of
study or preparing for nearby competitive examination.
• The probationer-trainee period shall stand extended by the period
of extraordinary leave sanctioned for the purpose of completing
continuing course of study or for nearby competitive examination

Trainee
• An existing employee already in regular service
shall have an option to opt either for the “Fixed
remuneration’ or the Pay in the Level in the
Pay Matrix (not the Level of his/her new
appointment), whichever is beneficial to him/her
While he/she is under probation.
• After successful completion of probation period,
Pay shall be fixed as per the rules, where such
a Government servant will get due advantage of
being in a regular Level earlier, and will get due
protection of his/her pay.
Pay Fixation during Probationer
Trainee Period
– A probationer trainee receive a fixed remuneration
during Probationer trainee period as per schedule
of notification dated 30.10.2017
– Government Servant, who is already in regular
service of State Government, if appointed as
probationer trainee on a post carrying equal or
higher
▪ He shall be allowed to draw Pay in the level of previous post or fixed
remuneration whichever is beneficial to employee.
▪ Increment in the level of previous post is also allowed during probationer
trainee period
▪ after completion of probation he will be fixed in the Pay Matrix of the
Level of the new post at the equal cell and if there is no equal cell than at
the next cell.
Pay Fixation during Probationer
Trainee Period
Government Servant, who is already in regular service of State
Government, if appointed as probationer trainee on a post
carrying lower :
➢ He will be fixed in the Level in the pay matrix of the new
post, which he would have been entitled to as if the period
of service rendered on the previous post would have been
counted as rendered against the new post.
Other Provisions related to
Probationer Trainee
• In case of Probationer Trainee already in regular
service of State Government opting existing pay in
his own pay scale of the previous post
– Leave related questions:
• Q-1 Whether he is entitled to avail his due leave of his
previous post during the two years period of
probationer trainee. ?
– Ans.: It has to be decided by the controlling authority.
• Q-2- Whether he is entitled to earn regular leave as
provided in RSR during the period he remains as
probationer trainee. ?
– Ans : He/ She shall not earn regular leave (PL/HPL)

• Q-3 In case of joining during the course of the year
whether the casual leave already availed will have
any effect on the entitlement of leave during
probationer trainee period ?
– Ans.: Probationer-trainee shall be eligible for Casual Leave
of 15 days in a calendar year and for period of less than a
calendar year, it shall be admissible in proportion on the
basis of completed months. Casual Leave availed prior to
joining as probationer trainee shall not affect this provision.
In case a probationer trainee joined on 02.01.2022, the
probationer trainee shall be allowed 13.5 CL in the calendar
year 2022.

• Increments related questions:
• Q-1 Will he/she be entitled to his due increments in
existing scale during or for the period of probationer
trainee. ?
– Ans.: In cases where a probationer trainee was already in
regular service and opts his/her existing pay scale of old
post (as per provision rule 24) shall be entitled to House
Rent Allowance at the rates of place of posting.
• Joining Time related questions:
• Q-2 Will he/she be entitled to joining time & joining
time pay on joining the state service ? If not, how will
the Sunday before joining be treated ?
Other Provisions related to

• Joining Time related questions:
• Q-1 Will he/she be entitled to joining time & joining
time pay on joining the state service ? If not, how will
the Sunday before joining be treated ?
– Ans: In cases of regular Government servants who have
completed three years service, joining Government service as
probationer trainee he/she will be entitled to joining time and
joining time pay and those who have not completed regular
service of 3 years will be entitled to only joining time and not
joining time pay.

• Pension related benefits:
• Q-1 Whether Government servants already in service
appointed to other services by direct recruitment shall
continue to be governed by the existing Pension Rules /
Contributory Pension Scheme ?
» Ans: Yes
• Q-2 Whether any benefit of counting past service for pension
would be admissible to those who join Government service
on or after 01.01.2004 from Autonomous Bodies, Public
Sector Undertakings etc. as provided in Appendix IX of
existing Pension Rules ?
– Ans: No

• Q-3 In case of death of counting past service, whether any
family pension and death Gratuity is payable ?

• For all other Purpose like promotion, experience & ACP the
probationary Trainee Period shall be counted as regular
service.
