The World IP Forum is currently in its 12th Edition, and in the years prior, we held numerous conferences in New Delhi,
Bangkok, Bengaluru, Dubai, and Taipei. We are preparing for the conference in UAE, UK, USA and European countries in
the near future.
This platform mainly focuses into knowledge sharing and thus fills up the previous gaps of un-certainty into a booming
business opportunity which was previously unexplored and un-ventured. It was a long haul through several obstacles
before the inception of this idea took place and came into reality. Our bull’s eye is mainly networking and knowledge

Projections indicate that the global semiconductor industry will reach $1 trillion by the end of this
decade, a significant increase from $590 billion in 2021. Notably, major players like Intel and AMD in
the United States engage in longstanding competition for dominance in computer processors, while
companies like Arm focus on semiconductor design for mobile devices. This fierce market rivalry not
only propels technological advancements but also fuels active research and development, leading to
the filing and enforcement of an impressive number of patents.
In 2022, a record-breaking 69,190 global patents were filed for semiconductors, reflecting a
substantial increase from the 62,000 and 55,000 filed in the preceding two years. While countries like
the United States, Taiwan, Japan, China, and some European nations currently lead in semiconductor
production and innovation, India is strategically positioning itself amidst a changing landscape.
Semiconductors have gained prominence due to their scarcity, driven by the U.S.-China technological
rivalry and the pandemic's impact, intensifying the urgency for nations to secure self-sufficiency in
semiconductor production. Recognizing the strategic importance of this technology in the
contemporary world, the Indian government aims to emerge as a semiconductor powerhouse. In
December 2021, the Cabinet announced a substantial Rs 76,000 crores (over USD 10 billion) incentive
package to attract foreign semiconductor and display firms. It is noteworthy that major players from
the chip industry, including Samsung Electronics Co. Ltd, Qualcomm, and Huawei Technologies, are
already major players in India’s patent landscape. Infact these three were the top filers of Indian
Patents for in year 2021.
The issue of patent registration holds paramount importance for India's semiconductor industry.
Semiconductors and their designs, requiring high-quality engineering and substantial investment,
demand legal protection against piracy. Throughout the history of intellectual property (IP)
protection, strong safeguards, particularly through patents, have incentivized manufacturers to
continuously innovate and enhance their market value.
Advancing patent and integrated circuit (IC) protection for semiconductors is crucial for fostering
innovation on a large scale. Such protection ensures a reasonable commercial return for domestic
manufacturers, contributing to India's growing prominence in the semiconductor market.
Furthermore, increased investment in patenting and protecting semiconductors will help India
establish a strong foothold in both domestic and international markets, positioning it as a major
semiconductor superpower.
Moreover, patenting semiconductors in India will drive the development of advanced research and
development (R&D) infrastructure, leading to improvements in existing technologies and increased
efficiency for future advancements. As the global demand for semiconductors continues to rise, India
has the potential not only to become a superpower in semiconductor production but also an
intellectual hub for research, design, and a significant player in exports.
The Indian Patent Office (IPO) has made significant improvements to streamline patenting processes,
including digital transformation and increased staffing. As a result, obtaining a patent now takes 3-4
years, comparable to developed IP-savvy jurisdictions. India’s Commercial Courts Act 2015 and the
Intellectual Property Division (IPD) created by Delhi High Court have further strengthened the
country’s patent ecosystem by creating specialized spaces to handle IP disputes, with other
prominent Indian high courts contemplating creating IPDs as well. This has resulted in a robust case
management system and timely resolution of patent disputes.
Protection under Patent Law in India presents a promising future for the Indian semiconductor
market, elevating the level of protection necessary for highly integrated circuits. With India poised to
increase its domestic semiconductor production and become a global market leader, an uptick in
patenting activity is expected, providing a significant competitive advantage over established
markets. Intellectual property rights are a key avenue for domestic manufacturers to establish a
presence in the semiconductor industry, aligning with the government's initiatives for the sector.
Strengthening the legal framework for semiconductor intellectual property in India is a prudent
move to protect and enhance the unique qualities of these technologies, setting the stage for
sustained growth and innovation in the Indian semiconductor landscape.
