Ref :- Inspection of records of your Factory/Establishment U/S 45 0f ESI Act. 1948


Dear Sir/Madam,

Please refer to my visit to your factory/establishment on _________________with advance


intimation for inspection of records under section 45(2) of the ESI Act 1948 to ascertain compliance
under the provisions of the ESI Act.Shri/Smt./Ms________________________________________
who was available at the time was contacted by me. All the relevant records are/were, however, not
produced before me for inspection purposes on the above date i.e __________________ though
prior notice of my visit was given to you.

Non-production of records before the Social Security Officer Under section 45(2) of the ESI Act
amounts to obstruction of the SSO and/or non-compliance under the ESI Act attracts Prosecution
Action Under Section 85 of the ESI Act. This will also attract other action against you in accordance
with the provisions of the ESI Act. However before recommending legal action as mentioned above
to the Regional Director and accepting your request for adjournment of inspection, you are given
another opportunity to produce the following records of your factory/establishment
on____________ when I will be visiting your Factory/Establishment between___________AM/PM.

The details of records to be produced by you are as under:-

1. All Attendance Registers for the period from___________ to __________ or last five years of
date of inception whichever is earlier.
2. All Wages Registers for the period from___________ to __________ or last five years of date
of inception whichever is earlier.
3. Accounts Books, Ledgers, Cash Books, Day Books, Journals and subsidiary books of accounts
along with vouchers and other documents.
4. All Registers to be maintained ( such as Form-7, Accident Register, Inspection Books) under
ESI General Regulations.
5. Challans for payment of contributions made from starting of factory/last five years to current
date.
6. Returns submitted Inspection of Factories/Commissioner of Shops & Establishments etc.
including for application for Licence/renewal of licence under various Acts.
7. Any other documents relating to your factory/Establishment relevant to the employment
position and payment of wages, Remuneration etc.
8. Audited Balance Sheet, Trial Balance and Profit & Loss A/C for the above referred periods.

Please note that no further postponement of inspection will be allowed and in case of failure to
produce all or any of the records detailed above on the above said date, I will have no other
alternative but to recommend the case to the Regional Director for Criminal Prosecution or other
Legal Action against you as per law.
