RESOLUTION ADOPTING THE INTERNAL RULES OF PROCEDURE OF THE
SANGGUNIANG BARANGAY OF BARANGAY ______________, NAGTIPUNAN,
QUIRINO.
WHEREAS, the Sangguniang Barangay of Barangay _________________, the
legislative body duly organized pursuant to law with functions, duties and
responsibilities as mandated in Section 391of Republic Act 7160, otherwise
known as the Local Government Code of 1991;
WHEREAS, pursuant to Section 50, Chapter 3, Book I of the said Code
which states that,”On the first regular session following the election of its
members and within ninety(90) days thereafter, the sangguniang concerned shall
adopt or update its existing rules of procedure;”
WHEREAS, to achieve effective and efficient legislation in the Barangay,
there is a need to adopt specific rules of procedure that will guide the concerned
sanggunian, particularly in the deliberation of measures that would affect
barangay operations;
NOW THEREFORE, on motion of Hon. ___________________ duly seconded
by Hon. _______________________; it was,
RESOLVED, as it is hereby resolved, to adopt the Internal Rules of
Procedure of the Sangguniang Barangay of __________________, Nagtipunan,
Quirino.
RULE I
SANGGUNIANG BARANGAY
SECTION 1. Composition. The Sangguniang Barangay shall be composed
of the Punong Barangay as Presiding Officer, and the seven ( 7 ) regular
Sangguniang Barangay Members elected at large and Sangguniang Kabataan
Chairman, as members.
SECTION 2. Powers, Duties and Functions. The Sangguniang Barangay
as a legislative body shall have the powers, duties and functions as provided in
Section 391 of the Local Government Code of 1991.
RULE II
PRESIDING OFFICER AND TEMPORARY PRESIDING OFFICER
SECTION 1. The Presiding Officer. The Punong Barangay shall be the
Presiding Officer of the Sangguniang Barangay and as such he shall vote only to
break a tie.
SECTION 2. Powers, Rights and Duties. The Presiding Officer shall
have the following powers, rights and duties:
a. To preside over the sessions of the Sanggunian;
b. To exact from all the members present during the sessions proper
deportment and decorum;
c. To enforce the internal rules of procedure of the Sanggunian;
d. To maintain order during sessions and render a ruling on question of
order, subject to appeal by the member concerned to the body for final
decision;
e. To sign all the legislative documents, papers, or checks requiring his
signature;
f. To declare a recess during sessions anytime he deems it necessary,
provided that the duration of the recess is less than fifteen (15)
minutes;
g. To declare the session adjourned to some other date, time and place in
cases of extreme emergencies, serious uncontrollable disorder, public
disturbances and other unavoidable circumstances;
h. The regular Presiding Officer shall not be a chairman of any standing
committee, but may observe committee deliberation and be permitted
to make brief remarks on matters pertaining on pending debatable
questions without expressing himself for or against the said question ;
and,
i. Exercise and perform such other powers and functions as may be so
provided by law, ordinance or regulations.
SECTION 3. Temporary Presiding Officer. In the event of the inability
of the regular Presiding Officer to preside at a Sanggunian session, the members
present and constituting a quorum shall elect from among themselves a
Temporary Presiding Officer. He shall certify within ten (10) days from the
passage of ordinances enacted and resolutions adopted by the Sanggunian in the
session over which he temporarily presided.
RULE III
SECRETARY
SECTION 1. The Barangay Secretary shall also be the Secretary of the
Sangguniang Barangay and shall perform the duties and functions provided in
Section 394 of the Local Government Code of 1991.
SECTION 2. No person shall be appointed Barangay Secretary if he is a
Sangguniang Barangay Member, a government employee, or a relative of the
Punong Barangay within the fourth civil degree of consanguinity or affinity.
RULE IV
SESSIONS OF THE SANGGUNIANG BARANGAY
SECTION 1. Regular Sessions. The regular session of this Sanggunian
shall be twice a month to be held at the Sanggunian Session Hall every 1st and 3rd
Sunday of the month at exactly 2:00 in the afternoon.
