AFFIDAVIT

I, Atty. WINNIE M . EDAD , a resident of 18 Gertrudes, FEU Village


, Antipolo, under oath , so hereby state:

1. I personally know Marilou Mendez, aka Marilou Ocsan (Malou), a


longtime resident of San Andres, Manila;

2. Sometime in January, 2025 Malou asked if I could loan Php


300,000.00 to LEONILDA CRUZ, FELEXUS CRUZ, LEO FELIX
CRUZ and MA. LETICIA DE VERA (LEONILDA et. al) who are
siblings and her neighbors ;

3. According to Malou , LEONILDA et al will put up as collateral a


parcel of lot covered by TCT No. 279206(see Annex “A”,
Complaint Affidavit) titled in the name of their late parents ;

4. After some thoughts, I agreed and so on January 10, 2025 I met


Malou and LEONILDA et al and gave to the latter the Php
300,000.00 and in turn I was given the TCT;

5. No formal contract was yet signed as during that time there was
yet discussions of how much and how often LEONILDA et al
would pay for the loan ;

6. Subsequently, (thru txts, see Annex”C”, ibid) I asked Malou if


LEONILDA et. al really needed Php300,000.00 and she replied
yes ;

7. However , much to my dismay, I learned later on that LEONILDA


et al had actually decided that they need only Php 150,000.00
and in fact gave same to Malou to return to me the said cash;

8. I was thinking that I should formally demand from Malou to give


me the money but it would be futile because:

a. She had already misled me into thinking that the loan was
still for Php 300,000.00.

b. Clearly she had already appropriated the Php 150,000.00


for herself and had no intention to give the money to me.
c. She clearly abused the trust reposed upon her by
LEONILDA at all (and myself for that matter) and whatever
she does to make reimbursement later on would not
change the fact that she had already committed (estafa
thru) unfaithfulness and abuse of confidence as
contemplated by our penal laws .

FURTHER, affiant sayeth naught.
