To ROSENNA NSIMBI (ADMINISTRATOR OF THE ESTATE OF THE LATE HENRY
NSIMBI)
Whereas it appears by the statement on oath of MARTIN NSIMBI, sworn 18th day of March,
2024, that HENRY NSIMBI of Busi, Masaka died on 3rd June, 2022, at MASAKA HOSPITAL
that letters of administration for the estate of the late HENRY NSIMBI were issued to
ROSENNA NSIMBI on the 29th day of January, 2023 vide Probate and Administration Cause
No. 24 of 2023 by the Chief Magistrate’s Court of Masaka.
And whereas it further appears from that statement on oath that MARTIN NSIMBI is one of the
biological children and hence beneficiary of the late Henry Nsimbi.
Now this is to command you, ROSENNA NSIMBI, that within twenty-one days after service of
this citation on you, inclusive of the day of that service, you cause a statement to be filed in this
court, and accept or refuse probate of the will, or show cause why letters of administration, with
the will annexed, of all the estate which by law devolves to and vests in the personal
representative of the deceased, should not be granted to MARTIN NSIMBI. And take notice that,
in default of your so appearing and accepting and extracting probate of the will, this court will
proceed to grant letters of administration of the estate to MARTIN NSIMBI, your absence
notwithstanding.

STATEMENT ON OATH
I, MARTIN NSIMBI, C/o M/s D6 & ASSOCIATES P.O Box 7117, Kyamugorani Road,
Mbarara, Uganda do solemnly take oath and state as follows: -
1. That I am a male adult Ugandan of sound mind, the Citor in this citation and swear this
statement on oath in that capacity.

2. That Martha Nsimbi, Joy Nsimbi and Malaika Nsimbi and I are biological children of the
late Henry Nsimbi (Copies of the respective Birth Certificates are hereby attached and
marked as Annexures “A1”, “A2”, “A3” and “A4”)

3. That our late father died and left property and Rosenna Nsimbi was appointed as
administrator by the Court to administer his estate on the 29th day of January, 2023 vide
Probate and Administration Cause No. 24 of 2023. (A copy of the said Letters of
Administration is hereto attached marked “B”).

4. That the administrator has been and is continuously mismanaging the estate of my late
father and has not yet exhibited an inventory or account in respect of the deceased’s
estate.

5. That the Administrator sub-divided the land at Busi, Masaka District and transferred
some portions of it to her children at no consideration.

6. That the administrator has never distributed the estate of the deceased among the
beneficiaries.
7. That the Administrator has further sold a part of the land at Busi, Masaka District to
Samuel Lugya and it is now known as Block 21 Plot 124.

8. That the Administrator withdrew all the money savings in the Bank Account at KCL
Bank, Masaka Branch.

9. That the Administrator has continuously mismanaged the commercial building in Masaka
Town which is now in a very unsanitary and disrepair state and some tenants have left
and others threatening to complain to the District Health Officer.

10. The grant obtained by the Administrator was fraudulent as the she made a false
suggestion without consent and knowledge of the Citor and no family meeting was held
to ascertain the Defendant as the Administrator of the deceased’s estate.

11. That I swear this affidavit on my behalf and on behalf of other Citors in support of our
application for revocation of the Letters of Administration granted by this Court to
Rosenna Nsimbi.

12. That whatever is stated herein above is true and correct to the best of my knowledge.