SECTION 2. Special Sessions. Special sessions may be called by the
Punong Barangay or by a majority of the members of the Sanggunian.
SECTION 3. Notice of Special Session. A written notice to the
Sanggunian members stating the date, time and purpose of the session shall be
served personally or left with a member of his household at his usual place of
residence at least twenty four (24) hours before the special session is held.
Unless otherwise agreed upon by two-thirds (2/3) vote of the members
present, there being a quorum, no other matter may be considered at a special
session, except those stated in the notice.
SECTION 4. Open to the Public. All Sanggunian sessions shall be open
to the public unless a closed-door session is ordered by an affirmative vote of a
majority of the members present, there being a quorum, in the public interest or
for reasons of security, decency, or morality.
SECTION 5. Limitation. No two (2) sessions, whether regular or special,
may be held in a single day.
SECTION 6. Attendance to Session. Every member shall attend all the
sessions of this Sangguian, unless he is prevented from doing so by reason of
sickness or other unavoidable circumstances provided that, as a general rule,
previous notice thereto shall be sent to the Sanggunian thru the Presiding Officer
or the Secretary.
SECTION 7. No Abstentions. As a general rule, every member is
required to vote on every question or proposed measure being voted upon by the
Sanggunian. Abstentions may only be allowed if it can be shown that the member
concerned has a pecuniary interest, either directly or indirectly, on the matter
being acted upon by the body.
SECTION 8. Decorum. Every member shall observe proper deportment
and decorum during session.
SECTION 9. Attire. Every member shall observe proper attire - uniform
with shoes or sandals during session.
RULE V
QUORUM
SECTION 1. Quorum. A majority of all the members of the Sanggunian
who have been elected and qualified shall constitute a quorum to transact official
business. Should a question of quorum be raised during a session, the Presiding
Officer shall immediately proceed to call the roll of the members and thereafter
announce the results.
SECTION 2. Absence of Quorum. Where there is no quorum, the
presiding officer may declare a recess until such time as a quorum is constituted,
or a majority
of the members present may adjourn from day to day and may compel the
immediate attendance of any member absent without justifiable cause. If still
there is no quorum upon proper action, no business shall be transacted. The
Presiding Officer, upon proper motion duly approved by the members present
shall then declare the session adjourned for lack of quorum.
SECTION 3. Calling the Session to Order. When the appointed time
has come to start the session, the Presiding Officer, regular or temporary as the
case may be, shall call the session to order with or without a quorum.
RULE VI
DECORUM
SECTION 1. Decorum. Decorum - refers to the proprietary of conduct and
decency of conduct of words or speech of members in a deliberative body.

e. Coursing remarks and question to the Chair
f. Speaking against motion is not allowed

RULE VII
ORDER OF BUSINESS
SECTION 1. Order of Business. The Order of Business of this
Sanggunian shall be as follows:
a. Call to Order
b. Roll Call
c. Reading and consideration of the minutes of the previous session
d. Reading and Appropriate Action on Communications Received
e. Committee Report
f. Calendar of Business
i. Unfinished Business
ii. Business for the Day
* Sponsorship and action on proposed resolutions
* Sponsorship and action on proposed ordinances
ii. Unassigned Business
g. Announcements (if any)
h. Adjournment
SECTION 2. Calendar of Business. The Calendar of Business shall be
prepared by the Secretary in coordination with the Punong Barangay and other
concerned Sanggunian members. A copy thereof shall be furnished to every
member of this Sanggunian not less than one (1) day before the date of the
regular session.
The Calendar of Business shall contain the following:
a. Unfinished Business - refers to proposals or measures that have
been left unacted upon, postponed or left unfinished during the
previous meeting or session.
b. Business for the Day - refers to a list of items that have been
reported out by committees and are ready for sponsorship and
deliberation on the floor. Specifically, these items are the proposed
resolutions and ordinances ready for sponsorship by the committees
concerned.
c. Unassigned Business - refers to pending matters or measures
including new ones arising out during the deliberation, or those
administration measures coming from the chief executive but not yet
assigned or referred to any committee for appropriate action.
