To the Defendant named above: -
The Plaintiff named above has instituted proceedings against you claiming an order
for a decree of divorce and other ancillary relief. A statement of the Plaintiff's claim
is set out in the declaration, a copy of which is annexed to this summons.
If you wish to oppose any of the plaintiff's claim, you must: -
(a) Enter an appearance to defend by making an appropriate entry in the
appearance book kept in the office of the Registrar of the High Court of
Zimbabwe at Harare within ten days of service of th is summons (Saturdays,
Sundays and public holidays are no counted as part of this ten-day period,
nor is the day on which this summons was served) and

(b) Notify the Plaintiff or her Legal Practitioners in writing at the address given
beiow on your entry of appearance to defend. You must give the plaintiff or
the Legal Practitioners an address for service within five kilometers of the
court specified above together with a postal address.
If you do not enter an appearance to defend, the Plaintiff's claims will be heard and
dealt with by the High Court without further notice to you.
The Sheriff is hereby required to serve a copy of this summons on the Defendant
named above and immediately after doing so, to return a further copy of the
summons with a return of service in the requisite Form duly completed to the
Registrar who issued it.

PLAINTIFF'S PARTICULARS OF CLAIM
PARTIES
1. Plaintiff is Joyline Edith Bhiri a female adult whose email address is
joybhiri@qmail.com
2. For purposes of this action, Plaintiff's address is care of her legal practitioners
of record Messrs John Mugogo Attorneys of 7A Monmouth Road, Avondale,
Harare and whose email addressis johnmuqoqo@qmail.com
3. Defendant is Kudakwasghe Terry Gonah, a male adault person whose email
address terrykudakwasheqona@qmail,com and whose residential address is
47 Pendenis Road, Mount Pieasant, Harare.
MARRIAGE
4. Plaintiff and Defendant got married to each other on 12th July 2023at Harare
in terms of the then Marriage Act [Chapter 5: 11] now known as Marriages
Act [Chapter 5:17]
5. The marriage still subsists.
A copy of the Certificate of Marriage is attached hereto as Annexure A

JURISDICTION
7. The Defendant is domiciled in Zimbabwe and considers Zimbabwe as his
permanent home.
8. Jurisdiction of this Honourable Court to hear the matrimonial matter is on
account of Defendant's domicile.
MINOR CHILDREN
9. There are no children of the marriage relationship between the parties.
MATRIMONIAL ESTATE
10. There are no properties, movable or immovable, acquired during the
subsistence of the marriage relationship.
IRRETRIEVABLE BREAKDOWN OF MARRIAGE
11. The marriage between the parties has irretrievably broken down to the
extent that it is not possible to resuscitate it into a normal marriage
relationship. In particular:
11.1 The parties have not lived as husband and wife for a period in excess
of a year
11.2 The parties have respectively lost love and affection for each other.
11.3 The parties have increasingly grown incompatible over the years that
they cannot continue with the marriage relationship.
MAINTENANCE
12. The parties are each capable of looking after themselves without any
contribution from the other. There is therefore no need for an order as to
spousal maintenance.
COSTS
13. There should be no order as to costs.

WHEREFORE Plaintiff seeks a decree of divorce against the Defendant in the
following terms;
a) A decree of divorce be and is hereby granted.
b) There shall be no order as to costs
