Under the instructions from and on behalf of my client MR. BLAISE


PINTO residing at Sheetal Heights, ‘H’ Wing, Flat No. 704, Seventh Floor,
Link Road, Near, D-Mart, (Fire Brigade), Nallasopara (East), District –
Palghar - 401209, I have to address you as under :-

1. My client Mr. Blaise Pinto undersigned invested his harden


money of Rs. 10 Lakh's with Dhawal Mhatre. He Agreed to
invest this money at his commodity Market Share Bazar on
condition accepted liabilities at fixed income at 5% each and
every month yield either gain. Or loss.. After accepted contract
between two party My client Blaise Pinto and Dhaval Mhatre; He
took his two cheques payment to Dhawal Mhatre of sum of Rs. 5
Lakh's of each on dated 30/08/2013 deposited to his bank
account drawn from Vijaya Bank, my client; Mr. Blaise Pinto's
account at Ambadi Road, Vasai branch. Second cheque issued
by my client Mr. Blaise Pinto to Dhawal Mhatre of Rs. 5 lakhs on
dated 13/09/2013 drawn from his Vijaya bank acount. Total
investment capital of Rs 10 Lakh's as agreed upon business deal
he would pay to my client 5% of the yield fixed amount derived
from his profits or not at commodity share market revenue
earned or not fixed income to my client,5% of the yield interest
fixed each and every month pay to Mr. Blaise Pinto out of his
earned income or not, that he receive from commodity markets
share bazar that he received every month of minimum 8% to
12% a month respectively. He agreed he would part with it to
my client undertake entire responsibility of his commodities SEBI
share market at his own risk accord and pay him each month 5%
of the yield income without fail to my client; either he earns or
not; agreed upon standard statutory agreement at my client Mr.
Blaise Pinto investment's of Rs. 10 lakh's with Dhawal Mhatre.
He Dhaval Mhatre gave his assurance, at writings to my client
Mr. Blaise Pinto with his company letter head signed with his
office rubber Stamp signature as signatory. Corporate Director of
Aster Finance Corporate. He put a clause stated at his
letterheads that, He would block my founds of 10 Lakh's for the
rest of period 3 months. He would return back my capital
invested with yield interest earned within 10 days written notice
period to my client Mr. Blaise Pinto.

2. He started paying to my client Mr. Blaise Pinto Rs. 25,000 each


due date of the month that is 5 th and 15th of each month this is
50,000 per month of each month respectively he woul

d pay is my client MR. BLAISE PINTO of Rs 25,000. That is 50,000. He


paid constantly for 7 month's to my client Mr. Blaise Pinto;

3. Thereafter; he came up with excuse story that his business


partner ran away with the money. While visiting his office, Mr.
Dhawal Mhatre said to my client Mr. Blaise Pinto that; he would
clear to pay out the capital amount first and later clear the yield
interests due part of it outstanding to my client Mr. Blaise Pinto..
I trusted and believed his statement so on. He closed his office
without notice to my client Mr. Blaise Pinto and quietly vanished
closed down his office at Vasai West.

4. You advertised your company with sign board as Aster finance


Corporate. You had a full fledged office at Anand Nagar Vasai
West, at Ground Floor. You closed down your office. You never
informed to my client Mr. Blaise Pinto; your next office shift not
known to my client Mr. Blaise Pinto whereabout you have shifted
your office premise's. Finally, tried to locate your living place at
Parijana Villa at Mulgaon your parent residence hide from your
client's. My Client went personally to meet you at your father
residence at Parijana at Mulgaon Vasai West, your father you
kept on preponing postponing with one after the other excuses
covering yourselves with lies. You never return the money with
due yield interest. Kept on postponing. Wherever, my client Mr.
Blaise Pinto went to your parent house you were not found
there, absconding from your parent place, later you was found
that you is staying at Santacruz with your friend sharing and you
used to come home at end of the week; sometime you were not
there at home.

