Affidavit
I, Dr Jayan T, aged 42 years, S/o Thankappan Nair, Kannankara veedu,
Nandaivanam,Nedumparambu Post,Alamcode 695 102, Thiruvananthapuram district,
do hereby solemnly affirm and state as follows:

1. I am the appellant in this case and well conversant with the facts and circumstances
of the case. The Mat. Appeal 51 of 2025 was dismissed by this Hon’ble High
Court vide order dated 18/02/2025 on account of non-appearance when the appeal
was called for hearing.
2. I file this application for setting aside the dismissal order dated 18/02/2025 and
restoring the Mat.Appeal to its original number.

3. I was not aware the date of attending counselling at Family Counselling Centre.
Therefore, I did not attend counselling on 11-02-2025.I was not aware that the appeal
had been listed for hearing on 11-02-2025 at 1.45 pm. The appeal was tentatively
listed for hearing on 17-02-2025 after that. I visited the Hon’ble High Court on 17-
02-2025.But, the appeal was not found on daily list. The appeal was listed next day.

4. I am unable to travel continuously due to severe back pain. I could not reach
Ernakulam from Attingal on 18-02-2025 due to severe back pain. I had no deliberate
intention to non-appear the Hon’ble court.

5. It is therefore just and expedient that this Hon’ble High Court may be pleased to set
aside the order dated 18/02/2025 and restore the Mat. Appeal to its original number.