Samsung India Electronics Private Limited, a subsidiary of Samsung Electronics, one of the world’s largest technology
and smart phone manufacturing companies, through its branch office in Bangladesh, filed a Judicial Review (Writ
Petition) in 2015 before the High Court Division of the Supreme court of Bangladesh. In the Judicial Review Samsung
challenged the inaction and failure of the government bodies, i.e. Customs Authority, Telecommunication Regulator
(BTRC), Rapid Action Battalion (RAB) and Police Authority of Bangladesh, to perform their statutory function. Such
inaction and failure had resulted infringements of SAMSUNG trademark rights through imports, distribution and
trading of unauthorized and counterfeit SAMSUNG branded mobile phones and electronic goods by grey importers
and unscrupulous traders.
The number of the unauthorized and grey importers and unscrupulous traders are plenty in numbers which made it
unmanageable and impractical for Samsung to bring them under justice and protect its trademark rights under the
ambit of Trademarks and Specific Reliefs Acts.
This Judicial Review, initiated in 2015, is the first of its kind litigation, a pioneering endeavor spearheaded by Barrister
Hamidul Mishbah of OLD BAILEY Chambers, Dhaka, who acted as the Lead Counsel for SAMSUNG, wherein a brand
owner moved to a constitutional court invoking its fundamental rights for protection and enforcement of its
trademark rights.
Samsung contended that Samsung’s ownership over the trademark “SAMSUNG” is an exclusive right, which grants
Samsung the sole right to authorize one for commercial use of the “SAMSUNG” trademark including imports,
distribution and trading of SAMSUNG branded mobile phones and electronic goods in Bangladesh. Plenty of
importers and traders are engaged into importing and trading of SAMSUNG branded goods, for which they have no
authorization or license obtained from Samsung.
Samsung further argued that BTRC has a statutory obligation under the telecommunication law to ensure that importers of
mobile phones obtain prior permission from BTRC for importing mobile phones, and the Customs Authority has an obligation
under the Customs Act to ensure that any importer of branded goods submits a certificate (license) obtained from the brand
owner, i.e. SAMSUNG, for importing such goods. Both the statutory bodies were falling short of performing their duty and enforce
the laws against the unauthorized and grey importers and traders. As a result, Samsung became aggrieved.
In this Judicial Review sought by SAMSUNG, the High Court Division has delved the issues of exclusive rights stemms from the
registration of a trademark, the legal position of the doctrine of exhaustion of intellectual property rights in Bangladesh, and the
legality of the inaction of the statutory bodies that have statutory duty to perform and enforce the laws against the parallel
importers and unauthorized traders.
BTRC being the licensing authority, Customs being the gate keeper, and RAB and Police being the law enforcement agencies
having the power to prohibit, disallow and stop any unlawful activities at and beyond the border, respectively, are entrusted with
the statutory duty to stop any unlawful act, which they ought to perform but have been failing.
The High Court, however, observed Samsung’s statutory rights conferred under the Trademarks Act, which is an exclusive right,
and such right inherently enshrines from the fundamental rights such as right to property, right to conduct lawful trade or
business and right to protection of law. Statutory bodies are obliged to protect, promote and ensure the enjoyment of
fundamental rights by any individual or entity. Fundamental rights are owed by the state to the people within the territory, and
the statutory bodies shall act in accordance to the law so that such rights are not infringed.
Article 102 of the Constitution of Bangladesh empowers the High Court Division to order any government authority to do which
such government authority is required by the law to do. The High Court therefore declared the inaction and failure of the relevant
government authorities, i.e. BTRC, Customs, RAB, and Police, as unlawful since they had failed to perform their statutory duties.
The High Court also passed a continuous mandamus order by directing such government bodies to perform their statutory
functions to ensure that the rights and obligations conferred by the relevant statutes are enforced that are intended to give
protection to the trademark owner’s, i.e. SAMSUNG, intellectual property rights. The Rule passed in 2015 was therefore made
Absolute.
