⚖️ ART. 1548, 1549, 1558 & 1559


Eviction, concept
the act/process of legally dispossessing a person of land or rental property

deprivation of the vendee of the whole/part of the thing sold by virtue of final judgment

based on a right prior to the sale or an act imputable (caused) to the vendor

REQUISITES FOR ENFORCEABILITY


1. the purchaser has been deprived of the whole or part of the thing sold

2. the eviction is by final judgment

the vendee need not to appeal from the decision or judgment in order that the vendee
may become liable for eviction

3. deprivation is based on a right prior to the sale or an act imputable to the vendor

4. the vendor must have been notified of the suit for eviction at the insurance of the vendee

the defendant vendee shall ask that the vendor be made co-defendant

within the period fixed in the Rules of Court
