FINAL DEMAND TO PAY
OUTSTANDING OBLIGATIONS
Dear Mr. and Ms. Bautista and Company:
We write in relation to the termination and non-renewal of your lease contract and your
outstanding obligation of SIX HUNDRED FORTY-THREE THOUSAND SEVEN
HUNDRED FIFTY PESOS (₱643,750.00) representing unpaid rent from 20 May 2021
to 05 May 2022, including penalty charges for such periods, from your occupation of our
property located at Lot 19 Block 30, Tropical Avenue, BF International, Las Piñas City
("Leased Property").
A copy of the Statement of Account dated 20 April 2022 is attached herewith and made
integral part hereof.

As you are well aware, you entered into a Contract of Lease dated 28 May 2019 with
BUILDERS 2000, INC over the Leased Property. The Contract stipulates that the lease
period shall commence on 20 May 2019 and will expire on 19 May 2021. The monthly
rent from 20 May 2019 to 19 May 2020, shall be P40,000.00 exclusive of any applicable
taxes; while the monthly rent from 20 May 2020 to 19 May 2021 shall be ₱50,000.00
exclusive of any applicable taxes. In case of default in payment of the rent despite receipt
of written notice, the Contract of Lease provides that the Lessor may terminate the
Contract and eject the lessee, among other remedies stipulated therein.
The Contract of Lease expired on 19 May 2021. You were provided a Renewal of
Contract of Lease, but you did not sign and return the same, yet you remained in
possession of the Subject Property thus an implied tacit renewal on a month-to-month
basis took place.
However, despite demand, you failed to update your account. Despite receiving a
monthly Statement of Accounts from us from May 2021 and repeated demands for
payment, you remained in possession of the Subject Property.
BUILDERS 2000, INC. was thus constrained to send you a Notice of Non-Renewal with
Demand to Vacate Premises and to Pay Outstanding Obligation dated 26 July 2021. You
were given until 19 August 2021 within which to pay your outstanding obligation, and
thereafter vacate the premises. Such demand to pay and vacate, however, was left
unheeded.
On 23 August 2021, BUILDERS 2000, INC. gave you an additional grace period until 26
August 2021 to vacate the premises and pay the outstanding balance. Such demand to pay
and vacate, however, was still left unheeded.
On 08 September 2021, BUILDERS 2000, INC. sent again a Final Demand to Pay and
Vacate by 19 September 2021. Such demand to pay and vacate, however, was still left
unheeded.

On 29 October 2021, you requested an extension to stay until the end of November 2021
with the commitment that you will pay Php250,000.00 on 03 November 2021 to cover
the unpaid obligations. again, such commitment was not complied with.
On 26 March 2022, you again emailed that you will vacate the Leased Property no later
than the second week of April 2022 and will settle all arrears. But up to the date of
writing of this letter, you have still failed to pay and vacate the Leased Premises.
BUILDERS 2000, INC. reiterates that it will no longer renew the lease. There shall no
longer be any tacit or implied renewal. The expiration of your lease, its non-renewal, and
your continued breach warrants your eviction from the Subject Property.
Furthermore, should you continue to possess the property after the five (5)-day deadline
to vacate, we reserve the right to charge a penalty in the form of increased rent in the
amount equivalent to SEVENTY-FIVE THOUSAND PESOS (₱75,000.00) per month
starting on the date of the expiration of five (5)-day deadline to vacate, until you have
peacefully turned over the possession of the Subject Property.
Thus, demand is hereby made upon you and to all other occupants of the Subject Property
deriving right from you to jointly and solidarily:
a. PAY your outstanding obligation in the amount of SIX HUNDRED FORTY-
THREE THOUSAND SEVEN HUNDRED FIFTY PESOS (P643,750.00)
representing your unpaid rental obligations from 20 May 2021, up to the date of
this writing, plus legal interest from the time of first extrajudicial demand until the
same is fully paid;
b. PAY the amount equivalent to 15% of the amount claimed pursuant to Section
18 of the Contract of Lease which is Ninety-Six Thousand Five Hundred Sixty-

Two Pesos & 50/100 (Php96,562.50) based on the outstanding obligation as of to
date;
c. VACATE the Subject Premises by virtue of the termination of the Lease
Contract and Non-Renewal of the same by 05 May 2022; and
d. PAY increased rental of Seventy-Five Thousand Pesos (Php75,000.00) a month
should you fail to surrender the Leased Property after 05 May 2022.
Otherwise, should you fail to heed any of the above demands, we shall be constrained to
refer the matter to our legal counsel and institute the appropriate legal actions against you
and all other occupants of the premises with additional claims for damages, attorney's
fees and other expenses of litigation to protect our interest.
We trust that you will give this matter your immediate and preferential attention.
