SUB : LEGAL NOTICE UNDER SECTION 138 OF THE NEGOTIABLE INSTRUMENTS


ACT, 1881

Under the instructions and on behalf of my client, Mr. Prakash Badade, residing in Kirti Nagar,
New Delhi-110002 (hereinafter referred to as "my client"), I hereby serve you with the
following legal notice:
1. That my client is engaged in the business of trading vending machines. In the ordinary
course of business, you, the addressee, purchased vending machines from my client and,
as payment towards the discharge of your liability, issued a cheque bearing No. 006584
dated September 19, 2023, drawn on State Bank of India, Dwarka Branch, New Delhi-
110008, for a sum of Rs. 10,00,000/-.
2. That my client deposited the said cheque for encashment with his banker, HDFC Bank
Ltd., located at 28, Kirti Nagar, New Delhi, on October 3, 2023.
3. That the cheque was returned dishonoured due to "insufficiency of funds." My client
received the dishonoured cheque along with the bank’s cheque return memo dated
October 3, 2023.
4. That my client became aware of the dishonouring of the cheque on October 3, 2023.
5. That due to the dishonouring of the cheque, you, the addressee, are liable for committing
an offence punishable under Section 138 of the Negotiable Instruments Act, 1881 (as
amended).

Through this legal notice, I formally demand that you make the payment of Rs. 10,00,000/-,
being the amount of the dishonoured cheque, within fifteen (15) days from the date of receipt
of this notice. Failure to comply shall compel my client to initiate appropriate legal proceedings
against you, including civil and criminal actions, at your sole risk, cost, and consequences.
This notice serves as your final opportunity to settle the matter amicably. We urge you to treat
this matter with utmost seriousness and resolve the issue promptly.

A copy of this notice has been retained for our records, and we shall proceed as required by law
in the event of non-compliance.