The calendar of Business shall contain brief description of the item of
business to be taken up during the regular session including, but not limited to
the following:
The title of the proposed ordinance or resolution;
name of the sponsor or authors; and
the committee to which it was referred or the committee sponsoring
it.
SECTION 3. Committee Reports. In rendering committee reports,
priority shall be given to regular committees to be followed by special
committees.
As a general rule, committee reports shall be rendered by its Chairman,
unless he dissents with the majority decision. In his absence, any committee
member concurring with the report and duly designated by the said committee
shall render the report.
No member of a committee shall oppose or object to the report of his
committee, unless he submits his dissenting opinion to the majority decision in
writing or orally in open session before the said committee renders its reports.
Otherwise, he shall be precluded to oppose it on the floor.
SECTION 4. Deviations. Deviations from the prescribed Order of
Business may be done only under the following circumstances:
a. When the Sanggunian decided to suspend the rules thru an “assumed
motion” by the Chair or thru a motion to suspend the rules by a
member. In any case, the decision to suspend the rules shall require a
vote by general consent or a unanimous vote, or at least a two-thirds
(2/3) vote of the members present.
b. When the measure to be acted upon by the Sanggunian is certified by
the Local Chief Executive as “urgent” which shall have priority over all
other items of business and shall be considered without need of
suspending the rules or even if it is not included in the calendar of
business.
RULE VIII
LEGISLATIVE PROCESS
SECTION 1. Ordinances and Resolutions distinguished.
Legislative actions of general and permanent character shall be enacted in the
form of ordinances, while, those which are of temporary character shall be
passed in the form of resolutions.
SECTION 2. Essential Parts of Ordinances and Resolutions.
Proposed ordinances and resolutions shall be in writing and shall contain an
assigned number, a title or option, an enacting or ordaining clause, and the date
of its proposed effectivity. It shall be signed by the author or authors and be
submitted to the Barangay Secretary who shall report the same to the
Sanggunian at its next session.
SECTION 3. First Reading. The first reading of the proposed
ordinance or resolution shall only be by title and thereafter, the same shall be
referred to the appropriate committee.
SECTION 4. Second Reading and Debate. On second reading, the
proposed ordinance or resolution shall be in full text with the amendments if any,
as proposed by the committee, unless copies thereof have been distributed
earlier, such reading shall be dispensed with.
SECTION 5. Debate and Closure of Members. In the discussion of any
measures, a motion to close the debate shall be in order after two(2) speeches
for and against, or after only one(1) speech for has been delivered and none
entered against it.
SECTION 6. Five (5)-Minute Rule. The five (5)-minute rule shall apply in
the consideration of an amendment or substitution.
SECTION 7. Approval of Measure on the Second Reading. The
Secretary shall prepare copies of the proposed ordinance or resolution in the
form it was passed on
second reading and shall distribute to the Sangguniang Barangay Members a
copy thereof.
SECTION 8. Third Reading. A proposed ordinance or resolution
approved on the second reading shall be included in the calendar business for
third reading. No ordinance shall be approved unless it has passed the three-
reading principle and copies thereof in its final form had been distributed to the
members at least three (3) days before its passage.
SECTION 9. Approval of the Resolution. A resolution shall be adopted
in the same manner prescribed for ordinances, except that it need not go
through a separate third reading for its final consideration.
SECTION 10. Majority Requirement. No resolution adopted by the
Sangguniang Barangay shall be considered valid unless approved by a majority
of the members present thereby constituting a quorum. Ordinances enacted by
the
Sangguniang Barangay shall upon approval by the majority of all its members, be
signed by the Punong Barangay. (Section 54-c, RA 7160).
