FINDINGS OF FACT AND CONCLUSIONS OF LAW
1. The Division of Administrative Hearings has jurisdiction over this matter and the
parties hereto.§§ 409.256, 409.2563, and 120.80(14)(c), Fla. Stat.
2. Based upon genetic test results that equal or exceed 99% probability of paternity,
of which Respondent acknowledged receipt, Respondent is the legal and biological
father of the following child(ren), as follows:

Paternity has been legally established by affidavit or voluntary acknowledgment.
The Respondent has a legal duty to contribute to the support of the child(ren)
and does not provide the primary residence.
3. The child(ren) needs support, and the Respondent has the present ability to pay
child support.
4. Ajonee Yvonne Martin, the Custodial Parent, has custody of the child(ren), and
the primary residence of the child(ren) is with the Custodial Parent.
5. a. The Respondent's actual net monthly income is $2,052.87 (48% of the parents'
combined net income).
b. The other parent's actual net monthly income is $2,257.32 (52% of the parents'
combined net income).
c. Monthly child care costs are $487.50.
d. Monthly health care coverage costs for the child(ren) are $0.00.
e. Total monthly child support need under the Florida Child Support Guidelines is
$1,368.50.
6. Respondent's share of the total child support need is $857.00 per month, taking into
account the factors set forth in section 61.30, Florida Statutes. The guidelines
worksheet is attached hereto and incorporated herein.
7. Respondent's obligation to support a child covered by this Order ordinarily
terminates when the child reaches 18 years of age or the disability of nonage is
removed.§ 61.14(9), Fla. Stat. However, Respondent's obligation to support a child
covered by this Order shall extend beyond the age of 18 years: a) if the child is
dependent due to a mental or physical incapacity that started prior to age 18; or b) if
the child is dependent, between his or her 18th and 19th birthdays, still in high
school, and reasonably expected to graduate before his or her 19th birthday.
§ 743.07(2), Fla. Stat. If none of these special conditions applies, Respondent's
current monthly child support obligation will be reduced or terminated at the 18th
birthday of the child or children covered by this Order, in accordance with the
following schedule:

Notwithstanding the above, whenever an obligation to pay current child support is
terminated or reduced due to the emancipation of a child and Respondent owes an
arrearage, retroactive support, delinquency, or costs, Respondent shall continue to
pay at the same rate in effect immediately prior to emancipation until all arrearages,
retroactive support, delinquencies, and costs are paid in full or until the amount of
the order is modified. § 61.14(10)(a) and (b), Fla. Stat.
8. Health insurance that would be accessible by the child is not available to the
Respondent at a reasonable cost (presumed reasonable if 5% or less of the
Respondent's gross income) at this time. The Respondent has the ability to pay 48%
of the child's medical, dental, and prescription medication expenses not covered by
insurance.
9. The Respondent must pay retroactive support from February 01, 2024 through
January 31, 2025, a total of 12 months, based on the age of the child or oldest child,
if more than one.
The total retroactive support amount of $7,884.00, before credit, is based on the
retroactive incomes of the parents, any financial affidavits as submitted by the
parents, and taking into account the factors required by the Child Support Guidelines
(Section 61.30, Florida Statutes). The retroactive support amount is calculated at a
rate of $857.00 per month for 02/01/2024 through 01/31/2025.
The Respondent has been given $100.00 credit for the support payments actually
made during the retroactive period.
The Respondent's net retroactive support obligation is $7,784.00 and must be paid at
the rate of an additional $43.00 per month, which the Respondent has the present
ability to pay.
With the additional payment for retroactive support of $43.00 per month, the Total
Monthly Support Obligation is $900.00.
10. No parenting time plan was offered to the parents.
11. Additional findings of fact and conclusions of law:
As indicated on the attached guidelines, the undersigned has made an equitable
Smith-Speed adjustment to the guideline support amount pursuant to section
61.30(11)(a)11., Florida Statutes, based on Respondent's support of a biological

child living in his household. Fla. Dep't of Revenue v. Cochran, 253 So. 3d 731
(Fla. 1st DCA 2018).
It is, therefore,
ORDERED that:
A. Paternity. Respondent, Christian Lamar Thomas, is the legal and biological father
of:

B. Payment of Support.
I. Current and Retroactive Support. Respondent, Christian Lamar Thomas, is
ordered to pay the following amount(s) every month, beginning on February 01,
2025, to:

(1) The total current support is $857.00 per month;
(2) $43.00 per month for retroactive child support until the total retroactive obligation
of $7,784.00 is paid;
(3) for a Total Monthly Support Obligation of $900.00.
II. Reduction or Termination of Current Support Obligation.
Respondent's obligation to support a child covered by this Order ordinarily
terminates when the child reaches 18 years of age or the disability of nonage is
removed. § 61.14(9), Fla. Stat. However, Respondent's obligation to support a child
covered by this Order shall extend beyond the age of 18 years: a) if the child is
dependent due to a mental or physical incapacity that started prior to age 18; or b) if
the child is dependent, between his or her 18th and 19th birthdays, still in high
school, and reasonably expected to graduate before his or her 19th birthday.

INCOME DEDUCTION ORDER
The undersigned Administrative Law Judge enters this Income Deduction Order
regarding the Respondent's child support obligation pursuant to sections 61.1301 and
409.2563(7), Florida Statutes.
To: All current and subsequent employers and payers of the following:
Respondent: Christian Lamar Thomas
YOU ARE HEREBY ORDERED, pursuant to Florida law, to immediately begin
making regular deductions from all income of the Respondent in accordance with this
Income Deduction Order and any accompanying Order/Notice to Withhold Income.
YOU ARE FURTHER ORDERED:
1. To deduct from all money due and payable to the Respondent:
(a) $857.00 per month for current child support. Child support shall be
automatically reduced or terminated consistent with paragraph 2.
(b) $43.00 per month for retroactive child support until the total retroactive
obligation of $7,784.00 is paid,
(c) for a total monthly obligation of $900.00.
2. Respondent's obligation to support a child covered by this Income Deduction
Order/Notice to Withhold Income ordinarily terminates when the child reaches 18 years
of age or the disability of nonage is removed. § 61.14(9), Fla. Stat. However,

3. You shall deduct 100% of any income paid in the form of a bonus or other similar
one-time payment, up to the amount of arrearage reported in the Order/Notice to
Withhold Income, or the remaining balance and forward the payment to the State of
Florida Disbursement Unit. For purposes of this subparagraph, "bonus" means a
payment in addition to an obliger's usual compensation and which is in addition to any
amounts contracted for or otherwise legally due and shall not include any commission
payments due an obliger.
4. You shall pay the deducted amount to the "State of Florida Disbursement Unit,"
and mail it to the State of Florida Disbursement Unit, Post Office Box 8500,
Tallahassee, Florida 32314-8500, Telephone No. (877)769-0251. All payments must
include the obliger's name (last, middle, first), obliger's social security number, obligee's
name (last, middle, first), name of county where court order originated, and depository
number. All payments must be made by check, money order, cashier's check, certified
check, or through the Internet with access provided by the State of Florida
www.floridasdu.com. No credit will be given for any payments made directly to the
obligee without a court order permitting direct payments.
5. You shall not deduct in excess of the amounts allowed under the Consumer
Credit Protection Act, 15 U.S.C. § 673(b), as amended.
6. This Income Deduction Order, or an Income Deduction Notice, will be served on
the Respondent's present and future employers. Enforcement of the Income Deduction
Order may only be contested on the grounds of mistake of fact regarding the amount
due pursuant to the order establishing, enforcing, or modifying the amounts in
paragraph 1, or the identity of the Respondent, the custodial parent, or the employer.
