Background 1.0 1d 13 14 Republic Act (RA) No. 9208 or the “Anti-Trafficking in Persons Act of 2003” as amended by RA No. 10364 (Expanded Anti-Trafficking in Persons Act of 2012) and further amended by RA 11862 or the “Expanded Anti-Trafficking in Persons Act of 2022”, provides that the State shall give highest priority to the enactment of measures and development of programs that will promote human dignity, protect the people from any threat of violence and exploitation, eliminate trafficking in persons, and mitigate pressures for involuntary migration and servitude of persons, not only to support trafficked persons but more importantly, to ensure their recovery, rehabilitation and reintegration into the mainstream of society in a manner that is culturally-responsive, gender-and age-appropriate, and disability-inclusive. RA 11930 otherwise known as the “Anti-Online Sexual Abuse or Exploitation of Children (OSAEC) and Anti-Child Sexual Abuse or Exploitation Materials (CSAEM) Act”, provides for the special protections of children from all forms of sexual violence, abuse, and exploitation, especially those committed with the use of information and communications technology (ICT), RA No. 11313 or the Safe Spaces Act mandates the local government units to enforce the provisions of the law under Article I (Gender-Based Streets and Public Spaces Sexual Harassment)! Furthermore, RA No. 9262 also known as the “Anti-Violence Against Women and Their Children (VAWC) Act of 2004, recognizes the need to protect the family and its members, particularly women and children, from violence and threats to their personal safety and security. ‘To monitor the implementation of the RA Nos. 9208 and 9262 and other women/VAW related laws and policies, and to address the problem of trafficking in persons (TIP) and VAWC, the Department of the Interior and Local Government (DILG), Department of Social Welfare and Development (DSWD) and Department of Justice (DOI) issued Joint Memorandum Circular (JMC) No. 2010-1 or the Creation of Local Committees on Anti-Trafficking and Violence Against Women and Their Children (LCAT-VAWC) on October 18, 2010. ““Matino, Mahusay at Maaasahan” Trunkline No: 876-3454 * DILG-PCW Joint Memorandum Circular No. 2020-001 dated December 7, 2020. Guidelines on the Localization of the Safe Spaces Act. 3 1s Further, the DILG issued Memorandum Circular No. 2020-006 which provides for Guidelines in Monitoring the Functionality of LCAT-VAWC and serves as a tool to assess the functionality of LCAT-VAWC. 16 Pursuant to the above and given the changing policy environment, there is a need to provide further guidelines on the operationalization of the LCAT-VAWC especially on their roles and responsibilities. Purpose This Memorandum Circular is being issued to further provide the local government units (LGUs) ‘with guidelines on the operationalization of their LCAT-VAWCs and address policy gaps. Scope/Coverage All Provincial, City and Municipal Governments, DILG Regional and Field Offices, the BARMM Ministry of Local Government and all others concerned. Definitions 4.1. Barangay Violence Against Women (VAW) Desk ~ is a physical facility that addresses VAW and gender-based violence (GBV) cases in a gender-sensitive manner. It serves as a frontline responder to VAW and GBV complaints and requests for assistance and shall be managed by a person designated by the Punong Barangay. 42. Child ~refers to a person below eighteen (18) years of age or those over but are unable to fully take care of themselves or protect themselves from abuse, neglect, cruelty, exploitation or discrimination because of physical, mental, intellectual or sensory disability or condition. 43 Child sexual abuse - refers to any form of communication through any platform or format, or any physical interaction between a child and any person when the child is being used for act or activity inducing sexual stimulation or for the purpose of sexual ratification or in pursuit of desire to have camal knowledge of the child, regardless of the gender of the perpetrator of the victim, or the consent of the victim. 