AFFIDAVIT
I, Vimala, wife of Mahendran, Hindu, aged about 58 years, residing at
No.126/33, Jaganathapuram, Chennai – 600 031, do hereby solemnly affirm
and state as under:
I state that I am residing at the above address at No.126/33,
Jaganathapuram, Chennai – 600 031 for past 2 years and the said address
is my proof of address.
I further state that The above said Respondent/ Accused have
remanded under Judicial Custody on 24.02.2025 for the alleged offences
under Sec.316(2), 318(4), 351(2), 3(5) of BNS 2023. in Crime
No.162/2024, on the file of the Respondent/Complainant and from the date
of judicial custody he is in Central Prison, Puzhal.
I humbly further submits that the accused was lease out his property
of Rs.15,00,000/- (Fifteen Lakhs) located at PANNAJ APARTMENTS
NO.17/9 new street, Chetpet Chennai – 600 031.which is already
hypothecated by HDFC Bank. And he is not pay the EMI So the bank officials
taken physical possessions of the Property at in the year of 2023. We are
not aware of the property is hypothecated by the bank. So we file a
complaint to the jurisdiction Police against our Land lard of
Mr.Kamalakannan and Mrs Devisathya who is the Owner of the property
and here the Accused 1&2.
I humbly further submits after keep on follow up the respondent
Police, was register a FIR against the Accused 1&2, and remanded the said
accused on 24.02.2025. Now the accused 1&2 came forward to decided to
settle the matter we received Rs.3, 50,000/- on 25.02.2025 and already
received Rs.2, 50,000/- on variable dates. Now the Said Accused confirmed
with us Ready to settle the matter within April 30,2025 to Pay sum of
Rs.9,00,000/- for the remaining balance and additional of Rs.1,00,000
Total.10,00,000/-
I humbly further submits after this settlement arrangement arranged
by the family members and the accused confirmation we are Agree the
same and here we confimed there is NO OBJECTION FOR GRANTING A
BAIL FOR THE ACCUSED.
It is therefore prayed that this Hon’ble Court may be pleased to
admit the Affidavit for supporting of bail of the Accused1 and 2.