This decision is now incumbent upon the government bodies, i.e. BTRC, Customs, RAB, and Police, to perform their statutory
duties by restraining the imports, distribution and trading of unauthorized SAMSUNG branded mobile phones and electronic
goods within Bangladesh. This shall ensure that import, distribution and selling of counterfeit or unauthorized SAMSUNG
branded goods are stopped prohibited at the border as well as throughout Bangladesh.
This emerges as a trailblazing judgment and precedent that mandates for stopping of parallel imports and trading of branded
goods. The principle enumerated from this judgment shall act as a reminder to the government bodies. International brands
doing business in Bangladesh, that experience similar challenges like Samsung, can now resort to this doctrine of precedent
established by the SAMSUNG case. The decision passed in the SAMSUNG case also bolsters Bangladesh’s commitment towards
protection of intellectual property rights of brand owners and foreign investors doing business in Bangladesh.

NO PRIVILEGE FOR
PATENT AGENTS AND CLIENTS

Clients rightly expect communications with their legal advisers to be protected by attorney-client privilege. While privilege is
available to lawyers and their clients in India, it does not extend to patent agents, even though their roles overlap in many
respects.
Patent law is practised by two sets of professionals, advocates or lawyers, and patent agents. The former are governed by the
Advocates Act, 1961 and can appear before the courts and the Indian Patent Office. The latter, trained in science, engineering or
technology, fall under the Indian Patents Act, 1970 and can appear before the Controller of Patents, prepare documents, transact
business and discharge functions in connection with patent proceedings. Patent agents, however, cannot appear before courts
unless accompanied by a lawyer.
The basis of privilege is found in sections 126 to 129 of the Indian Evidence Act, 1872, which protect professional communications
between lawyers and clients. Lawyers’ clerks and employees are included. Section 128 allows a client to waive privilege and
section 129 protects clients from being compelled to disclose legal professional communications. Exceptions to privilege include
communications in connection with an illegal purpose or crime, and those involving in-house counsel. In India, a lawyer who is a
full-time salaried employee cannot register as an advocate, and thus cannot practise before the courts. Patent agents are similarly
excluded from enjoying privilege in their communications with clients. While patent agents are bound by general principles of
confidentiality, the absence of privilege protection means that information they receive may have to be disclosed in court
proceedings.
A lack of privilege for patent agents has not gone unnoticed. The Law Commission has twice raised this in its 69th report in 1977
and in its 185th set of recommendations in 2003. The body suggested amending the law of evidence. However, Law Commission
reports are non-binding, although they can influence parliamentary debates.
Clients may ask how they can remain protected when dealing with patent agents. Pending legislative changes, prospective
patent applicants should ensure that they deal only with patent agents who are also lawyers. Many patent agents hold dual
qualifications and almost all patent law firms in India are owned or managed by lawyers. Communications with such patent
agents would thus be automatically protected by attorney-client privilege. Such dual-qualified professionals employ patent
agents and typically have contracts in place to protect confidentiality. As communications to patent agents are usually directed
to the lawyer heading the practice, or lawyers are copied in, such communications would likely be privileged. This admittedly
creates an imbalance in favour of dual-qualified professionals, but for now, the best solution is to engage only those in that
category.
Patent agents, however, also have access to sensitive information, such as patent portfolios, business objectives and strategic
plans. The lack of privilege can hamper the free flow of information between inventors and patent advisers and, by extension
compromise patent quality and the whole patent system.
Extending privilege to patent agents would benefit the innovation ecosystem as a whole. As the basis of privilege is public
interest, the Law Commission is clear that it is in the public interest to extend privilege to patent agents.
Even if privilege were so extended, one concern would remain. Patent applicants are not obliged to disclose to the patent office
all prior art known to them. Where a specification is amended after publication of the patent application and the original
specification was not drafted in good faith, the court shall not grant any claimed damages or profits. However, a bad faith defence
only becomes available if a defendant can find evidence of it in discovery proceedings.
This vacuum could perhaps be filled by a legislative amendment to impose a duty of disclosure of all known prior art. The
distinction between prior art and professional advice on it means that privilege need only extend to the advice and not to the art
itself.
The present law, however, is clear that patent agents do not enjoy privilege. Clients should be aware of the extent of their rights,
or lack thereof, and proceed accordingly.
