Domestic violence against women.
➢ Introduction:-
India has 138 crore people living in it. According to the sex ratio of 2020 the total population
of India is 108.18 males per hundred females.
In India domestic violence has become a very common thing. Every 9 out of 10 females face
domestic violence of some manner in their lifetime, and only 2 cases out of 10 get reported.
This is a harsh reality of India. Here gender based discrimination also plays a very
important role and it is because, since childhood a child get treatment according to his/her
gender. If the child is a boy then he will be told to not be a girl, this thing affects the mind of a
child and it makes a child think that a boy is always strong and superior to a girl.
Another important reason behind domestic violence is lack of knowledge regarding rights. In
India women are told to live according to their husbands. They cannot complain against
them as in many cases husbands are only one to earn bread for their families and this binds
a women to tolerate the torture perform against them by their husband.
Let us discuss what are the provisions to get rid of this kind of crime.
❖ Provisions :-
In many cases women face severe torture just because she can't able to hold both office and
household chores.
Domestic violence is a punishable offence.The major provisions that are dealing with the
protection of women against domestic violence are Section 498-A of IPC and 125 of Crpc(
criminal procedure code).
In today's scenario the cases of domestic violence against women are increasing day by
day. To stop it we really have to start teaching about real equality to both the genders.
Otherwise our upcoming generation will be unable to manage their relationships.
In the year of 2006 (Protection of women from domestic violence act) came into
existence.
Now let us discuss what was the need of this Act?
➢ Protection of women from domestic
violence act 2005. :-
On 26 October 2006 The Ministry of women and children development and The Indian
government brought the domestic violence act 2005. This act gave the defination of
domestic violence for the first time in Indian law.
Domestic violence not only means physical abuse of a person but also physical, mental and
economical abuse.
As informed by National Legal Services Authority (NALSA), a total of 3,582 number of cases
of domestic violence between April, 2021 and June, 2021, as against a total of 3,748 number
of cases between April, 2020 and June, 2020, were received," the minister said.
The cause of increasing domestic violence is the mentality of patriarchy and dominance.
In today's scenario the cases of domestic violence against women are increasing day by
day. To stop it we really have to start teaching about real equality to both the genders and
even to respect the opposite gender. Otherwise our upcoming generation will be unable to
manage their relationships.
❖ Effect of domestic violence on children's health :-
Any type of violence affects a child's mind. It completely digests his/her childhood and gives
him/her a pack of depression, fear, low confidence, negativity, bad thoughts, and self doubt.
In simple and short terms it is unexpectedly harmful for a child's life and his upcoming future.
A child learns the behavior, morality, discipline from his elders. And if the elders treat a
women like animals then it corrupts the mind of a child. It make him think that it is OK to
torture women as they are born to keep men happy.
So it is necessary to stop such crimes so our upcoming generation can start respecting their
opposite gender.
➢ Types of Domestic violence :-
As we have already discussed that the D.V. act of 2005 describe domestic violence as not
only physical abuse but mental, emotional and economical abuse too. So there are four
types of abuse covered by Domestic violence act 2005 :-
● Physical abuse :- Physical abuse refers to, when a person use his power to cause
injury to a women. This abuse doesn't apply only on Husband of a women but also to
the relatives of her husband. It includes kicking, punching, slapping, threatening her
by using some weapons, using physical force in sexual situations etc.
● Emotional abuse :- Emotional abuse refers to when a person uses vulger language
for his wife and also blaming her for everything, calling his wife wretched etc. It is not
necessary that every domestic violence must consist violence. It might doesn't hurt
your body but it can make you suffer through depression and other mental disorders.
● Sexual abuse :- When a person tries to perform unnatural sex with his partner
without her consent will be considered as Sexual abuse. This abuse also applies on
the people living in Liv- In relationships. Under this abuse a person uses his force on
his partner to perform sex and also includes hurting her with objects and weapons
during sex.
● Economical Abuse :- Economical abuse refers to, when a person doesn't alow his
wife to take up employment, and not even being provide her proper money to
maintain herself and her children
Hence,these are some abuse which are used to define the term domestic violence under
protection of women against domestic violence act 2005.
➢ Conclusion:-
Domestic violence against women is increasing day by day. Every woman faces it once in
their lifetime. If your partner using some abusive word against you and that thing cause
depression or any mental disorder to you then the thing will be considered under domestic
violence and that women can complain against her partner under Domestic violence act
2005.
Many women faces domestic violence silently without complaining against her partner or his
family because somewhere our judicial system fails in providing immediate justice to the
victim, which causes much financial and dignity loss to the victim.
To stop such crimes we have to improve our judicial system which can provide immediate
justice to the victim. And also we must have to make each and every women aware about
their rights. This can be done through campaigns, rallies and advertisements etc.
