EXECUTIVE SUMMARY
This Subcontractor Management Plan is drafted according to the requirements set out in
Appendix B to additional conditions of contract - Guidelines on Scope and Contents of
the Subcontractor Management Plan. These requirements are to be fulfilled by measures
as stated below: -
1. Scope of works to be sub-contracted including the form and extent of sub-
contracting arrangement such as labour only, labour and plant, labour and
material, plant only, lump sum or any other combination of types. Proof of
ownership of construction plant and material should be addressed. The scope of
works to be sub-contracted shall comply with the contractual provisions (i.e.
Clause C7 of the additional conditions of contract for Limiting tiers of
subcontracting).
Subletting Schedule is prepared to address the detail of all the works to be
subcontracted with the information in respect of the extent of subcontracting
arrangement.
Throughout the contract period, there shall be a List of Subcontract to record the
update information of subcontractors, whereas the list of ownership of construction
plant and material supplied by each subcontractor will also be incorporated. The
subcontractor shall be requested to provide the proof of ownership of the construction
plant and material, if any.
For the format of the Subletting Schedule and List of Subcontract, please refer to the
section 5 of this plan.

2. Details of sub-contracts (irrespective of tiers) including the names of sub-contractors,


proposed form of sub-contracts and the programme of the sub-contracted works.
The "List of Subcontracts" in section 5.2 of this plan shows all the proposed
subcontractors in various scopes of subcontracts works.

3. The Contractor's approach to demand/ensure his sub-contractors to a) abstain from


subcontracting the whole of the works sub-contracted to them, and b) report upwards
their subcontracting arrangement and any subsequent changes with written
declarations of no "hidden" sub-contracts for any part of the Works sub-contracted to
any of them.
Subcontractors will be requested to provide information of their subcontractors
including the name of subcontractor, scope of works as well as the plant information.
In addition, they will also be requested to provide a written declaration of no
"hidden" subcontracting of works. These requirements will be detailed in the Special
Conditions of the Subcontracts. The relevant procedures are set out in Section 7 of
this plan.

4. The contractor's proposed measures/or supervision of the works and monitoring of
the performance of sub-contractors, particularly the aspects of the works
programming, quality and safety of the works and environmental protection.
The Integrated Management System is implemented in this joint venture project. It
incorporated all the control measures provided for monitoring and assessing the
subcontractors performance including progress, workmanship, safety and
environmental. The monitoring process can be categorized as follow:
• Project Initiation
There shall be a Subcontractor Kick-off Meeting arranged for each
subcontractor so as to clarify the requirements in workmanship, safety,
environmental and programme.
• Monitoring of Subcontractor's Works
Throughout the construction stage, there will be regular Subcontractors Review
Meeting so as to review the performance of each subcontractor. It also provides
a formal channel for project team to communicate with the subcontractors.
Furthermore, there shall be Inspection & Test Plans established for each
package of work to be carried out by subcontractor so as to ensure an effective
mechanism for the monitoring of subcontractors works. In case of any non-
compliance observed, Non-Conformance Reports will be initiated to the
respective subcontractor and request for their appropriate correction and
corrective actions.
• Performance Appraisal
Subcontractor Performance Appraisal shall be conducted at least once a year,
whereas their performance on progress, quality, safety and environmental
protection will be evaluated. Any subcontractors failed in the assessment will
be suspended for future tendering ofour project.
For the further details of the above mentioned measures, please refer to the Section 8
of this plan.

5. Criteria for selection of subcontractors.


Subcontractors for the project will be selected based on their capability, quality /
environmental / safety performance, resources, as well as the financial ability.
All the potential subcontractors shall be selected from (i) the nomination from the
client or (ii) the current list of Subcontractor Register kept by the participant of the
JV.
For the detail, please refer to Section 6 of this plan where the procedures for the
registration and appraisal of subcontractors on the list, the selection and appointment
of subcontractors are incorporated.

6. The Contractor's apploach to ensure all his sub-contractors (irrespective of tiers) to
adopt written contracts in their sub-contracting and that all the sub-contracts
complied with the requirements as stipulated in the Contract (i.e. Clause C8 of the
additional conditions of contract for Sub-contract Conditions).
Subcontractors are requested to adopt written contracts in their subcontracting and
the Project Q.S. shall assist the subcontractors in preparing their own written
subcontract to their subcontractors whenever necessary as detailed in Section 7 of
this plan.

7. Details of the Contractor's Management Team, as required in the Contract (i.e. the
Clause D1 of these additional conditions of contract for Contractor 's Management
Team), employed on direct supervision and management of sub-contractors. An
organization chart showing the responsibilities of the Contractor's direct staff in
supervision and management of his sub-contractors should be submitted.
The Project organization chart and the respective duties and responsibilities on the
management of subcontractors are attached to the Section 4. Generally, the
Commercial Manager is responsible for the overall control of the subcontractors
whereas he would assign responsibilities to Site Engineer to monitor the day-to-day
performance of subcontractors.