44 Child Sexual Abuse or Exploitation Materials or Child Sexual Abuse Material (CSAEM/CSAM) - refers to any representation, whether offline, or by, through or with the use of ICT, be means if visual, video, audio, written, or any combination thereof, by clectronic, mechanical, digital, optical, magnetic or any other means, of a child engaged or involved in real or simulated sexual activities or depicting acts of sexual abuse or exploitation of a child as a sexual object, 4.5 Gender-Based Sexual Harassment in Streets and Public Spaces (GBSH) ~ is an act committed in streets and public spaces through any unwanted and uninvited sexual actions or remarks against any persons regardless of the motive for committing such action or remarks. 46 Gender-Based Violence (GBV) — refers to harmful acts directed at an individual or a group of individuals based on theit gender. 47 Local Committee against Trafficking and Violence Against Women and thelr Children (LCAT-VAWO) - a local mechanism established at the provincial, city, and municipal levels pursuant (o the Joint Resolution of the Inter-Agency Council Against Trafficking (IACAT) and the Inter-Agency Council on Violence Against Women and Their Children (AC-VAWC) adopted by the IACAT and IACVAWC in June 2006. It serves as the policy and program coordinating and monitoring body of anti- trafficking and violence against women and their children’s efforts at the local level Page 2 of 14 hl OT 48 49 4.10 4a 4.12 Online Sexual Abuse or Exploitation of Children (OSAEC) — refers to the use of information and communication technology (ICT) as a means to abuse and/or exploit children sexually, which includes cases in which offline child abuse and/or exploitation is combined with an online component, This can also include, but is not limited to, the production, dissemination, and possession of Anti-Child Sexual Abuse or Exploitation Materials (CSAEM) Act; online grooming of children for sexual purposes; sexual extortion of children, sharing image-based sexual abuse; commercial sexual exploitation of children; exploitation of children through online prostitution; and live-streaming of sexual abuse, with or without the consent of the victim: Provided, That OSAEC may be used interchangeably with online child sexual exploitation or abuse (OCSEA). Sexttal Exploitation - refers to any means of actual or attempted abuse of a position of vulnerability, differential power, or thrust for sexual purposes or lewd designs, including profiting monetarily, socially, or politically from the sexual exploitation of another, regardless of whether or not consent was given. Trafficking in Persons (TIP) refers to the recruitment, obtaining, hiring, providing, offering, transportation, transfer, maintaining, harboring, or receipt of persons with or without the vietim’s consent or knowledge, within or across national borders by means of threat or use of force, or other forms of coercion, abduction, fraud, deception, abuse of power or of position, taking advantage of the vulnerability of the person, or, the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation which includes at a minimum, the exploitation or the prostitution of others, or the engagement for the production or distribution, or both, of materials that depict child sexual abuse or exploitation, or other services, slavery, servitude, or the removal or sale of organs. The recruitment, transportation, transfer, harboring, adoption, or receipt of a child for the purpose of exploitation or when the adoption is induced by any form of consideration for exploitative purposes, shall also be considered as “trafficking in persons", even if it does not involve any of the means set forth in the preceding paragraph. Victim-Survivor - refers to the victims of TIP, VAWC, GBSH in streets and public spaces, and other forms of gender-based violence. Violence Against Women and Their Children (VAWC) - refers to any act of or a series of acts committed by any person against a woman who is his wife, former wife, of against a woman with whom the person has or had a sexual or dating relationship, or with whom he has a common child, or against her child whether legitimate or illegitimate, within or without the family abode, which result in physical, sexual, psychological harm or suffering, or economic abuse including threats of such acts, battery, assault, coercion, harassment or arbitrary deprivation of liberty. It includes, but not limited to: 4.12.1 Physical violence which refers to acts that include bodily or physical harm; 4.12.2 Sexual violence which refers to an act that is sexual in nature, committed against a woman or her child as described in Section 5 (c) (2) of the Implementing Rules and Regulations (IRR) of RA No. 9262; 4.12.3 Psychological violence