EMPLOYMENT CONTRACT
This Employment Contract is made and entered into this 8th day of August 2024 and between:

Hereafter referred to as the Employer,
-and-
James Cyrus Jumao-As Generale,
With residence, postal and contact address at Purok Kamunggay, Pitalo, San Fernando, Cebu,
Philippines, hereinafter referred to as the Employee.
The Company employs the employee and the employee accepts employment by the company on the
following terms and conditions:
Article 1 - Employee Classification
1. The classification of work for which the employee represents he/she is qualified and for which
he/she is engaged, is that of an AC Technician.
2. It is understood and agreed that although the employee is engaged for the above designated
classification of work, he/she may be used, at the option of the company, on any other type of work
without reduction of pay, however, if the employee is not, in the judgment of the company, qualified
to perform the work falling within the classification stated above, the company has right, which is
hereby reserves and retains, to assign the employee to a classification of work carrying a lower wage
rate.
Article 2 - Working Hours
1. The Employee agrees to work a minimum of forty (40) hours per week, with variations based on
position requirements for the duration of the contract. The Employee agrees to work such hours and
such shifts as may be required by the Employer.

2. The Employee agrees to work beyond the minimum working hours and different shifts as may be
required by the Employer or due to the nature of the position to ensure the timely completion of tasks.
Article 3 - Wage / Salary
1. The Employer shall pay the Employee USD $12.00 per hour. The Employer agrees to pay the
Employee at a rate not less than the current legal minimum wage applicable, in the event such rate
becomes higher than the sum above during the Contract Period. Payroll checks will be issued to the
Employee by Employer every two weeks (bi-weekly).
2. The Employee is responsible for payment of all personal income taxes and employee wage taxes
which may be assessed by the national and/or municipal governments. The Employee is also
responsible to pay the employee’s share of local social security taxes which apply at the site of
employment. There is no reimbursement or allowance paid by the Employer for Employee’s costs of
taxes, social security tax, or health fund tax. Employee Tax deductions from wages, shall be made in
accordance with the law.
Article 4 - Employee Obligations
1. The employee agrees to devote his/her entire time and attention throughout the term of his/her
contact and any extension thereof exclusively, to the service of the company. The employee, during
the term of this contract or any extensions thereof, agrees not to become an employee of, or render
services to any other person or persons, or company other than to the company or party to whom the
company’s rights under this contract may be assigned.
2. The employee agrees to work and live in harmony with his coworkers employed by the company.
The employee agrees to at all times conduct himself/herself in an orderly manner, with due regard to
the comfort and convenience of his coworkers.
3. The employee agrees to diligently perform any task assigned to him/her, even though it is outside
his/her regular trade or classification.
Article 5 - Benefits
1. Transportation to the site of employment, and return to the point of hire, will be provided by the
employer, provided, the employee finishes his/her contract or his discharged without cause.
2. In the event of death, the employer shall be responsible for the transportation of the employee’s
remains, the property, or in the event that this is not possible to make proper disposition after
arrangements with the employee’s next of kin or nearest attaché.
3. The employer shall be financially responsible for emergency medical or dental services that are
direct result of the employees work for the employer. In the event the Employee is not able to work
as a result of any on the job accident, the Employee shall be eligible for any Workman's Compensation
payments in accordance with applicable law. The Employer is not responsible for Employee’s costs of
health care or disability support beyond those benefits paid by the above-mentioned insurance.

4. The employee will be entitled to the following:
a. Ten (10) days’ vacation leave after each year of employment
b. Five (5) days sick leave within a year
Article 6 - Board & Lodging
The Employer shall provide reasonable living quarters at the Employer’s expense and reasonable utilities
costs. These living quarters are strictly single-status (non-family) and may be shared by two or more
employees. The Employee is responsible for his/her own food and normal housekeeping costs. There is
no cash allowance from the Employer for food or lodging costs.
Article 7 - Transportation To and From Job Site
The Employer shall provide transportation for the Employee at workers’ quarters, or other central
meeting place, to and from the place of employment if located beyond reasonable walking distance.
Article 8 - Term of Employment, Termination and Renewal
1. The term of this employment contract is one year affective on arrival at the jobsite, & subject to
approval of the Government that might require an earlier termination.
2. This contract may be terminated by the employer for cause pursuant to Article 9 or without cause at
the discretion of the employer. If terminated without cause, employee shall be given 30 days advance
notice.
3. This contract may be renewed upon mutual agreement of employee and employer.
Article 9 - Termination
1. The commission of any violations of company regulations or of the following offenses will be
sufficient cause for which the employee may be immediately terminated from further service under
this contract.:
a. The willful violation of any law.
b. The possession of any type of firearms, drugs or narcotics, or illegal possession of
Government property or company property.
c. Failure to obtain prior permission from the appropriate officials of the company to be
absent from duties to which he/she is assigned.
d. Gross negligence of duty.
e. Having misrepresented himself/herself in any information provided the Employer
2. Upon termination for any of the foregoing causes, for being absent from the work assigned to
him/her without justifiable cause, he/she shall not be entitled to any further wage or salary and shall
forfeit any and all rights and privileges and will be transported to his/her home of record by the first
available and practical means at the employee’s expense.

3. If the employee in the performance of his/her duties hereunder, should be found by the company
to be careless, insubordinate, or otherwise objectionable, he/she may be immediately discharged by
the company, in which event he/she will be transported back to his/her home of record, via the first
available and practical means of transportation at the expense of the employee. He/she will waive all
rights and claims to payments to him/her by the company of any further wage or salary as of the date
of his/her discharge.
Article 10 - Off-Island Transportation
1. The Employer shall provide round-trip economy-class transportation from the Point of Hire to the
Site of Work. This transportation shall be paid by the Employer at no cost to the Employee if the
Employee completes the initial one-year term of employment or earlier if the Employee is dismissed
without cause.
2. In the event the Employee is terminated with cause, the Employee will be responsible to pay his/her
own airfares for return from the Site of Work to the Employee’s Point of Origin.
Article 11 - Accident or Emergency
1. In the event of accident or emergency, the Employer must notify the Government Labor Department
at the Site of Work, and shall be authorized without further consent of the Employee or liability being
incurred thereby, to do the following:
a) In the event of the Employee’s death during the performance period of the contract, the
Employer will, if the Employee’s next of kin so desire, defray the expense of embalming and
transporting his/her remains to the point of hire.
b) The Employee agrees that in the event of his complete mental or physical incapacity, the
Employer may authorize appropriate medical treatment as may be recommended by qualified
medical authority, before contacting the Employee’s next of kin.
c) The following person is the Employee’s next of kin, and should be notified in the event of an
emergency:

Article 12 - Location
The Employee may be assigned to work at any site or at different job sites as determined by the
employer.

Article 13 - Government Approval
This contract is subject to approval by the Government Labor Department at the site of work. In
addition, an exit visa may be needed by the Employee to depart from his/her point of hire. The date of
travel to the site of work performed there will not begin until necessary Government entry, work, and
exit permits can be obtained to allow transit of the Employee to the site of work.
Article 14 - Certification
1. The employee hereby certifies that he/she has read or has had read and explained to him/her the
foregoing agreement and that he/she fully understands its terms and conditions. That no promises or
understanding have been made other than those stated herein and that this agreement shall be
subject to modification only by written instrument signed by both him/her and the Employer.