8. Declaration that members of staff on the Contractor 's Management Team are
prohibited to be given a sub-contract to any part of the Works or to have a vested
interest in any of the sub-contractors irrespective of tiers.
Refer to Section 6.2 - Sub-contractor Selection, we have emphasized that members of
staff on the Contractor's Management Team are prohibited to be given a sub-contract
to any part of Works or to have a vested interest in any of the sub-contractors
irrespective of tiers.

9. The Contractor's proposed measures to ensure the compliance with the


implementation of the system of payment of wages to the Site Personnel as stipulated
in the Contract (i.e. Clause E6 of the additional conditions of contract for Payment of
Wages of Site Workers). The Contractor's proposed measures for ensuring timely
payments to sub-contractors and payments by subcontractors to subcontractors of
lower tiers.
To ensure payments has been made to subcontractor's subcontractor, the project team
will request the subcontractor to provide a declaration stating that payment has been
made to his subcontractors for the corresponding payment period, otherwise, no
payment will be made to the respective subcontractor.

10. The contractor's proposed measures to demand his subcontractors to report upward
their subcontracting arrangements and any subsequent changes.
"Reporting of Subcontracting Arrangements and Subsequent Changes" is an agenda
item in Subcontractors Review Meeting, whereas all the information reported shall
be minuted. Section 7 of this plan refers.

11. The contractor 's approach for monitoring early industrial dispute problems.
For any early industrial dispute problems identified, a working group will be formed
to investigate and to resolve the dispute problem. The members of the working group
will include the Director, Project Manager, Site Agent, Commercial Manager / Q.S.,
Site Engineer.
For the details, please refer to Section 7.4 of this plan.

12. The contractor's approach for handling complaints from workers on site regarding
wages arrears disputes and co-ordinate with Labour Department for earlier action.
Training will be provided to workers and request them to report any wages in arrears
for over 7 days. In case of any wages in arrears reported, the Human Resources
department shall be responsible for the follow up the settlement.
For the detail, please refer to Section 8.3 of this plan.

13. The contractor's proposed measures for maintaining updated daily attendance record
of all workers on the site.
A site pass system will be implemented so as to ensure the accuracy of all in/out
record of workers. Project-in-charge will assign a responsible staff to ensure and
maintain the updated daily attendance record for all workers on site.
For the detail, please refer to Section 10 of this Plan.

14. The contractor's proposed measures for site security and worker's daily access
control if applicable.
There shall be site hoarding and entrance access control for the project to ensure
unauthorized person cannot enter the site.
The vehicle in/out control shall be responsible by security guard. Any
materials/plants leaving the site are to obtain an "Exit" permit from the
administration office. No property is allowed to leave the site without such permit.

No worker will be allowed to commence work prior to receiving induction training


and the issue of a site pass that will include a photograph of the worker. The worker
will be required to show this pass prior to register for work for the day.
Daily Checking, Bi-weekly Checking and Random Checking of works on site will be
carried out by various staff.

J. Purpose
The purpose of this document is to detail the arrangement in subcontractor
management for Contract No. NL/2017/03 – Tung Chung New Town Extension –
Reclamation and Advance Works.

2. Scope of Subcontractor Management Plan


The following items will be detailed in this Subcontractor Management Plan: -
• Scope of works to be sub-contracted including the form and extent of sub
contracting arrangement.
• Subcontracting Schedule that details the names of subcontractors and form of
sub-contract.
• Criteria for selection of subcontractors.
• Project organization as well as duties & responsibilities in subcontractor
management.
• Measures in preventing subcontractor to subcontract the whole of the works
sub contracted to them
• Control and monitoring of subcontractor's performance (including works
programme, quality, safety and environmental protection).
• Measures for ensuring timely payment to downstream subcontractors after
payment to the subcontractors.

·4. Project Organization

4.1 Project Organization Chart

The proposed project organization chart is attached in the APPEDNIX C of this plan.

4.2 Duties & Responsibilities on Subcontractor Management

The Joint Venture Board

The Joint Venture Board will consist of nominated senior management


executives from each of the participating companies. The ultimate authority on
all matters related to the project lies with the Joint Venture Board. Its duties &
responsibilities in respect of subcontractor management are: -

• Approval of significant subcontracts with large values.


• Review and monitor the subcontractor management system and to ensure the
subcontractors are selected according to the selection criteria.

Project Director/ Project Manager/ Deputy Project Manager

Report to the Joint Venture Board and is responsible for:

• Approve the sub-letting schedule


• Approve the sub-contract and ensure the sub-contractors are selected
according to the selection criteria

Site Agent

Reports to the Director In-Charge and is responsible for: -

• Preparing and updating the Subletting Schedule.