which refers to acts or omissions causing or likely to cause mental or emotional suffering to the victim as described in Section 5 (c) (3) of the IRR of RA No. 9262; and 4.12.4 Economic abuse which refers to the acts that make or attempt to make a woman. financially dependent as described in Section 5 (¢) (4) of the IRR of RA No. 9262. Policy Contents and Guidelines SA Creation and Composition of the Local Committee on Anti-Trafficking and Violence Against Women and their Children (LCAT-VAWC) 5.1.1 512 $13 The LCAT-VAWC must be created at the provincial, city, and municipal levels. Thus, all local chief executives shall ensure the creation and functionality of LCAT-VAWC in their jurisdictions according to the guidelines set herein, through the issuance of an Executive Order, within the first 100 days upon assumption of office. The Provincial Committee on Anti-Trafficking and Violence Against Women and their Children (PCAT-VAWC) shall be composed of the following: Chairperson : Provincial Governor Vice-Chairperson: Chairperson of the Committee on Women, Children and Family, Sangguniang Pantalawigan Members a, Provincial Planning and Development Coordinator b. Provincial Social Welfare and Development Officer ¢. Provincial Health Officer 4. Provincial Public Employment and Services Officer ¢. Gender and Development Focal Person £. Public Schools Superintendent, Department of Education (DepEd) g. Field Office Director, Civil Service Commission (csc) 1h. Provincial Prosecutor, Department of Justice (DO) i. Provincial Director, Department of the Interior and Local Government (DILG) j. Provincial Director, Philippine National Police (PNP) k, Provincial Liga ng mga Barangay Chapter President 1, NGO Representative from each sector: © Women; © Children; and © Overseas Filipino Workers The City/Municipal Committee on Anti-Trafficking and Violence Against ‘Women and their Children (C/MCAT-VAWC) shall be composed of the following: Chairperson 2 City/Municipal Mayor Vice-Chairperson: Chairperson of the Committee on Women, Children and Family, Sangguniang Panlungsod/ Bayan Members a. NGO Representative from each sector: © Women; © Children; and ‘© Overseas Filipino Workers 5.1.4 The Provincial/City/Municipal Social Welfare and Development Office shall serve as the Secretariat of the P/C/MCAT-VAWC. 5.2 Functions of the P/C/MCAT-VAWC 5.2.1 Recommend policies or measures to ensure the effective implementation of RA No. 9208 as amended by RA Nos. 10364 and 11862, RA No. 9262, RA No. 11313, RA No. 11930, and other related laws and policies to protect women and children within its jurisdiction; 5.2.2 Recommend ordinance to implement local programs and related interventions on TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces and other forms of gender-based violence; 5.2.3 _ Institute policies and programs to protect women and children who are victims of trafficking, violence, sexual abuse or exploitation, sexual harassment, and other forms of gender-based violence (formulate or recommend local ordinances and resolutions); 5.2.4 communities and families that are vuincrable to TIP for purposes of providing appropriate interventions; 5.2.5 Undertake information, education, and advocacy campaigns against TIP, VAWC, GBSH in streets and public spaces, OSAEC and CSAEM, and other forms of VAW in the community and for the protection, recovery, and reintegration to the community of vietim-survivors; 5.2.6 Monitor and oversee the implementation of the laws; $.2.7 Prepare an Annual Work and Financial Plan (AWFP) to serve as a guide to actions to be undertaken in order to effectively implement the duties and responsibilities of the LGU and attain the objectives of the laws. A copy of the AWEP must be submitted to the R[ACAT-VAWC in the case of provinces, highly-urbanized cities (HUCs,) and Independent Component Cities (ICCs) and to the PCAT-VAWC in case of component cities and municipalities to ‘ensure alignment of the priorities of the province and the region. 5.2.8 Prepare and submit annual accomplishment report on local initiatives, based on the following schedules: 5.2.8.1 Every 15! of November ~ from C/MCAT-VAWC to PCAT-VAWC, through the Provincial Social Welfare and Development Office (PSWDO). 