MOTION TO LITIGATE AS PAUPER
WITH ATTTACHED URGENT
PETITION FOR MANDAMUS
Petitioner, by himself and unto this Honorable Court, most
respectfully states that:
1) Petitioner is an indigent within the meaning of
Section 21, Rule 3 of the Revised Rules of Civil
Procedure considering that the gross income taken
together with that of his immediate family do not
exceed an amount double the monthly minimum
wage of an employee and that no real properties
having a fair market value of more than Three
Hundred Thousand Pesos (Php300, 000.00) is
registered under their name;
2) Article 3, Chapter II of the 2021 Public Attorney’s Office
(PAO) Operations Manual provides:
“ARTICLE 3. Indigency Test. – Taking into consideration
recent surveys on the amount needed by an average
Filipino family to (a) buy its “food consumption basket”
and (b) pay for its household and personal expenses, the
following shall be considered indigent persons:

1.) If residing in cities or municipalities within the
National Capital Region (NCR), persons whose individual
net income does not exceed Twenty-Four Thousand
Pesos (P24,000.00) a month;
xxx.
3) In the case at bar, the petitioner is presently residing in
the City of Manila1 which is within the NCR, and his monthly
income does not exceed P24,000.002. Hence, it is very
clear that herein petitioner is an indigent;
4) To further bolster his claim that he is an indigent, the
following are hereto attached, to wit:
a) Certification from the Business Permit and License
Office stating that he has no business3;
b) Affidavit of Indigency executed by petitioner4; and
c) The Joint Affidavit of two (2) disinterested persons in
attestation of petitioner’s indigency5.
3. By virtue of the foregoing, Mariano P. Flores respectfully
prays that he be allowed to litigate as pauper and he
be exempted to pay the docket and other legal fees
relative to the filing of his petition with this Honorable
Court pursuant to Section 19, Rule 141 of the Revised
Rules of Court6.

1 Faithful reproduction of petitioner’s Postal Identity Card is attached hereto as
Annex “A”.
2 The original copy of petitioner’s Certificate of Employment with Compensation is
attached hereto as Annex “B”.
3 The original copy of which is attached hereto as Annex “D”.

WHEREFORE, premises considered, it is most respectfully
prayed of this Honorable Court that the petitioner be allowed
to litigate as pauper.
