MOTION TO WITHDRAW INFORMATION


UNDERSIGNED, ASSISTANT PROVINCIAL PROSECUTOR, before this
Honorable Court, most respectfully alleges:

1. That prior to arraignment within the reglementary period provided


by law, Respondents, through counsel moved for Re-investigation of
the case which the court granted;
2. That the case was scheduled for re-investigation on July 12 and 26,
2017;
3. That, on June 20, 2017, complainants executed an Affidavit of
Desistance and submitted the same to this office on June 28, 2017,
for having no interest in further prosecuting the case;
4. That, after a re-evaluation of the complaint, and evidence on record,
the undersigned recommended the dismissal of the charge against
respondents MERCY LAURETO, NORA YAP, TIRSO LAURETO and
BENITO DELA CRUZ.
5. That, in view of the foregoing, the undersigned Assistant Provincial
Prosecutor most respectfully prays that the Information previously
filed before this Honorable Court be withdrawn.

WHEREFORE, premises considered, the prosecution respectfully moves


for the withdrawal of Information for the above entitled case.