• Selection of Subcontractors.
• Review the performance of subcontractors in monthly basis and report in the
Project Review Meeting.
• Handling of industrial dispute problems.
• Allocate adequate resources in subcontractor management.
• Preparing and updating the Subcontractor Management Plan.
• Ensure the performance of subcontractor (including works programme ,
quality, environmental protection and safety).
• Provide advises to subcontractors in case of any difficulties.
• Ensure the subcontractor is notified in case of any non-compliance

Construction Team Leader

Reports to the Site Agent and is responsible for:

• Monitoring the performance of subcontractors


• Establish and maintain good working relationship with subcontractor
• Supervise and co-ordinate project team and subcontractors to meet the
quality, safety, environmental protection and schedule requirements
• Review and approve material supply and work carried out by subcontractor
in relationship to workmanship, approval status
• Initiate and draft non-conformance report to subcontractor in case of any
non compliance, and follow up with the correction and corrective action
• Convene meeting with subcontractor

Site Engineer

Reports to the Construction Manager and is responsible for the co-ordination of


the site activities:-

• Support in technical matters on site work


• Inspection of materials and works
• Supervise the works of subcontractor

Superintendent/Foreman

Reports to the Construction Manager and is responsible for:

• Assist the Construction Manager in the control and monitoring of subcontractor


• Supervise the works of subcontractor
• Report to the Construction Manager in case of any non-compliance observed

Commercial Manager

Reports to the Project Manager/ Site Agent and is responsible for the contractual and
subletting matters.

• Finalize subletting packages


• Prepare the sub-contract and ensure the subcontractors are selected
according to the selection criteria.

Contractor's Labour Officer

Reports to the Project Manager/ Site Agent and is responsible for the full time on-
site monitoring of the payment of wages and MPF contributions for all the Site
Personnel:-

• Monitor the payment of Wages and MPF contributions to all the Site Personnel
• Assist the Labour Relations Officer in the monitoring process and in the
handling of complaints on arrears of wages and MPF contributions raised by
any Site Personnel

Safety Manager/ Safety Officer

Reports to the Project Manager/ Site Agent and is responsible for:

• Ensure that all activities. carried out on sites are in accordance with the
Occupat ional Safety & Health Ordinance
• Participate in organizing and conducting safety & induction training and
promotional activities to site staffs and subcontractors
• Ensure that appropriate types of PPE are issued and properly used by
subcontractors
• Promote awareness of injury prevention and damage control among
subcontractor
• Ensure that all subcontractors receive adequate and appropriate training
• Check on all plant certification provided by subcontractor to ensure
maintenance records are kept

Environmental Manager/ Environmental Officer

Reports to the Project Manager/ Site Agent and is responsible for:

• Ensure that all activities. carried out on sites are in accordance with the
Occupat ional Environmental Ordinance
• Participate in organizing and conducting Environmental training and
promotional activities to site staffs and subcontractors
• Promote awareness of Environmental Protection and damage
Control among subcontractor
• Ensure that all subcontractors receive adequate and appropriate training
• Check on all plant certification provided by subcontractor to ensure
maintenance records are kept

QA Manager/ QA Engineer

Reports to Project Manager/ Site Agent and is responsible for:

• Ensure and check that site works are carried out by competent workers
• Coordinate and Check performance appraisal of subcontractor regularly
• Conduct quality assurance training to subcontractor
• Ensure the subcontractor clearly understand the construction procedure and
requirement

Any members of staff on the Contractor's management team are strictly


prohibited to be given a sub-contract to any part of the Works or to have a vested
interest in any of the sub-contractors irrespective of tiers. This requirement
clearly states Section 4 of this plan.
5.Subcontracting Arrangement

5.1 Subletting Schedule


The proposed subletting schedule is detailed in APPENDIX D of this Plan for all
the works that will be sub-contracted. The Project Manager/ Site Agent shall
ensure that the limitations on sub-contracting shall apply to the project as set out
in the Contract.

5.2 List of Subcontracts


The proposed list of subcontractors is detailed in APPENDIX E of this Plan for all
the works that will be sub-contracted.

5.3 Requirements in ACC


The Subcontractor come from CEDD’s approved listed contractor of following
works shall obtained an ISO 9001:2008 or ISO 9001:2015 certificate.
- Ground Investigation Field Works – Group I or II
- Land Piling– Group I or II
- Site Formation (Group C)
- Port Works (Group C)
The sub-contracting of a part of the Works by the Contractor shall be limited to
two tiers of sub-contracting. The Engineer may upon request by the Contractor
permit the Contractor to introduce an extra tier of sub-contracting for a part of the
Works or a Relevant Portion which has been sub-contracted out in accordance
with the provisions of the Contract.
The Contractor shall ensure (1)Conditions of Contract Clause 46; (2)Additional
Conditions of Contract Clauses C2~C9 (3)Particular Specification Section
28&29.

6. Appointment of Subcontractor

6.1 Selection of Subcontractors

6.1.1 Potential subcontractors for the project are selected from nomination from the
client or current list of Subcontractor Register.

