Both Parties Agreed the Followings:-
The Second Party Agreed to work for the First Party as (DATA ENTRY OPERATOR)
in LUXEMBOURG.
DURATION of CONTRACT
This contract is for 02 Year’s period from the date of second party
joined the Hotel. This contract will be subject to termination according to any
of the parties will without assigning any reason provided that the party
desiring to exercise such right shall notify the other party not less than one
month before termination.
On joining the Hotel, you shall be on probation for a period of two
months from the date of joining as per the law of country. Your performance will
be reviewed during the probationary period and your confirmation will be
considered. Your services will not be deemed to be confirmed unless specifically
confirmed in writing.
During the probation period/after confirmation of your appointment at
the end of your period of probation, the company will be entitled to terminate
your services by giving termination letter with 3day notice in writing, or by
payment of salary in lieu of such notice. In the event you desire to leave the
services
of the Hotel, you will be required to give the Hotel One month’s notice in
writing or completion of the assigned task whichever is later.
The second party will have to pay all his debts to the first party and
other before he finally leaves the work.
SALARY
The basic salary of the second party shall be EURO (1900)
and normal working hours shall not exceed forty eight hours per week. This rule
shall be applicable on those working at senior position.
Second Party Overtime in accordance with labor law of country/ Hotel
Premises.
FOOD, ACCOMMODATION & TRANSPORTATION
The second party shall have free food provided by the Hotel Premises.
The second party shall be entitled to free accommodation by Hotel
Premises.
Transport by the Hotel Premises from camp to work location and vice
versa.
MEDICAL CARE
The first party shall assist the second party to procure health cards to
avail medical treatment from the hospitals of the country at nominal rates to be
borne by the second party.
The first party shall provide the second party with medical first aid at
the work place of the letter under the provision of Him who is assigned by the
first party.
The first party shall undertake that the second party receives his payable
indemnity for labor accidents, disability or death arising out of service or as a
result of his service.
HOLIDAYS
The second party shall be entitled to a normal level each Year (23 days)
with basic salary.
The second party shall receive full pay in the official holidays.
The second party shall also have two other days of holidays with full pay
during the year. These two days are to be declared by the government or decided
by the employer to all workers.
Under the provision of the country labor law, the second party shall be
entitled to pay sick leave after two months continuous physician approved by the
employer.
END OF SERVICE GRATUITY
The second party is eligible for gratuity at the rate of (23days) of the
basic salary per Year of service with effect from the date of joining and it
will payable at the termination of contract, provided the second Party completed
at last of service with the first party.
GENERAL PROVISIONS
The second party shall undertake to perform his work according to daily
average performance in his occupation. In case he fails to carry out his daily
average performance, he shall be subject to the table of penalties in this
regard.
In the course of contract, the second party shall not have the right to
work for others, and the first party shall not have (he right to hire out the
second party to any other employer).
The second party shall undertake to refrain from interfering in political
or religious affairs and he will have to respect the local customs and
traditions.
The Second party shall at all times keep confidential all information
related to hotel's business, assets, affairs, transactions, documents, methods
of operation, accounts, finance, technical information, computer systems etc.,
And shall not disclose such information to any person or use such information
otherwise than for the purpose of performance of his duties. The second party,
after termination of the contract, shall not work or participate on any similar
work which may compete with the first party.
The country labor law and its executing regulations shall be considered
as the legal basis of the text of this contract. There shall be recourse to the
law in respect of any dispute the two parties unless the terms of this contract
provide better benefits for the second party.
The second party agrees to work, if required, for any of the companies in
or associated with the first party, on the same term and conditions, but not
detrimental to second party.
During the period of employment with the first party, the second party
will not engage himself directly or indirectly in any activity or job or
employment or assignment outside this employment and shall devote his full time
and attention to the interest of the first party.
The second party hereby agrees to comply with all internal rules and
regulations of the first party as revised from time to time, which shall be
considered as integral part of this contract
No amendment or alteration to the terms and conditions of the contract
shall be valid unless mutually agreed in writing and signed, both on behalf of
the first and second party.
This contract is made in English version and issued in four original
copies, one copy to the first party, one copy to the second party, one copy to
the ra’s and the fourth copy to be filed with the Labor & social affairs
department.
This letter is related to the legal process and its rights of the foreign
passenger, which relates to the labor law of the country and validity of this
letter is 15 days, after which the letter will be rescinded by the Hotel.
If for any reason the candidate cancels the letter during the process,
laws can be filed on behalf of India's Labor Department, Hotel and the law of
the country.
This contract cancels any other previous contracts with anyone.

Visa other fees will be provided by the Hotel.
Workmen Compensation Insurance Provided by Hotel its Cost.
Transportation, Complete Air Passage and Indemnity etc provided by Hotel Its
Cost.
WORKER/CANDIDATE Benefits & Note.
Please sign and return the duplicate copy of this appointment letter as a token
of your acceptance.
You will be required to execute confidentiality/Non-disclose agreement for
Company Property Rights (CPR) agreement with the Hotel on your joining.
