The following sample contract is based on the requirements for a Written Statement of Initial
Employment Particulars. In accordance with the Employment Rights Act 1996 all employees
should receive a written statement that contains all of the following within two months of
starting work.

Some additional clauses are added at the end. These are suggestions of clauses that you might
want to add, but they are not legally required.

Contract of Employment

1. The name of the employer referred to in this contract is <insert Name>.

2. The name of the employee referred to in this contract is <insert Name>.

3. The date when your employment with this employer began is <insert date>.

4. The date when your employment in the role referred to in this contract began is <insert
date>.

5. Your job title will be <insert job title>.

6. In this role your commencing salary will be <insert amount>. This will be paid in equal
[monthly/weekly] instalments into your bank account on the [date] of each
[week/month].

[You will also be entitled to a bonus which will be calculated on the basis of [Explain
bonus calculations. Make it clear if the bonus is discretionary or contractual].

leave must be booked in advance through your line manager. If you request to take one

that your request will be approved – the company will not be liable for any cancellation
fees if you book a holiday before permission to take the leave is granted.

You are expected to take all your leave in the holiday year which runs from [month] to
[month]. It will only be in exceptional circumstances that you will be permitted to carry
leave forward to the next holiday year.

expected to explain the reason for your illness and the length of time you expect to be
absent.

Additional Clauses

Probationary Period

In this role you will be subject to a probationary period of [number] months. If, during that
period, you do not meet the standards required by the company, we reserve the right to
terminate your employment without notice.

If your performance during this period is acceptable but not quite up to standard the company
reserves the right to extend the probationary period. If the required standards are not met
during that extended period the company reserves the right to terminate your employment
without notice.

Conditional Offer

This contract of employment is offered subject to the receipt of satisfactory references. If


satisfactory references are not received, the company reserves the right to terminate your
employment without notice.

Garden Leave

The company reserves the right to ask you to stay at home and remain on the payroll at any
time. During this period, you would not be required to work. This period, referred to as ‘garden
leave’, would be for a period determined by the employer.

Pay in Lieu of Notice

The company reserves the right to terminate your employment and pay your outstanding
notice pay as a lump sum. In this situation, the date at which your employment would end
would be the date given by the company, when the lump sum payment would be made.

Confidentiality

Any information that you have access to during your employment in relation to customers,
