AFFIDAVIT OF ARRESTING OFFICER

I, Pat Mark Dagul, bonafide member of the Philippine National Police,


assigned at PNP Drug Enforcement Group Special Operation Unit situated at Camp
Winston S Ebersole, San Roque, Occidental Mindoro after having been duly sworn to
in accordance with law, do hereby depose and say:

1. That on February 25, 2022, at about 8:00 o’clock in the morning, PLT
KENNETH IRING, received an information from the Confidential Informant (CI)
related to the activities of @ Harry and cohorts who are allegedly involved in selling
and distribution of illegal drugs mainly shabu preferably in NCR, region 3 and nearby
and cities and provinces and they are looking for possible buyer;

2. Acting on said information PLT KENNETH IRING team leader relay the
information given by the confidential informant to Pat Johnsem S Isoy and instructed
us to evaluate and validate the said information;

3. After getting all the essential elements of information our team leader
received a phone call from our confidential informant that the above-named subject
drug personalities were looking for a buyer of Shabu in the quantity of 50 grams.
wherein our confidential informant will introduced Pat Isoy to the subject as his friend
that is willing to make a purchase of shabu;

4. On February 26, 2022 at around 8:00 oclock in the morning our PLT
IRING called up a meeting to all personnel of this unit together with the CI regarding
to the pending operation to the subject personality @ Harry and cohorts, during the
said meeting Pat Isoy was designated as poseur buyer (PB) on the said operation;

5. On February 27, 2022 at around 8:00 oclock in the morning final briefing
was conducted somewhere in Caloocan. The undersigned was designated as
arresting officer, Pat Shaira Ly as photographer and others are back up officers. In
addition, tackled that the PB will scratch his head as pre-arranged signal confirming
that the sale has already been consummated;

6. Further, during the subject briefing PLT IRING informed that our Unit has
already received a Memorandum from TDL in compliance with Administrative
Matter 21-06-08-SC (Rules on the Use of Body-worn Cameras in the Execution
of Warrants and an Alternative Recording Device) (attach a copy of a
memorandum from TDL dated August 10, 2021, signed by PMGEN ANGELITO A
CASIMERO) informing our Unit that there is no available stock of Body-worn
Cameras and Alternative Recording Device for issuance at present. However,
these items will be considered in future programming for procurement. In addition, we
were also informed that our CI will be part of the actual Buy-bust and his confidential
information, as well as his identity, cannot be disclosed and documented for his
personal safety and that his family against the imminent and possible retaliation of
our target drug personalities not to mention that our conversations and exchange of
information are considered “Top Secret” and/or “privileged”. These pressing
circumstances made it impossible to record and/or videotape the whole operation as
it could possibly result in danger to the lives of the police operatives and compromise
the entire operation;
7. On even date at around 4:45 in the afternoon while we are at Rizal
Avenue in front of SM Grand Central, Monumento, Caloocan City, the undersigned
and other operatives of this unit position ourselves in strategic location;

8. The undersigned saw the PB together with the confidential informant


approached an unidentified male personality slim body built MOL 5’2 to 5’4 in height
MOL 20 to 25 years old wearing a white t-shirt, blue and white short with labeled nike
standing in the side walk in front of SM Grand Central the confidential informant wave
to him and approach them. After a while I saw the PB handed a bundel oh money to
the unidentified male person, the unidentified male person handed also a plastic bag
to the PB after scrutinizing the content of the plastic bag the PB scratch his head
resulting to the undersigned and other back up officers to immediately run towards
the suspect and introduced myself as police officers while putting the suspect under
arrest I apprised him of his constitutional rights and the nature and cause of his
arrest, the suspect was identified as HARRY TAG YAWID @Harry, male, 20 years
old, DOB October 24, 2001, single, self-employed and resident of 164 J. Dolores St.
Pasay City.

9. In compliance in Section 21 of RA 9165 as amended in the doctrine


laid down in the PP vs Lim, the undersigned immediately prepare the inventory
receipt form and physicaly marked the said ítems and photographs in front of
arrested suspect witnessed by:
a. Kgwd. Juan De Leon, elected Brgy. Official of Brgy 88, Caloocan
City; and
b. Mr. Renato Alige, media representative of Agila News.

10. On even date a coordination was made by PCpl Luvy Ruerte to avail
the presence of DOJ Representative from the City Prosecutor’s Office of Caloocan
City. Accordingly, no available DOJ representative as per duty SG Ditablan.
However, he put on record for the purpose of compliance to Section 21 of RA 9165
as being a witness in a Buy bust operation conducted by this Unit;

11. On even date at around 11:10 in the evening, the PB together with
PCpl Dizon (IOC) and the undersigned brought the arrested suspect for drug test
examination and submitted the pieces of drug evidence at PNP Forensic Group
Camp BGen Rafael T Crame, Quezon, City;

12. The filling of case against HARRY TAG YAWID @Harry, male, 20 years
old, DOB October 24, 2001, single, self-employed and resident of 164 J. Dolores St.
Pasay City for violation of Section 5 and Sec. 15, Art. II of RA 9165 otherwise known
as “The Comprehensive Dangerous Drugs Act of 2002” are being prepared for
filing against the arrested suspect.
