Affidavit in support of application U/S 14 of securitisation and
reconstruction of Financial Assets and Enforcement of Security Interest act,
2002
I, GURSEWAK SINGH ,Aged Adult Authorized officer of Aavas financiers limited is
a company incorporated under the companies act,1956 and is a Financial
Institution Under the SARFESI act having its Registered office at at 201-202 second
floor south and Square Mansarovar Industrial Area Jaipur-302020, do hereby
solemnly affirm and state on oath as under:-
1. 1.That the respondent had availed the secured loan against property facility
of Rs.. 6,50,000 ( SIX LAKH FIFTY THOUSAND RUPESS) for grant of loan
against property facility by mortgaging the property by deposit of title
deeds and submitted an application form furnishing various details
mentioned particularly therein. And also executed the loan against property
facility account No LNBDL02922-230267691 for 7,04,256/-(SEVEN LAKH
FOUR THOUSAND TWO HUNDREAD FIFTY SIX RUPEES ONLY) as on
08/10/2024 in favour of Aavas financiers Limited , The respondents thereafter
had jointly defaulted in making payment of due amount and failed to
regularize the loan amount despite, repeated request, reminders and
issuance of notice , so the entire the loan amount become NPA and were
recalled by the applicant and the respondents were called upon to pay a
sum outsanding of 7,04,256/-(SEVEN LAKH FOUR THOUSAND TWO
HUNDREAD FIFTY SIX RUPEES ONLY) together with further interest till the
date of payment.
2. The opponents have created a security interest over various property and
that the applicant is holding a valid and subsisting security interest over
such property and the claim of the applicant is within the limitation period

3.The borrower/co-borrower/mortgagor has created security interest over
such property giving details of the property reffered in sub clause (ii) above
4. The borrower/co-borrower/mortgagor has jointly committed default in
repayment of the financial assistance granted to them aggregating to the
6,50,000 ( SIX LAKH FIFTY THOUSAND RUPESS) as on 31/12/2022
5.Consequent upon such default in repayment of the financial assistance to
the loan account of The borrower/co-borrower/mortgagor has been classified
as non-performing asset on dated
6 Affirming the that the period of sixty days notice as required by the provision
of sub-section (2) of section 13, demanding payment of the defaulted financial
assistance has been issued and served on the opponents through post
7. The Borrower has not made full repayment of the financial assistance in
spite of the above notice and Authorized officer is therefore, Entitled to take
possession of secured assets under the provision of sub section 14 of section
SARFESI ACT,2002
8 That the provision of the act and rules made there under had been compiled
with
