NEW IA-1663/2025
This application has been filed seeking the following prayers:
(a) Direct Respondent No. 3 to verify and admit the claims
filed by the Applicant; and
(b) Pass such order(s) as this Hon'ble Tribunal may deem fit
and proper.
Issue notice to the Respondent No. 2/Resolution Professional.

Mr. Harish Taneja, the Resolution Professional appears in


person and accepts notice. One week time granted to file the reply
affidavit to the Resolution Professional.

A copy of the reply affidavit shall be served on Mr. Harish


Taneja, the RP during the course of the day.

This application has been filed seeking the following prayers:

i. Allow the present application;


ii. Condone the delay in filing the Claim Form CA dated
04.10.2024 filed by the Applicant with the Respondent
No.1 (Resolution Professional) vide even dated email;
iii. Pass a direction directing the Respondent No.1 (Resolution
Professional) to admit the claim of the Applicant of Rs.
28,06,818/- filed with him vide Claim Form CA dated
04.10.2024 and thereafter deal with the same in terms of
Para No. 27 of the Order dated 01.06.2022 passed by the
Hon'ble NCLAT in Puneet Kaur Vs. KV Developers Pvt. Ltd.,
[Company Appeal (AT) (Insolvency) No. 390/2022];
iv. Pass such other and further orders as this Hon'ble
Tribunal may deem fit and proper in the interest of justice
and in the facts and circumstances of the present case.
Ld. Counsel for the Applicant submitted that the claim of the
Applicant is born out of the records of the Corporate Debtor. In this
regard, the Ld. counsel referred to the statement of the demand of
the Corporate Debtor which shows the amount dues to the present
Applicant. Ld. Counsel appearing for the Applicant further
submitted that the present case is squirrely covered by the
judgment of the Hon'ble NCLAT in the case of the "Puneet Kaur Vs.
KV Developers Pvt. Ltd.".
Mr. Harish Taneja, the Resolution Professional appearing in
person has submitted that there is no dispute with respect to the
records of the Corporate Debtor in as much as details of the
Applicant are clearly born out of the records of the Corporate
Debtor. He further submitted that in case the delay is condoned by
this Adjudicating Authority, the Resolution Professional will
consider the claim of the Applicant in accordance with the
treatment provided in the resolution plan and the law laid down in
the judgment passed by the Hon'ble NCLAT in the case of "Puneet
Kaur Vs. KV Developers Pvt. Ltd.

Having regard to the submissions made by the Resolution


Professional and in order to meet the ends of justice, we condone
the delay in filing the claim of the Applicant and direct the
Resolution Professional to consider the claim of the Applicant in
accordance with the treatment given in the resolution plan and the
law laid down in the judgment passed by the Hon'ble NCLAT in the
case of "Puneet Kaur Vs. KV Developers Pvt. Ltd.

This application has been filed seeking the following prayers:-

i) Direct the Resolution Professional to treat all the


buyers of Flats in the Bharat City Phase-2 as
Financial Creditors and to give them due
representation in the Committee of Creditors;
ii) Direct the Resolution Professional to grant a fresh
opportunity to all the Home Buyers to file their
claim;
iii) Direct the Resolution Professional to restrain from
taking unilateral decisions without even consulting
the Home Buyers/Registered Society (present
applicants);
iv) Direct the Resolution Professional to consider the
claim of the Applicant Society on the basis of the
pleadings before the Hon'ble NCDRC in the
Consumer Complaint No. 495/2023;
v) Direct the Resolution Professional to take steps for
completion of the ongoing work on. amenities for
the residents of Bharat City Phase-2 as well as
basic minimum facilities essential for 800
inhabitant families including essential electrical
infrastructure (Panel & Transformer), Covered &
Open Parking, Boundary Wall, Sewage Treatment
Plant etc;
vi) Direct the Resolution Professional to take steps for
completion of the construction of H4 tower where
only finishing work remains;
vii) Direct the Resolution Professional to take steps for
completion of construction of rest of the unfinished
towers of Bharat City Phase-2;
viii) Pass any such order or further orders as this
Hon'ble Adjudicating Authority may deem fit and
proper in the facts and circumstances of the
present case.
We have heard the submissions of Ld. Counsel appearing on
behalf of the Applicant as well as Mr. Harish Taneja, the Resolution
Professional appearing in person.

This application has been filed seeking a direction to the
Respondent-HDFC Bank to change the authorized signatory and
add the beneficiary details of the Applicant i.e. the Resolution

HDFC Bank fairly submits that the bank has no objections to the
prayers made by the Applicant and the bank is willing to change
the name of the authorized signatory, if a direction is given.

In view of the statement made by the Ld. Counsel appearing


on behalf of the HDFC Bank, we grant liberty to the Resolution
Professional to approach the bank for necessary changes in
accordance with the provisions of the Insolvency and Bankruptcy
Code, 2016.
