PLAINT
1. THAT the Plaintiff is a male adult Ugandan of sound mind whose address of
service for the purpose of this suit shall be c/o M/s E3 & Co. Advocates P.O.BOX
1989 Ntinda, Kampala.
2. THAT the first Defendant is a male adult Ugandan presumed to be of sound
mind, who fraudulently obtained letters of administration to the estate of the late
Yoana Maria Nsimbi vide Administration cause No. 009 of 2024 In the High Court
of Uganda at Masaka and the Plaintiff’s Advocates undertake to effect service of
court process on him.
3. THAT the second Defendant is a male adult Ugandan presumed to be of sound
mind, the purported registered proprietor of the land comprised in Busiro Block
336 plot 445 and the Plaintiff’s Advocates undertake to effect service of court
process on him.
4. THAT the Plaintiff’s claim against the 1st Defendant is for:
a) AN ORDER FOR REVOCATION of letters of administration issued to the 1st
Defendant in respect to the estate of the late Yoana Maria Nsimbi due to
having been obtained fraudulently, through making false suggestions and
concealing material facts.
b) A DECLARATION that the 1st Defendant mismanaged the estate of the late
YOANA MARIA NSIMBI.
c) AN ORDER compelling the 1st Defendant to account for and surrender all
monetary benefits he has derived from the estate of the deceased.
d) AN ORDER granting letters of Administration of the estate of the late YOANA
MARIA NSIMBI to the plaintiff.
e) AN ORDER directing the 1st Defendant to surrender all the property that
belonged to the late YOANA MARIA NSIMBI that is currently registered in his
name.
f) A DECLARATION that the plaintiff is a fit and proper person to be granted
letters of administration.
g) Punitive damages.
h) General damages.
i) Costs of the suit.
5. The plaintiff’s claim against the 2nd Defendant is for;
a) ADECLARATION that the transaction between the 2nd Defendant and Don
Muyiiya was fraudulent and illegal in nature.
b) A DECLARATION that the 2nd Defendant may not benefit from an illegal
transaction between the 1st Defendant and Don Muyiiya.
c) A DECLARATION that the plaintiff is entitled to recover the land at Busiro
Block 336 Plot 445.
d) AN ORDER directing the Registrar of titles to cancel the 2nd Defendant from
the title of the land at Busiro Block 336 Plot 445 vide instrument WBU
1802271.
6. The facts giving rise to the Plaintiff’s cause of action against the Defendants
arose as hereunder:
a) THAT the plaintiff is a son of the late Yoana Maria Nsimbi (hereinafter
referred to as the deceased) who died intestate on 22nd November 2022. (A
copy of his death certificate is hereto attached and marked as Annexure “A”).
b) THAT at the time of his death, the deceased was survived by his father, a
widow, the plaintiff and the 1st defendant.
c) THAT the estate of the deceased includes properties worth over four billion
Uganda Shillings, namely:
1. Ssese Block 70 Plot 4 measuring 87 hectares at Kabanga, Kalangala
District.
2. His home was on a four-acre piece of land at Lungujja, Masaka –
Masaka Block 230 Plot 124
3. 30 acres at Bubembe, Ssese Block 70 Plot 3 at Bubembe, in Kalangala
District.
4. 10 acres at Bunyama, Ssese Block 70 Plot 7 at Bunyama, Kalangala
District.
5. Busiro Block 336, Plot 445.
6. Commercial buildings in Masaka City.
d) THAT the 1st Defendant reported the death of the late Yoana Maria Nsimbi to
the Administrator General.
e) The 1st Defendant falsely represented himself as the sole surviving child of
the deceased and further alleged that he had been duly authorized by the
family to petition for Letters of Administration.
f) The 1st Defendant deliberately brought individuals who were not relatives of
the deceased to the meeting at the Administrator General’s office, following
which he was issued a Certificate of No Objection.
g) The 1st Defendant presented the Certificate of No Objection before the High
Court at Masaka, upon which the Court duly issued him Letters of
Administration in respect to the estate of the late Yoana Maria Nsimbi.
(Attached herein is the copy of Letters of Administration marked as annexture
“D”).
h) In his application for Letters of Administration, the 1st Defendant wilfully
omitted the Plaintiff, the Plaintiff’s mother, and the Plaintiff’s grandfather as
beneficiaries to the estate of the deceased.
i) THAT upon obtaining Letters of Administration, the 1st Defendant registered
the deceased’s land in his own name.( copies of search reports in respect of
the land are bundled, attached and marked as “E”)
j) That the 1st defendant subsequently sold Busiro Block 336, Plot 445 to the
3rd defendant who sold to the 2nd Defendant, now the registered owner of
the land vide Instrument Number WBU-00236789. (A copy of the Special
Certificate of Title is attached as Annexure “F”).
k) THAT the 1st, 2nd and 3rd Defendant’s actions are illegal and fraudulent in
nature.
7. The plaintiff avers and shall prove to this Honourable court that the letters of
Administration of the estate of the late Yoana Maria Nsimbi were fraudulently
obtained and the administration of the estate arose from an act of fraud.
PARTICULARS OF FRAUD
a) The 1st Defendant wilfully concealed material information about the
existence of other beneficiaries of the late Yoana Maria Nsimbi.
b) The 1st Defendant made a wilful misrepresentation by falsely asserting
that he was the sole surviving child of the deceased, thereby excluding
other rightful beneficiaries.
c) The 1st Defendant fraudulently orchestrated the attendance of
individuals who were not relatives of the late Yoana Maria Nsimbi at the
meeting convened in the office of the Administrator General, in a bid to
secure the grant of certificate of no objection.
d) The 1st Defendant, despite having knowledge of the existence of other
lawful beneficiaries to the estate, intentionally excluded them from his
application for Letters of Administration.
e) That the 1st defendant mismanaged the property of the deceased by
fraudulently transferring the property into his own name.
f) That the 1st defendant fraudulently transferred the land comprised in
Busiro Block 336, Plot 445 to a third party without authority from the
beneficiaries.
g) The 2nd Defendant knew that the 1st Defendant had effected the sale to
the 3rd defendant in his capacity as Administrator.
8. THAT the Plaintiff is a fit and proper person to administer the estate of the late
Yoana Maria Nsimbi.
9. THAT a notice of intention to sue was served on the Defendants, but the
same was ignored.
10. THAT this Honourable Court has jurisdiction to address the matter.
WHEREFORE, the Plaintiff prays for the following orders against the Defendants:
a) An order for revocation of letters of administration granted to the 1st
Defendant in respect to the estate of the late Yoana Maria Nsimbi.
b) A Grant of letters of Administration to the plaintiff in respect to the estate of
the late Yoana Maria Nsimbi.
c) An order that the 1st Defendant surrenders the Administration of the estate of
the late Yoana Maria Nsimbi to the plaintiff.
d) An order compelling the 1st Defendant to account for and surrender all
monetary benefits he has derived from the estate of the deceased.
e) A declaration that the purchase of land comprised in Busiro Block 336 Plot
445 and Block 336 Plot 324 by the 2nd Defendant was illegal.
f) An order directing the Registrar of titles to cancel the title of the 2 nd defendant
in respect of land comprised in Busiro Block 336 Plot 445.
g) An order for compensation in monetary terms against the 1 st defendant if the
court determines that the Plaintiff is unable to recover the land in Busiro Block
336 plot 445 from the 2nd Defendant.
h) An order directing the Registrar of titles to cancel the registration of the land
comprised in Ssese Block 70 Plot 4 measuring 87 hectares at Kabanga,
Kalangala District, land at Lungujja, Masaka – Masaka Block 230 Plot 124, 30
acres at Bubembe, Ssese Block 70 Plot 3 at Bubembe, in Kalangala District
and 10 acres at Bunyama, Ssese Block 70 Plot 7 at Bunyama, Kalangala
District registered in the 1st Defendant’s name.
i) A permanent injunction restraining the 1st Defendant from any further dealing
and intermeddling in the estate of the deceased.
j) Punitive damages.
k) General damages to the plaintiff.
l) Costs of this suit.