SECTION 11. Special Provisions on Budget Ordinances. The
Sanggunian shall in no case increase the appropriations of any project of the
barangay over the amount submitted by the Punong Barangay in the budget
proposal.
SECTION 12. Review of Barangay Ordinances by the Sangguniang
Bayan. Within ten (10) days after its enactment, the Sangguniang Barangay
shall furnish copies of all barangay ordinances to the Sangguniang Bayan for
review as to whether the ordinance is consistent with law and municipal
ordinances.
SECTION 13. Enforcement of Disapproved Measures. Any attempt to
enforce or execute any ordinance or resolution after the disapproval thereof,
shall be sufficient ground for the suspension or dismissal of the official or
employee concerned.
SECTION 14. Effectivity of the Enactment. Unless otherwise stated in
the ordinance or resolution, the same shall take effect after the lapse of ten (10)
days from the date a copy thereof is posted in a bulletin board at the entrance of
the Barangay Hall, and at least two (2) other conspicuous places in the barangay.
SECTION 15. Manner of Addressing the Chair. When a member
desires to speak, he shall address the chair as “Mr. Chairman” or “Mr. Presiding
Officer.”
SECTION 16. Recognition of Member to Speak. When two or more
members address the chair at the same time, the Presiding Officer shall
determine and recognize the member who will speak first.
SECTION 17. Time Limit for Speeches. No member shall speak for
more than five (5) minutes on a particular issue or question being debated upon
unless he is allowed to do so by a majority of the members present.
SECTION 18. Break Time. There shall be a break of not more than ten
(10) minutes.
RULE IX
STANDING COMMITTEES
SECTION 1. Composition. Every regular committee to be created shall
be composed of not more than three (3) members including the chairman.
SECTION 2. Restrictions. The Presiding officer shall not be a member of
any regular committee.
SECTION 3. Special Committees. The Sanggunian may organize
Special Committees as it may be deemed necessary. The Sangguniang Barangay
Chairman shall appoint the officers and members of the said committee.
SECTION 4. Vacancy. Vacancy in a committee shall be filled:
1. By the majority vote of all the members of the Sanggunian or,
2. By the Presiding Officer, upon authorization of a majority of the
members present, there being a quorum.
SECTION 5. Committee Meetings/Hearings. The committee shall
determine the schedule of their meetings/hearings. A majority of all the members
of the committee shall constitute a quorum. Committee meetings/hearings shall
be held only in a public building, to be supported by committee minutes.
SECTION 6. Committee Report and Orders. Committee reports and/or
Orders on ordinances and resolutions shall be considered in formal meetings, but
shall not be submitted to the Sanggunian unless accompanied by the minutes of
the meeting or hearing of the committee which adopted such. Draft resolutions
and ordinances should be attached to the committee reports.
SECTION 7. Standing Committees. The following mandatory Standing
Committees are hereby created:
a. Committee on Finance, Budget and Appropriations - All matters
related to appropriation of funds for the payment of obligations,
taxation ordinances, monetary and fiscal matters.

RULES X
DISCIPLINARY ACTION
SECTION 1. Penalty . Any member who commits an act in transgression
of the foregoing Internal Rules of Procedure shall be punished with the
corresponding penalties hereunder prescribed, to wit:

RULE XI
SUSPENSION OF RULES
SECTION 1. Except those prescribed by existing laws, any part of this
Internal Rules of Procedure may be suspended at any particular session by
general consent or by a two-third (2/3) vote of the members present therein.
RULE XII
AMENDMENT AND EFFECTIVITY
SECTION 1. Amendment. This Internal Rules of Procedure may be
amended at any regular session by two-thirds (2/3) vote of all the members of
this Sanggunian, provided that prior notice of such proposed amendment is given
to all the members and provided further that no provision herein which is based
on, or prescribed by existing laws shall be amended.
SECTION 2. Effectivity. This Internal Rules of Procedure shall take effect
on the date of its adoption.