6.1.2 Subcontractors for the project are selected based on following Criteria:

- Previous sub-contractor history;


- Organization of Tenderer;
- Existence of quality management system
- Financial capacity and stability;
- Experience in preforming works of similar size and complexity as the works
for which their tender has been submitted;
- Qualification and experience of personnel to be allocated to the work;
- Industrial relations;
Safety, including the Control measures for Factories and industrial Undertakings
(Safety Management) Regulations compliance;
- Available resources;
- Insurance;
Support and parent company guarantees (if appropriate); and
- Any other subject of relevance

6.1.3 The Project Manager shall seek, subject to approval levels, approval of the Board
to place the proposed sub-contract by completing the Subcontractor/ Major
Supplier Report.

6.1.4 Members of staff on the Contractor's Management Team are prohibited to be


given a sub-contract to any part of Works or to have a vested interest in any of the
sub contractors irrespective of tiers.

6.1.5 The detailed subletting procedure is shown in Appendix A.

Remark: Whenever there is any discrepancy between the Chinese version of the
Sub letting Procedure and the English version of the Sub-letting Procedure, the
Chinese version shall prevail.

6.2 Appointment of Subcontractor

6.2.1 The Commercial Manager and Managing Q.S. are responsible to prepare a
standard Subcontract Agreement. The terms in the Subcontract Agreement in
addition to the
contract specifications shall also include the requirements m quality assurance,
safety and environmental protection that the subcontractor has to comply with
when they conduct their works in the project; further subletting arrangement such
that the subcontractor cannot re-sublet the entire package.

6.2.2 The Project Manager/ Site Agent shall request his sub-contractors to adopt
written contracts in their sub-contracting.

6.2.3 Any members of staff on the contractor's management team are prohibited to be
given a subcontract to any part of the works or to have a vested interest in any of
the subcontractors irrespective of tiers.

7. Control of Subcontractor 's Subcontracting

7.1 Subcontractor's Subcontracting

7.1.1 The Project Manager/ Site Agent shall request all subcontractors to submit their
subcontractors' information, which shall include the Name of Subcontractor,
scope of works, plants information etc.
7.1.2 The Project Manager/ Site Agent shall request the subcontractors to adopt written
contracts in their subcontracting. Managing Q.S. shall assist the subcontractors in
preparing their own written subcontracts to their subcontractors whenever
necessary. The suitable contract provisions setting out the restrictions stated in
ACC to the Subcontract conditions shall be incorporated in the subcontracts.
Where restrictions in the number of layer of sub-contracting are specified in the
ACC, the Project Manager/Site Agent shall incorporate these requirements in the
corresponding sub-contracts and ensure that they are observed.

7.1.3 The Project Manager/ Site Agent shall ensure the subcontractors do not re
subcontracting the entire package by inspecting the subcontractor's site
organization.

7.1.4 Upon the award of subcontract, the Project Manager/ Site Agent shall request the
subcontractor to provide a written declaration of no "hidden" subcontracts for any
part of the Works sub-contracted to him.

7.1.5 The Project Manager/ Site Agent shall request his subcontractors to report upward
their subcontracting arrangements and any subsequent changes. These shall be
reported through the regular Subcontractors Review Meeting.

7.1.6 The above mentioned requirements for the subcontractors to submit their
subcontractors information, adopt written contracts in their subcontracting, not to
re subcontracting the entire package, provide written declaration of no "hidden"
subcontracting of any part of the Works, and, report upward their subcontracting
arrangements and any subsequent changes will be included in the Special
Conditions of the Subcontracts.

8. Control of Subcontractor's Performance

8.1 Project Initiation Stage

8.1.1 Upon the appointment of the subcontractors, the Project Manager/ Site Agent
shall arrange a Subcontractor Kick-off Meeting with each of the subcontractors to
elaborate the scope of works, the terms of the subcontract agreement, the safety,
quality, environmental protection and programme requirement of the works
together with the payment arrangement and communication arrangements. When
subcontract is not ready for signing and works has to be commenced on site, the
Project Manager/ Site Agent shall also record any uncertain items at the meeting
and to ensure proper records will be made available.

8.1.2 The subcontractor shall be requested to provide the proof/clarifications of


ownership of construction plant and material, if any

8.2 Monitoring of Subcontractor's Works


8.2.1 The Project Manager/ Site Agent shall ensure each subcontractor submit their daily
report so as to report the progress of the works.

8.2.2 The Project Manager/ Site Agent shall convene Subcontractors Review Meeting on
regular basis so as to review the performance & progress of each subcontractor.

8.2.3 Inspection and Test Plan (ITP) is prepared for each package of work to be carried out
by subcontractor. The ITP shall address all the inspection/testing criteria and
responsibilities of the Engineer, Contractor and Subcontractors. All subcontractors
shall acknowledge the respective ITP and follow the stated requirements entirely
throughout the construction.

