AFFIDAVIT OF COMPLAINT
I, the UNDERSIGNED, in my capacity as the Chief of Legazpi City Police
Station, hereby institute this Affidavit of Complaint against Antonio Nap, 35
years old (DOB: [Date of Birth]), male, resident of Barangay San Lorenzo,
Tabaco City, Albay, for the crime of Homicide committed as follows, to wit:
That on February 2, 2025, at approximately 8:00 p.m., personnel of Lgeazpi
City Police Station responded to a report of a stabbing incident at
Kapuntukan Restobar, Barangay Puro, Legazpi City, Albay. Upon arrival,
responding officers found that the victim, Andres Igay, 28 years old, male, a
resident of Barangay San Isidro, Legazpi City, Albay, had been repeatedly
stabbed in different parts of his body using an ice pick, allegedly by the
suspect, Antonio Nap.
That based on the investigation conducted, eyewitnesses positively identified
Antonio Nap as the perpetrator. They stated that the suspect and the victim
were engaged in a drinking session at the said establishment when a heated
argument ensued, escalating into a violent altercation. Witnesses further
recounted that the suspect grabbed an ice pick from the table and
repeatedly stabbed the victim, causing profuse bleeding and leading to his
immediate collapse at the scene.
That after committing the crime, the suspect fled the establishment, evading
immediate apprehension. Meanwhile, the victim’s companions and
concerned customers rushed Andres Igay to Bicol Regional Hospital and
Medical Center for medical treatment. However, despite medical
intervention, the victim was pronounced dead due to severe blood loss.
That upon verification of the facts and conduct of a manhunt operation,
personnel of Legazpi City Police Station, successfully apprehended Antonio
Nap at a relative’s house in Barangay Tinago, Legazpi City.
That during the arrest, the police officers properly identified themselves,
informed the suspect of his charges, apprised him of his constitutional rights,
including his right to remain silent and his right to counsel, and ensured
compliance with the Anti-Torture Act.
That the confiscated evidence pertinent to this case includes:
The ice pick used in the commission of the crime, recovered at the
crime scene;
The bloodstained clothing of the suspect and victim, preserved as
evidence;
That, as of this writing, the suspect Antonio Nap and the recovered evidence
are under the custody of Legazpi City Police Station for proper
documentation and disposition in accordance with the law.
That I initiate this Affidavit of Complaint based on the pieces of object
evidence, witness statements, and other documentary evidence gathered as
a result of the investigation conducted by Legazpi City Police Station.