5. My client Mr. Blaise Pinto met your father. Your Father said his
properties are at sale process and once he get the money he
would clear everyone debts. Your father kept on postponing that
his property sale deed is on process. After reminding he started
giving my client dates. When enquired with him it is on
processes, enough excuses told to my client Mr. Blaise Pinto,
heard nothing sign of money from your father Nitin Mhatre, you
and your father started with excuses; Either return of cheque
payment or at process from 2014 onwards until March 2018
nothing concern to pay my dues money. My client Mr. Blaise
Pinto started calling up you and your father and heard of enough
number of excuse till the date. there was no sign of my client
money return dues. He was duped cheated by you and your
associates and my client Mr. Blaise Pinto threatened not to come
to them at your home and Dhawal would lodge harassment
complaint's to the police. My client Mr. Blaise Pinto's money with
committed yield interest over his money and the statement of
account enclosed for your kind attention.

You hereby called upon expedite immediate return of my


client Mr. Blaise Pinto's dues as statement account enclosed and
the due bank interest accumulated against his money invested
with Dhawal Mhatre from 2013 to today's days value full and
final settlement of account required to clear his outstanding
account. Failing which; my client Mr. Blaise Pinto shall sue you
under section cheat and fraud business of Dhawal Mhatre. You
should return the money with full accountability as or the norms
you agreed contract with liability of my client Mr. Blaise Pinto
and written promissory note given by you to my client Blaise
Pinto due money and the yield with bank interest to senior
citizen according to legal convection discharge of his
commitment records as agreed upon 2013 contract signed
agreed by you and my client Blaise Pinto, you hereby expedite
the matter for payments, within 15 days from the receipt of this
Notice statement of accounts enclosed for kind perusal
attention to pay the dues with bank interest for all these years
long period due in return from you to my client Mr. Blaise Pinto.

Please Note, the Outstanding Amount will be


charged as per Bank Interest to the Senior Citizens.

1. My client says that my client was come in your contact by introducing of one
MR. SANJAY QUELO who is an also investor of your company and dealing of
the second hand car. My client says that Mr. Sanjay Quelo was very well known
that my client has sold his residential flat. My Client further says that my client
is have huge amount, hence MR. SANJAY gave advice my client that my client
should invest his money in company who give good returned, MR. SANJAY had
held a meeting you in your office with my client, in the meeting you assured and
trusted my client you will give good returned i.e. @ 6% per month in whole
invest amount.
2. My Client says that on your trust my client had invested a sum of Rs. 10,00,000/
(Ten Lakh) in two part by way cheque bearing no. 19320881 dated 30/08/2013,
19324012 date 13/09/2013 in your reputed company and you assured and trusted
my client my client would be get good income every month on the investment
amount @ 6% per month. You also trusted my client the invest amount will be
lock down period of 3 months and amount will be returned on the demand of my
client after three months on the time of span of 10days , in this respect you have
given the same in writing.
3. My client says that my client was being got Rs. 30,000 per month accordingly
your assurance from 31/10/2013 to 30/10/ 2014 continuously and after that my
client was being got Rs. 15,000/ on 31/10/2014 & 28/02/2014 and you failed
for making of the payment of the month November & December 2014 and
thereafter you gave Rs. 15,000/ on 28/02/2015 & Rs. 20,000/ on 31/03/2015, Rs.
15,000/ on 31/05/2015 and lastly Rs. 10,000/ each i.e. 20,000/ on 13/09/2016 &
31/12/2016.
4. My client says that accordingly the calculating of the proper account an amount
Rs. 11087903 is payable by you to my client.
5. My client says that sometime you failed for the making of the payment, as you
trusted my client at the time of the investment. My client had given his lifetime
income to you for his future rest but you did spread water on the hope of my
client. Now my client has been making efforts to contact you personally, but you
could not be available anytime anywhere and hence my client comes to final
conclusion that you have some ulterior motive to the effect that you are not
sincere in making the payment of my client as you trusted.
6. My client says that from the total behavior on your part, my client has drawn a
clear inference that you have done so with a view to deceiving and cheating my
client on your false misrepresentation, you have entrusted with investment of my
client. My client further says that now you have intention to permanently dispose
off the same for you own use and it is criminal offence punishable under
provision of Section 420, 409 of IPC.
7. My client says that it also appears that from beginning you intention were not
good when my client approached you for making of investment, since than you
had made plan to cheat my client due to his old age.

That under the circumstance, you are hereby called upon to pay the client Rs.
11087903 to my client within 15 days from the receipt of this notice ,failing
which my client will be constrained to take against you an appropriate legal
action , which please you note.