5.2.8.2. Every 30" of November - from PCAT-VAWC and CCAT-VAWC (for HUCs and ICCs) to RIACAT-VA WC, through the Department 2 Prosecution Service Act of 2010 Page 5 of 14 of Social Welfare and Development (DSWD) Field Office, copy fumish the Department of the Interior Local Government (DILG) Regional Office. ‘The coverage of the annual accomplishment report will be from November I of the previous year to October 31 of the current year. 5.2.9 Monitor the creation and functionality of LCAT-VAWC and/or the establishment and functionality of the Barangay VAW Desk within its jurisdiction; 5.2.10 Meet quarterly to discuss, plan, formulate local policies, implement and ‘monitor programs, projects, and activities within the context of LGU; 5.2.11 Designate principal and alternate representatives in meetings to ensure the ‘ownership of policies and activities; $.2.12 Document and monitor cases of TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces, and other forms of GBV within the area of jurisdiction; 5.2.13 Maintain and update database on cases of TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces, and other forms of GBV within the area of jurisdiction; 5.2.14 Ensure the harmonization of data on cases of TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces, and other forms of GBV within the area of jurisdiction; 5.2.15 Conduct mapping of available services in the area for efficient referral of victim-survivors of TIP, VAWC, GBSH in streets and public spaces, OSAEC and CSAEM, and other forms of GBV; and 5.2.16 Perform such other functions necessary to achieve the objectives of the laws and policies related to trafficking in persons, VAWC, and other forms of GBV. Functions of the LCAT-VAWC Secretariat 5.3.1 Coordinate the LCAT-VAWC meetings by preparing and sending out the notice of meetings together with the agenda and other relevant documents to the LCAT-VAWC members and other invited guests, if any. The Secretariat shall also take care of the logistics for the meetings; 5.3.2 Document the LCAT-VAWC meetings by taking note of all the discussions ‘and agreements during the meeting, among others, and thereafter prepare the highlights/minutes of the meetings. The Secretariat shall secure the consent of those present in the meeting before recording activity. The Secretariat shall ensure the highlights/minutes of the meetings are distributed to the members; 5.3.3 Maintain the records and documents of the LCAT-VAWC, particularly the signed resolutions, highlights/minutes of the meetings and other relevant documents; 5.3.4 Monitor and evaluate the implementation of programs, projects and activities of the LCAT-VAWC members in line with the approved annual work and financial plan and/or mandates; and Page 6 of 14 5.3.5 Gather and consolidate reports from the LCAT-VAWC members and submit to the Chairperson and/or to the higher LCAT-VAWC for action and information and reference. Assessment of the LCAT-VAWC Functio. The functionality assessment of LCAT-VAWC shall be conducted to evaluate its performance, determine the issues and gaps, provide recommendations to the LGU to ‘ensure the full functionality of its LCAT-VAWC, and serve as the basis for designing and providing capacity development interventions to its members. Some of the fanctionality indicators of the LCAT-VAWC ate included in the Social Protection and Sensitivity governance area of the Seal of Good Local Govemance (SGLG) of DILG. Thus, the conduct of the said assessment is important to determine and ensure that this mechanism responds to the needs of the vuinerable and marginalized sectors of society. 5.4.1 The functionality of the LCAT-VAWC shall be assessed in the following areas: 5.4.1.1 Organization The LCAT-VAWC shall be created/reconstituted at the provincial, city, and municipal levels every three (3) years, through a local ordinance, executive order, ‘or any similar issuance. The composition of the LCAT-VAWC shall be in accordance with this Memorandum Circular. ‘The members of the LCAT-VAWC must be capacitated on their functions as well as on the various laws that protect women and children ftom TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces, and other forms of GBV. 5.4.1.2 Meetings ‘The LCAT-VAWC shall conduct regular quarterly meetings to discuss, plan, and formulate local policies, and implement and monitor programs, projects, and activities within the context of LGU ordinances and other issuances. ‘The agenda of such meetings shall include, but not limited to, the development and implementation of policies, programs, projects, and activities relative to the promotion and protection of women’s and children’s