8.2.4 The Project Manager/ Site Agent shall initiate Non-conformance report to
subcontractor in case of any non-compliance observed. The Project Manager/ Site
Agent shall also request the subcontractor to complete the correction and corrective
action within a time frame. All non-compliance shall also report to the Project
Manager/ Site Agent.

8.2.5 The Project Manager/ Site Agent shall inspect the subcontractor's works and ensure
the quality meets the requirements before submit the Request for Inspection to the
Engineer.

8.2.6 The Project Manager/ Site Agent shall convene regular site walk with subcontractors,
so as to identify all the improvement needs, including progress, resources allocation,
quality, safety and environmental protection.

8.2.7 The Project Manager/ Site Agent shall report the performance of each subcontractor
in Project Review Meeting.

8.3 Performance Appraisal

8.3.1 The Project Manager/ Site Agent, Safety Manager, Commercial Manager and QA
Manager shall grade the performance of each active subcontractor at least once a year
by completing the Subcontractor Performance Appraisal Form through company
intranet. The performance will be evaluated based on the following parameters: site
management, technical knowledge, workmanship (quality), progress, environmental
protection, safety, co-operative, manpower resource and financial.

8.3.2 The Project Director shall review the Subcontractor Performance Appraisal Forms
prepared by QA Manager.

8.3.3 The QA Manager shall review the Subcontractor Performance Appraisal Forms,
clarifies with the Project Director and Project Manager/ Site Agent, and making
adjustment to the assessment score if necessary; and then prepare the Subcontractor
Performance Summary.
8.3.4 If the score in the Subcontractor Performance Appraisal Form is below average,
the subcontractor will be classified as disqualified subcontractor and an
appropriate disciplinary action should be executed.

8.4 Monitoring of Early Industrial Dispute Problems

8.4.1 All the dispute problems shall be handled as soon as it happened.

8.4.2 Once the dispute happened, the Project Manager/ Site Agent shall form a working
group to investigate the case and try to resolve it with the respective
subcontractor. The working group shall form by the Project Manager, Site Agent,
Commercial Manager.

8.4.3 For any dispute problem carn10t be resolved at the early stage, the Project
Manager/ Site Agent shall seek for advice from Project Director and Commercial
Manager for further action.

9. Preventing of Wages in Arrears

9.1 Ensure Timely Payments to Subcontractors and Payments to Subcontractors of


lower tiers by the Subcontractors

9.1.1 Sufficient funds shall be reserved in the Contractor's designated bank account for
the subcontractors' payment.

9.1.2 The agreed time frame for the payment to subcontractors in accordance with the
respective subcontract shall be strictly complied with.

9.1.3 The Project Manager/ Site Agent shall request the subcontractors to provide name
of its subcontractors of lower tiers, and required the subcontractors to submit a
written declaration to ensure payment has been made to their subcontractor of
lower tiers at a timely manner. Otherwise, the Project Manager/ Site Agent shall
withhold payment to the subcontractor.

9.1.4 The Contractor shal1 ensure that the subcontractors of all tiers has sufficient fund
available in the designated bank account for the subcontractors' payment to his
subcontractors of lower tiers.

9.1.5 The Project Manager/ Site Agent shall encourage subcontractors of lower tiers to
report if payment has not been made to them within an agreed time frame.
9.1.6 The Project Manager/ Site Agent shall request the subcontractors to provide the
name of workers (including those working under their sub-sub-contractors or any
lower tiers) when the workers first enter the site to work.

9.2 Protect Labour from Wages in Arrears

9.2.1 In general, the specified measures as set out in the Contract for the workers'
wages protection measures shall be followed.

9.2.2 The Project Manager/ Site Agent shall ensure that all on-site workers to enter into
written employment contracts with their employers. All the written employment
shall be properly kept on Site for record and checking purpose.

9.2.3 The Project Manager/ Site Agent shall ensure all wages, including MPF, for site
personnel (except Casual Workers) must be paid through an auto pay account
opened at a designated bank. Transaction records of the auto payment shall be
submitted to the Engineer.

9.2.4 For the Casual Workers, who are defined as site personnel and has only worked
on the project for less than 7 days over the full duration of the project, their wages
payment can be made by cash cheque with the name of the worker as recipient.
Copy of the withdrawal receipt issued by the bank and signed by the worker will
be submitted to the ER.

9.2.5 Self employed workers without personnel accident insurance cover, with a
minimum coverage of HK$ 1,000,000, will not be allowed to work on the site.
Certified true copy of the insurance policy will be made available for inspection
by the ER. A sample insurance policy is also enclosed in the appendix of the
ACC.

9.2.6 The Project Manager/ Site Agent shall arrange to provide a JV Labour Officer for
the ER to monitor I handle labour issues of the project. The JV Labour Officer
shall carry out his/her duties and responsibilities for the worker's wage protection
works as stated in the Specifications.

