by Hon’ble Single Judge in SWP No. 1624/2017
titled Abdul Majid Tak Vs. State of J&K & Ors.

May it please your Lordships: -

The Caveator/applicant respectfully submit as under: -

1/- That vide judgment dated 02.12.2019 the Learned Single


judge disposed of the writ petition with a direction to
respondent No. 1 and 3 to examine the findings submitted
by the enquiry Committee vide their communication dated
25th of October 2018 with reference to the issue involved in
the writ petition and accordingly pass appropriate orders
thereon in accordance with law. A copy of judgment dated
14.11.2019 downloaded from website is enclosed herewith
and marked as ANNEXURE – “I”.

2/- That the caveator has reasonable apprehension that the


non- caveator may challenge the aforesaid judgment before
the Hon’ble Division Bench and may press for passing an
exparte interim relief by misrepresenting the facts.

3/- That the caveator is bound to suffer substantial irreparable


loss and injury in case an ad-interim exparte order is
granted in favour of non caveator without hearing the
caveator. As such the caveator respectfully prayed that
they shall be heard in the matter before passing any order.
4/- That the caveator has already send the copy of the instant
caveat petition to the non caveator through registered post
which is evident from perusing the postal receipt enclosed
herewith and collectively marked as Annexure-“II”.

IN THE PREMISES:

It is, therefore, respectfully prayed that keeping in


view the submissions made hereinabove, the Hon’ble Court
be pleased to hear the caveator/applicant before passing
any order in case non caveator file LPA against the
aforesaid judgment dated 02.12.2019.