rights especially those victim-survivors of TIP, VAWC, OSAEC, and CSAEM, GBSH in streets and public spaces, and other forms of gender-based violence. Special meetings may be called to address immediate concerns not discussed in the regular meetings. ‘The meetings conducted shall be supported by Notices of Meetings, Minutes of Meeting, and Attendance Sheets duly signed by the head of the LCAT-VAWC Secretariat, 5.4.1.3 Policies, Plans, and Budget On Policies Policies refer to guidelines, resolutions or recommendations to protect the constituents ftom TIP, VAWC, OSAEC, and CSAEM, Page 7 of 14 GBSH in streets and public spaces, and other forms of gender-based violence; and/or to provide support to victim-survivors. Policies may include, but are not limited to the following: a. Prevention © Conduct of information campsign against TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces, and other forms of gender-based violence; © Establishment of Migrants Advisory and Information Network (MAIN) Desk; © Development of information, education, and campaign materials; © Prevention and suppression/elimination of TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces and other forms of gender-based violence; ‘© Provision of basic social services for the prevention of TIP, VAWC, OSAEC and CSAEM, and GBSH in streets and public spaces and other forms of gender-based violence; and © Strengthening, activation, and mobilization of existing committees, councils, similar organizations, and special bodies to prevent and suppress TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces and other forms of gender-based violence. b. Protection © Monitoring and documentation of cases of TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces and other forms of gender-based violence in the area of Jurisdiction and ensuring the confidentiality of these cases; © Cancellation of license of establishments, which violate RA No. 9208 and its amendatory and expansion laws; and © Provision of protection and support to victim-survivors. c. Recovery/Rehabilitation/Reintegration * Implementation of residential care, child placement, educational assistance, livelihood and skills training and ‘other community-based services that are responsive to the specific needs and problems of the victims-survivors and their families On Plans ‘The LCAT-VAWC must develop an Annual Work end Financial Plan (AWEP) indicating the programs, projects, and activities (PPAs) to address TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces, and other forms of gender-based violence in the locality, and the corresponding budget required to implement them, The AWFP must be approved by the LCAT-VAWC's chairperson. These PPAs may include activities such as, but not limited to, the following: ¢ Maintenance of database on TIP, VAWC, OSABC and CSAEM, GBSH in streets and public spaces and other forms of gender-based violence. Page 8 of 14 ‘© Conduct of information, education, and advocacy campaign against TIP, VAWC, sexual exploitation and other forms of VAW; ‘¢ Implementation of capability programs for all stakeholders on women’s and children’s rights; © Assistance to victim-survivors, including services that respond to their needs, interests, and concerns; © Monitoring and assessment of PPAs on women and children being undertaken by the LGUs; © Creation and establishment of systems on surveillance, investigation, and rescue to ensure effective and efficient coordination; and © Monitoring of aftercare services for vietim-survivors On Budget The approved AWEP shall be included in the Annual Investment Program (AIP) of the LGU to ensure funding for the implementation of the LCAT-VAWC’s PPAs. Funds to support the implementation of the PPAs may be charged against the LGU"s 5% gender and development (GAD) budget, the 20% Development Fund of the LGU as provided for in Section 287 of the Local Government Code of 1991, particularly in the realization of the goals for social development, or the 1% of the Local Council for the Protection of Children (LCPC), especially on PPAs for children. The LGUs are also encouraged to engage with private organizations that provide financial and technical assistance to further support the implementation of the PPAS. 5.4.1.3 Accomplishments ‘The accomplishments of LCAT-VAWC shall include the activities undertaken based on the approved AWEP. The LGUs, thru their LCAT-VAWCs, shall submit their annual accomplishment reports to the higher LCAT-VAWCs or RIACAT- VAWC according to the abovementioned schedule. 