Conciliation

Conciliator: Thank you for attending the conciliation meeting today as the conciliator I am here to help
resolve the dispute by the way of conciliation and I am not representing any side.

Conciliation is completely voluntary and all the information gathered during the process is kept
confidential. It is hoped that a settlement is reached between both the parties.

Ms.Tina, what would you like to say to your landlord about the fact that even though you were given a
notice of 90 days you did not vacate the house.

Ms.Tina: Mr.Landlord you already know that the major reason I chose your house was that it is very
near to my children’s school.

As a tenant I have kept your house clean and always paid the rent on time. And I have not violated any
terms of the rental agreement.

All of a sudden you have sent me a termination notice to vacate the premises within 90 days. There was
no reason mentioned in the notice.

How can you do such a thing to me?. That too without any reason behind it.

Conciliator: Mr.Landlord is there anything you would like to add to that. Wouldn’t it be better if you had
mentioned a reason the request of termination in the notice?

is any other reason which cannot be mentioned in the notice. If so you can tell her now since the whole
process is confidential.

Landlord: No sir nothing as such. I do acknowledge whatever Ms.Tina said about her conduct as a tenant
but I have personal reason for which I would need the house. So I thought it is not necessary to mention
that in the notice.

Conciliator: Can we know what that reason is?

Landlord: Sir I have an elder sister who got married 3 years ago and she is expecting a child now. As per
our traditions the first pregnancy will be taken care by her parents. And she needs a separate room for
her privacy.

Since our house is not having an additional room we need the house that Ms.Tina is residing. That is the
reason I sent her a termination notice.

Conciliator: Ok now that we have heard concerns of both the parties it is better to look for an amicable
way to settle this.

Ms.Tina, Mr.Landlord has now given you the reason for terminating your rental agreement. By the way
why didn’t you vacate the house within 90 days? Is it because that there was no reason mentioned in
the notice?
Ms.Tina: No sir I did try to search a house which is suitable for my requirement i.e. it should be near to
my children’s school. But I did not find a suitable one.

Conciliator: Ms.Tina to resolve the dispute do you have any solution or request in mind?

Ms.Tina: I need more time to search for a house which is suitable for my requirement.

Conciliator: Ok how much time do you need?

Ms.Tina: A minimum of 3 months sir.

Landlord: No Ms.Tina it is impossible for me grant you that much time. It will be very difficult for me to
accommodate my sister in my house in her condition. Please understand the problems I am facing.

I request you to vacate the house in the next 20 days.

Ms.Tina: Mr Landlord how can I find a house suitable to my conditions within 20 days. It is not possible.

Landlord: It is not at all possible to grant you 3 months tina

Ms.Tina: Then I don’t think we can nothing more to talk Mr.Landlord.

Conciliator: Both of you calm down. Take it easy. See I have to remind both of you that if this case is not
conciliated it may be taken to court.

But that is up to you. However there are other concerns.

Mr.Landlord you told me your situation and if this thing goes to the court it might take many months
which will only worsen your situation.

Ms.Tina it is going to cost you both time and money.

So I advise the both of you reconsider your options and come to an amicable settlement so that it will be
beneficial to both of you.

Ms.Tina do you really need that many months of time. Can you search it a bit quicker considering the
unavoidable situation Mr.Landlord is in?

Ms.Tina: I will definitely search sir but 20 days is not enough to find a house.

Conciliator: Mr.Landlord can you not give her some more time? Please keep in mind that if you take it to
court it might take a lot of time to vacate her and it will add more trouble to you.

Mr.Landlord: Yes sir but definitely not 3 months.

Conciliator: Given the situation of dreadlock let me suggest a timeline.

Considering your situations I think 45 days is feasible enough for both of you
Is it agreeable?

Mr.Landlord: it will be difficult to wait for that much time sir but considering what you have told I am ok
with granting her 45 more days.

Conciliator: Are you ok with 45 days Ms.Tina. Before saying Yes or No, do consider the time and money
you will be saving by not going to the court.

Ms.Tina: Ok sir I agree to vacate the house in 45 days.

Conciliator: As both of you have agreed to the solution we have arrived at in the conciliation please sign
on the agreement. The agreement signed by both of you is a legally binding document. Both of you
should keep the case and terms of the agreement confidential

Parties shake their hand and leave