9.2.7 The JV Labour Officer shall establish an effective "one-point" contact for the Site
Personnel on Site on any enquiries in relation to workers' wages and employment
matters.

9.2.8 A separated direct telephone hotline to the JV Labour Officer shall be established
to receive any related enquires or complaints on wage arrears, if any. The JV
Labour Officer shall arrange meeting(s) with the relevant Site Personnel on Site
for further follow-up, whenever considered necessary.
9.2.9 The Project Manager/ Site Agent shall arrange to display notices for the contact
details of the N Labour Officer at prominent locations on the Site for the easy
information and notification to any Site Personnel.

9.2.10 The JV Labour Officer shall conduct briefing sessions to inform and to educate
the Site Personnel the benefits of the wage payment control measures being
implemented, in particular the workers.

9.2.11 The JV Labour Officer shall conduct regular visits to promote the monitoring
system and to establish contacts with Site Personnel to obtain feedbacks.

9.2.12 The JV Labour Officer shall monitor payment of wages and MPF contributions
and oversee the setting up and maintenance of a record system on employment
contracts, workers attendance, re-deployment, and wage payments.

9.2.13 The Project Manager/ Site Agent shall anange to employ an administrative officer
responsible for full time on-site monitoring the payment of wages and MPF
contributions to all the Site Personnel.

9.2.14 The workers are required to confirm that they have received all wages up to end
ofthe latest payment period.

9.2.15 The Project Manager/ Site Agent shall require his/her subcontractors, of all tiers ,
to prepare the respective schedule of wages of the Site Personnel employed or
engaged by them and the corresponding MPF contributions based on the verified
data from the smart-card system (For the details of Smart-card system, please refer
to Section 11 of this Plan).

9.2.16 The subcontractors are also required to declare that all workers employed by them
or their sub-sub-contractors (or any lower tiers if any) have received wages up to
the end of the latest payment period. Failure to comply with this requirement shall
result in suspension of further payment to the concerned sub-contractor until
compliance thereof.

9.2.17 The Project Manager/ Site Agent shall a so instruct the Safety Officer and Site
Foreman to remind all workers and get their signed acknowledgement, during
conducting Safety Induction Training / Toolbox Talk for the following: -

• There are any wages and salaries in arrears for over 7 days, the worker shall
report to our company immediately via the designated administrative officer.
• Workers shall not sign incorrect wage records and attendance records

• Workers shall retain a copy of signed employment contract and keep signed
copies of accurate wages and attendance.
9.2.18 The Project Manager/ Site Agent shall ensure the wages has been made to labour
before effect payment to subcontractors. (APPENDIX B)

9.2.19 The Project Manager/ Site Agent shall arrange to establish and to ensure the
operation of the monitoring system for payment of wages to all workers
employed by the company or the subcontractors of all tiers, which also covers the
Smart Card system. The Site Pass System is outlined in the Section 12 of this
plan.

9.3 Handling Complaints of Wages in Arrears

9.3.1 Notice shall be posted at the site entrance, site office and other places as
appropriate, to remind workers to report any wages in arrears by subcontractors.

9.3.2In addition to the efforts made by the administrative officer, the Project Manager/
Site Agent shall instruct their Safety Officer and Site Foremen to remind all
workers and get their signed acknowledgement, during conducting Safety
Induction Training / re freshment Training / Toolbox Talk for the following:

• Should there be any wages and salaries in arrears for over 7 days, the worker
shall report the company immediately via the administrative officer.
• Workers shall not sign incorrect wage records and attendance records
• Workers shall retain a copy of signed employment contract and keep signed
copies of accurate wages and attendance.
• Inform the workers about the contact details of administrative officer and the
JV Labour Officer. In case of any queries related to wages in arrears for over
7 days, the workers shall immediately inform the administrative officer and
the JV Labour Officer.

9.3.3Should there be any "Wages in Arrears" found, the Project Manager/ Site Agent
shall report the case to the Director-in-charge. With the assistance of the HR
Department, the administrative officer shall verify the Wages in Arrears and the
relevant records, including the attendance records, prior to report to the JV Labour
Officer. The JV Labour Officer shall refer to the Labour Department complaints
on wage arrears as soon as they are received and to provide necessary assistance
to Labour Department to facilitate investigation and/or dispute resolution where
appropriate.

9.3.4 The Project Manager/ Site Agent shall collect all the relevant information and pass
to Human Resources Department to follow up with the settlement with the
workers.

9.3.5 The Project Manager/ Site Agent shall also inform the Procurement Department to
suspend the future tendering / award of further subcontract to the concerned sub
contractor.

9.3.6 The Project Manager/ Site Agent and the Human Resources Manager shall co-
ordinate with Labour Department for earlier action in handling such complai nts.