5.4.2 The functionality of LCAT-VAWC shall be rated, as follows: ‘Assessment Area. Rating | Organization 10% Meetings 10% Policies, Plans and Budget 30% ‘Accomplishments 50%. L_ Total 100% ‘The functionality indicators per assessment area can be found in Annex A(LCAT-VAWC Functionality Indicators and Rating System), 5.4.3 The functionality level of the LCAT-VAWC shall be described as follows: ‘Functionality Level Rating {[Non-Funetional 20% and below, Low-Functional 3 - 5% “Moderately-Funetional = Highly-Funetional BI - above% Page 9 of 14 5.5 Monitoring the Functionality of LCAT-VAWC 5.5.1 Creation of the Inter-Agency Monitoring Team (IMT) ‘An Inter-Agency Monitoring Team (IMT) must be created at the regional and provincial levels to monitor the creation and assess the functionality of LCAT- VAWC within its jurisdiction. The DILG Regional Offices, as Chairperson at the Regional level, shall organize the RIMT by inviting but not limited to the below-preferred members. 5.5.2 Composition of the Regional IMT Chairperson : _ DILG Regional Office Focal Person Vice-Chairperson : DSWD Regional Office Focal Person Members : DOJ Regional Office Focal Person DOH Regional Office Focal Person PNP Regional Office Focal Person One (1) representative from the sector of women, children, or OF W as a member of the RIACAT-VAWC, if available 5.5.3 Composition of the Provincial IMT ial DILG Office Focal Person Chairperson > Provi Vice-Chairperson: Provincial Social Welfare and Development Office Focal Person Members : Provincial Prosecutor's Office Focal Person Provincial Health Office Focal Person Philippine National Police Provincial Office Focal Person One (1) representative from the sector of women, children, or OFW, as a member of the PCAT-VAWC Duties and Responsibilities of the IMT 5.6.1. The Provincial IMT shall: 5.6.1.1 Assess the City/Monicipal Committee on Anti-Trafficking and Violence Against Women and their Children (C/MCAT-VAWC) based on the documents presented, using the LCAT-VAWC Form 13 56.1.2 Discuss with the concemed city/municipal mayors the outcome of the assessment and provide recommended actions to address the iggues concerning the functionality of the C/MCAT-VAWC; and 5.6.1.3 Consolidate and submit report, using the LCAT-VAWC Form No. 2, to the Regional IMT not later than July 15 of each year. Page 10 of 14 5.7 5.6.2 The Regional IMT shall: 5.62.2 Assess the Provincial/Highly Urbanized _City/Independent Component City Committee on Anti-Trafficking and Violence Against Women and their Children (P/HUC/ICCAT-VAWC) based on the documents presented, using the LCAT-VAWC Form No. 1; 5.5.2.2 Discuss with the concemed provincial governors and city mayors the outcome of the assessment and provide recommended actions to address the issues conceming the functionality of the PIHUCMICC-VAWC; and 5.62.3 Consolidate and submit a report, using the LCAT-VAWC Form No. 4, to DILG Regional Office not later than July 15 of each year. Documents to be Presented by the LCAT-VAWC to the IMT A copy of the following documents shall be presented/submitted to the IMT during the conduct of the functionality assessment of the LCAT- VAWC. a, Ordinance, Executive Order or any similar document creating the LCAT-VAWC; b. Certificate of Attendance/Participation of the LCAT-VAWC members; c. Notice of Meetings with Agenda, Minutes of Meetings, and Attendance Sheets duly signed by the head of the LCAT-VAWC Secretariat; d. Annual Work and Financial Plan (AWFP) approved by the LCAT-VAWC Chairperson; e. Approved Annual Investment Program; f. Post-Activity Report/s on the capacity-building activities conducted by the LCAT- VAWC; @ Post-Activity Report/s on the information, education, and advocacy campaign activities conducted by the LCAT-VAWC; h. Data on cases of TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces, and other forms of gender-based violence, and number of vietim-survivors provided with mandatory services; i. Ordinance appropriating funds for the implementation of PPAs to address TIP, VAWC, OSAEC and CSAEM, GBSH in streets and public spaces, and other forms of gender-based violence in the locality; j. Approved GAD Plan and Budget; k. Children Code; 1. GAD Code; and m. Annual accomplishment report submitted to PCAT-VAWC by C/MCAT-VAWC or RIACAT-VAWC by P/HUC/ICCAT-VAWC, with an: acknowledgment receipt. Page 11 of 14
