(hereinafter called "the tenderer") has submitted its tender dated 27th March, 2025 for
PROPOSED CONSTRUCTION OF A 200 STUDENTS CAPACITY STOREY DOMITORY AT
NYATAMBE MIXED SECONDARY SCHOOL - PHASE I. Hereinafter called "the Tender"
KNOW ALL PEOPLE by these presents that WE THE MONARCH INSURANCE COMPANY
LIMITED of P.O. BOX 44003 - 00100 NAIROBI, having our registered office at
PRUDENTIAL ASSURANCE BUILDING, THIRD FLOOR, WABERA STREET (hereinafter
called "the Surety"), are bound unto SUBA SOUTH NAIONAL GOVERNMENT
CONSTITUENCIES DEVELOPMENT FUND of P.O. BOX 24 - 40308, Sindo. (Hereinafter
called "the Procuring entity") in the sum of KSHS. 600,000/= (Kenya Shillings Six
Hundred Thousand Only) for which payment will and truly to be made to the said
Procuring entity, the Surety binds itself, its successors, and assigns by these presents.
THE CONDITIONS of this obligation are:-
1. If the tenderer withdraws its Tender during the period of tender validity specified by
the tenderer on the Tender Form; or
2. If the tenderer refuses to accept the correction of errors in his bid; or
3. If the tenderer, having been notified of the acceptance of its Tender by the
procurement entity during the period of tender validity:
a) Fails or refuses to execute the Form of agreement in accordance with
instructions to tenderers, if required; or
b) Fails or refuses to furnish the performance security in accordance with the
Instructions to tenderers;
We undertake to pay to the Procuring entity up to the above amount upon receipt of its
first written demand, without the Procuring entity having to substantiate its demand,
provided that in its demand the Procuring entity will note that the amount claimed by it is
due to it, owing to the occurrence of one or both of the two conditions, specifying the
condition or conditions.
This tender guarantee will remain in force for 126 (One Twenty Six) days and including 30
(Thirty) days after the period of tender validity, and any demand in respect thereof should
reach the Surety not later than the above date.

550 - 40300, Homa Bay. (Hereinafter called "the Procuring entity") in the sum of KSHS.
150,000/= (Kenya Shillings One Hundred and Fifty Thousand Only) for which pay-
ment will and truly to be made to the said Procuring entity, the Surety binds itself, its suc-
cessors, and assigns by these presents.