9.3.7 The Project Manager/ Site Agent shall keep the Engineer informed of the latest
situation of the complaints.

9.3.8 The administrative officer shall provide all necessary assistance to the JV Labour
Officer in the monitoring process and in the handling of complaints on arrears of
wages and MPF contributions raised by a Site Personnel.

1.0. Site Security Measures & Control

10.1 Site Hoarding and Gate


Proper condition site hoarding with lighting or chain link fence will be erected
along the boundaries of the site where practicable.
Security guard will report any defect of the hoarding / chain link fence to the Site
office for rectification.

Any damage hoarding / chain link fence with intention will be reported to the Project
Manager/ Site Agent immediately.

10.2 Sign Board


Warning notices shall be displayed on signboard at all site entrances.

10.3 Access Control


Site entrance access will be kept to a minimum possible extent and a metal gate
with pad lock shall be provided.
The metal gate at site entrance will be locked after site working hour.
A notice with the emergency contact number will be posted next to every entrance
gate.

After 1800 hours to 0800 hours next morning, security guard will have regular
patrol and logbook to be signed.

10.4 Vehicle Control


No vehicle is allowed to park overnight on site without the prior consent of Project
Manager/ Site Agent. Label will issue to authorized vehicles.
Security guard will record all vehicles in and out of the site. Where necessary the
security guard will request the driver to produce HKID record especially vehicle
leaving the site with property.

Material and plants leaving the site are to obtain an ' Exit' permit From the
administration office. All properties without the 'Exit' permit will not be allowed to
leave the site. The security staff will stop any vehicle carrying material or
equipment attempted to leave the site without authorization by all possible means.
Vehicles in doubt should not leave the site unless clarify by the administrative officer.

11. Site Pass System -Worker's Daily Access Control

11.1 Implementation of Site Pass System

11.1.1 The Project Manager/ Site Agent shall arrange to implement the Site Pass System: -

• To ensure that all person working in this project are registered.


• To ensure no illegal worker will be employed.
• To identify worker to be under which subcontractor.
• To record the attendance of all site personnel

The Site Pass system comprises designated procedures of workers' registration on


Site, their daily access control and an attendance recording system that is named as
"Smart card system". The "Smart-card system" shall comply with the requirements
set out in the contract specifications.

11.1.2 The Site Pass (i.e. The Smart Card) shall be issued to the worker within one
working day after he has attended the Site Safety Induction Training. Site
Administration will keep a database of the Site Pass issued. However, at the
project initiation stage which is prior the operation of Smart Card system, log
books shall be used as a temporary measure to record the time of entry and
departure of all Site Personnel and selfemployed workers in and out of the Site.

11.1.3 Subcontractors shall provide $100 deposit per card for Site Pass. No deposit is
required for direct employed workers.

11.1.4 The direct employed workers and subcontractor workers shall be charged $100
handling fee for lost card replacement.

11.1.5 Smart card readers shall be installed at the security booth at different convenient
locations of the Site for access control and attendance recording purpose.

11.1.6 Handling of Visitors and Newly Joined Daily Workers: -

• All visitors are to be registered at the security booth. Limited safety helmets
will be kept for visitors.
• Any visitor refuses to be registered will not be allowed to entered the site.
• Newly joined daily workers are to be registered at the security booth and their
Green Card copies are to be stuck onto their safety helmet until they have
received their Site Pass.

11.1.7 Handling of the Client / Engineer's Representative Staff: -

• Client / Engineer's Representative staff will be invited to join the system.

• Deposit and charge for lost card replacement is not required.
11.1.8 All persons, including the subcontractor's workers, entering and leaving the site
shall pass through the entrance gate of Smart Card System at security booth and
hence the information including their date and time of the entry / exit, etc. will be
recorded electronically.

11.1.9 The administrative officer will collect compile and verify the daily records of the
Site Personnel working on the Site based on the data collected by the Smart Card
System. Such verified daily attendance records shall be distributed to each
corresponding sub contractors for their verification.

11.2 Site Pass Patrol and Recording

Project Manager/ Site Agent shall appoint the administrative officer or other staff
to be responsible for keeping the people and vehicles in /out records.
Subcontractors shall submit the daily labour return according to the subcontract
requirements.

The administrative officer will maintain the updated daily attendance record of all
workers on the site and verify with respective subcontractors in case of any
ambiguities.

Daily Checking: -

• To be conducted by the site foreman.


