RESIDENTIAL LEASE AGREEMENT
This residential agreement is made this 30 th day of Dec, 2021
BETWEEN
1. Rajneshwar Prasad & Astika Prasad of Lot 34 Cheng Place, Raiwai (who together with his executors

administrators and assigns is hereinafter referred to as “The Landlord”) of the first part.
AND
Ashneel Chand Maharaj of TIN : 133519703
2. _____________________________________________________________ respectively (who together with
their executor administer and assign is hereinafter referred to as “The Tenant”) of the
second part.
WHEREAS the landlord shall let the tenant take tenancy of the dwelling situated at Lot 34
(As House on it's Own, Top & Bottom Flat) Cheng Place, Raiwai, Suva (hereinafter called “The Premises”).
UPON AND SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS
1. The tenancy shall commence on the 16th Jan, 2022 and shall be fixed for a term
of 2 Years to 15th Jan, 2024. The tenancy may be extended by mutual
agreement between the landlord and tenant.
2. The tenant agrees to pay rent of $3000 per month exclusive of the water bill and
exclusive of electricity bill, commencing from the 16th day of Jan, 2022 Such
rent is to be paid monthly in advance without any deduction whatsoever to the
landlord. Rent is due on the commencement date of the month and if not paid on or
before the commencing date than penalty of FJD100.00 per month will be applied.
3. The tenant agrees to pay bond of $3000.00 to the landlord on the date of
execution of Tenancy Agreement. The landlord shall be entitled to apply the said
bond in payment of any unpaid rent or other monies owing by the tenant and in
payment of any cost, claims, damages or expenses incurred by the landlord in
remedying or attempting to remedy any breach by the tenant of any of the terms,
conditions or covenants hereof. The bond shall be payable to the tenant if he or she
decides to vacate the house upon the completion of the term stated above which
is 2 years. Vacation at any time earlier than this will not be accommodated by this
arrangement. Bond will only be refunded to the tenant upon completion of
mandatory term of 1 year expiring on 15 th Jan, 2023
4. The tenant agrees to notify the landlord in writing of any damages or repairs
required on the property, on the attached property inspection checklist within FIVE
working days of the commencement of this tenancy. If this list is not returned it shall
be taken that the tenant has accepted the premise in a clean and undamaged
condition. The tenant may be liable for any repairs and damages that have not been
so notified
5. The tenant agrees to keep the premise and chattels therein all times reasonably
neat, clean and tidy and in good condition and repair (fair wear and tear excepted)
and shall not paint, drive nails or screws into, affix any kind of adhesive tape, or in
way deface the premise or the landlord’s fixture and fittings.
6. The tenant agrees to replace all glass, window, mirrors, electric light bulbs, light
shades, stove element, fuses, electrical fittings and tap washers in the premise as
they wear out or are broken or become unserviceable, with /other of at least the
same quality and power as installed at the date hereof.
7. The tenant agrees to ensure that the premise receive adequate ventilation and is
responsible for the prevention and removal mould and mildew if and when it
accumulates
8. The tenant agrees to keep drains, water pipes and sinks free of obstruction and
shall keep the premises free of pest and insects and shall compensate the landlord
for any drain cleaning, fumigation or extermination that may be necessary
9. The tenant agrees to keep the ground clean and tidy and free from bottles,
pruning, clippings, compost and all general rubbish. Lawns are to be mown regularly,
edges and gardens kept tidy and hedges cut. The grass cutting will be done by
the landlord
10.The tenant shall not cause or permit any condition or alterations to the said
premise or to any of the fittings in or on the property
11.The tenant shall use the premises as a private dwelling only and shall not at any
time permit or suffer any act or omission upon or about the premises which shall be
disturbance, nuisance or annoyances to the Landlord or the occupiers or the owners
of adjoining properties which might render any additional premium payable in
respect of any polices of insurance on the premises or which will make voidable any
such policy.
12.The maximum permitted number of occupants shall be Family of 9. The number of
cars permitted shall be 2. The tenant shall only park permitted cars in the space
provide and shall not permit any cars or vehicles to be otherwise parked on the
grounds of the premises. The tenant shall ensure that all vehicles parked on the
premise have a current warrant of fitness and registration and are in all respected
roadworthy. Any vehicle not complying with above shall be removed immediately.
13.The tenant agrees to pay compensation to the value of any repair to any part of
the property damaged by the tenant during the Tenancy.
14.The tenant agrees to be liable for ALL debt recovery costs including but not
limited to collection agency fees, legal expense, District court charges and other cost
incurred by the landlord in pursing monies outstanding at the end of the tenancy.
15.The tenant agrees not to assign, sublet or part with the possession or occupation
of the premise or any part there of or of the chattels and shall not remove any of the
chattels form the premises.
16.The landlord has the right in accordance with the relative provisions of Laws of Fiji
to inspect the premises under the following circumstances; (a) to make regular
internal room inspections (b) to show to new tenants or prospective purchasers (c)
to carry out value or inspect any necessary or urgent repair or maintenance. The
Landlord will be inspecting the property once in every month and will give at least 2
days’ notice before the said inspection.
17.The tenant hereby warrants that all carpets/tiles will be personally or commercially
cleaned at the tenant’s costs upon termination of the Tenancy. The tenant shall
provide a receipt to the landlord evidencing the work if requested, or shall otherwise
accept that the landlord will carry out the work on the tenant’s behalf, chargeable to
the tenant.
18.Should the tenant fail to pay rent promptly or break any of the terms of this
agreement or break any provisions of the Residential Tenancies Act then the landlord
shall be liberty to pursue all the remedies set out in the Residential Tenancies Act.
19.Rental for the aforesaid property is fixed at FJD $ 3000.00 per month for the
duration of the Tenancy, i.e. Landlord cannot increase rent during the 2 years term
.
20.The tenant acknowledges receipt of a copy of this tenancy agreement and accepts
receipt of 1 set of key for the premise as detailed below, unless otherwise notified
in writing to the landlord within five working days of the commencement date of this
tenancy.
21.The tenant agrees to deliver the keys to the landlord, by noon on the day the
premise are vacated and the tenant shall be deemed to have remained in occupation
of the premises until the keys have been so delivered. If the keys are not returned
within three working days after this date the landlord shall be entitled to have
tenant’s expenses.
22.The Landlord shall be responsible for insurance, town rates and any other
statutory payments/obligations relating to the premises.
23.The tenant is NOT PERMITTED to consume Alcohol and tobacco products at
the premises.
24.The tenant is NOT PERMITTED to slaughter any animal at the premises.
25.The tenant must ensure that a high standard behavior in and around the
premises is maintained and the neighborhood is not disturbed with any
activity that may warrant intervention from any regulatory or enforcement
agencies.
26.The tenant must ensure that no visitor is allowed to stay at the premises for
more than 2 days and seek approval from landlord in any case where a
visitor may be required to stay more than 2 days.