• To inspect the Site Pass / Green Card of the suspicious persons entering /
remaining on site.
• The checking record will be sent to the administrative officer and Safety
officer after inspection.
Bi-weekly Checking: -

• To be conducted by Project Manager/ Site Agent or by a security company


appointed by the company
• The ID and Site Pass will be checked and recorded during the inspection
• To advise the Project Manager/ Site Agent on any security related matter
after each inspection
• Prepare checking record and report to Project Manager/ Site

Agent Random Checking: -

• To be conducted by Site Safety Officer with Security Guards


• The Green Card will be checked, recorded and passed to administrative officer

1. Procedure

1.1 Declaration by Sub-Contractor of Having Paid All Wages and Salaries


1.1.1 All Project-in-charge shall request their subcontractors to provide the
name of the workers (including those working under their sub-sub-
contractors) when the workers first enter the site to work.
1.1.2 Project-in-charge or his delegates shall check the identity of all workers
(including HKID card number and green card nun1ber, and obtain
specimen signature from the worker) and keep a record of the
information checked. This information shall be passed to Safety Officer
for verification when conducting induction training for the new workers.
1.1.3 Project-in-charge or his delegates shall carry out daily checks to ensure
that the named workers are actually working on site and that any workers
not named on the list are, subject to our checking of their identity and
that we have already main tained a record of him/her, included therein. In
the latter case, the sub-contractor concerned shall be asked to confim1
that the worker is actually required on the day in question.
1.1.4 The workers are required to confirm that they have received ALL wages
up to the end of the latest payment period. If there is any worker not
confirming such receipt or confirming that he/she has not received FULL
payment, the sub-contractor shall be asked in writing to provide evidence
of FULL payment within 7 days or to give valid reasons of non-payment
to the satisfaction of the Company. If the sub contractor fails to provide
such evidence or reasons, no further payn1ent will be made to the sub-
contractor concerned unless and until be satisfactorily proved that all
such wages are paid.
1.1.5 The sub-contractors are required to confirm that all workers employed by
them or their sub-sub-contractors have received wages up to the end of
the latest payment period. Failure to comply with this requirement shall
result in suspension of further payment to the concerned sub-contractor
until compliance thereof.
1.1.6 All the above-mentioned records shall be maintained by Administrative
Officer.

1.2 Ensure Salaries / Wages were Received by Labour before Authorizing


Pay ment to Sub-contractor
1.2.1 At the end of each payment period, the site QS shall check that all
records are completed and duly executed.
1.2.2 Before preparing payment certificates to sub-contractors, the project-in-
charge shall satisfy that:

1.2.3 All labour shown on the daily records as having been worked on site during the
relevant payment period has confirmed receipt of their respective wages by
signing a declaration of receival of wages.
a. labour employed by him has been paid and has caused his sub-sub
contractors of any tier to submit a similar form to the Company.
1.2.4 Before authorizing payment to the sub-contractors, the Accounts Department shall
ensure a full set of payment records of the concerned sub-contractor are duly com
pleted.
• Ideally, declaration of receival of wages shall be attached to declaration of
payment of wages when the subcontractor for payment. However, should this
not be practicable, the sub-contractor should be asked to provide all declara
tions of reoeival of wages (signed by workers) before the payment cheque is
re leased to the sub-contractor. The Project-in-Charge shall inform the
Accounts Department using a record of the completeness of wages payment.

1.3 Encourages Worker to Report Wages in Arrears

1.3.1 Notice shall be posted at the site entrance, site office and other places as
appropriate, to remind workers to report any wages in arrears by subcontractors.
1.3.2 All Project-in-charge shall instruct their Safety Officer and Foremen to remind all
workers and get their signed acknowledgement, during conducting Safety
Induction Training / refreshment Training / Toolbox Talk for the following:
• There is any wages and salaries in arrears for over 7 days, the worker shall re
port to our Company immediately via the PIC, site Safety Officer or Foremen.
• Workers shall not sign incorrect wage records and attendance records
• The Main Contractors are only liable for the fast two-month wages in arrears.
Workers must serve a written notice to the main contractor within 60 days of
the wages become due.
• Workers shall retain a copy of signed employment contract and keep signed
copies of accurate wages and attendance.

1.4 Reporting of Salaries in Arrears

1.4.1 Should there be any "Salaries in Arrears" found, the Project-in-charge shall
report the case to the Director-in-charge.
1.4.2 Project-in-charge shall collect all the information in regarding the matter to
Human Resources Department to follow up with the settlement with the workers.
1.4.3 Project-in-charge shall also inform the Procurement Department to suspend
the future tendering / award of the concerned sub-contractor.

1.5.1 Any public infonnation (e.g. HKCA) in regarding "Wages in Arrears" shall
passed to Procurement Department, Human Resources Department and all
Project-in Charges. 1 of 3
1.5.2 Procurement Department shall check if the concerned company is on our Sub-
contractor Register, if yes, the Procurement Manager shall initiate to suspend the
company from tendering / award for our project without justification from the
Director.
1.5.3 Procurement Dept. shall issue a memo with a fulllist ofall concerned companies
to all Project-in-charge. The Project-in 야 arge shall check to ensure if any
concerned company is the sub-contractor or sub-sub-contractor of the project. If
yes, the Project-in-Charge shall inform the case to Director immediately, and
discuss with the Director in regarding the strategy shall be imposed to the
concerned sub contractor /sub-sub-contractor.