SUMMARY OF EVIDENCE.

1. That I, NICHOLAS MWAAVU, of C/O M/s E3 & Co. Advocates P.O.BOX 1989
Ntinda Kampala, do hereby solemnly swear and state as follows;
2. That I am a male adult Ugandan of sound mind aged 38 (thirty eight), a resident
of Kiwumu Masaka District, the plaintiff in this suit and make this statement in that
capacity.
3. That I am a biological son of the late Yoana Maria Nsimbi who died on 22 nd
November 2022. ( copy of the birth certificate and death certificate attached
hereto and marked “A” and “B” respectively)
4. That my father, the late Yoana Maria Nsimbi left the following property:

District.

5. That I am a beneficiary of the estate of my late Yoana Maria Nsimbi who was
also survived by my mother and grandfather who are still alive and my other
brothers and sisters died in 2019.
6. That in 2024, my step brother John Clever Muyiiya, the 1 st defendant in the plaint
made a report of death of my father to the Administrator General.
7. That in the said letters of administration, he lied that he was the only surviving
child of my late father and he stated that he also had authority from the family to
apply for letters of Administration in respect of the estate of my late father.
8. That the 1st defendant did not involve me and other beneficiaries in his petition for
the letters of administration nor was I notified about the proceedings, which was a
violation of my rights as a beneficiary of the estate.
9. The court granted him letters of Administration of the estate of the late Yoana
Maria Nsimbi in that capacity as the only surviving son of the deceased at
Masaka High Court vide Probate and Administration Cause No. 009/2024. ( A
copy of the Letters of Administration is hereto attached and marked “B”)
10. That the 1st defendant used the Letters of Administration to register all the land in
his own name and sold some.
11. That he sold land comprised in Busiro Block 336, Plot 445 to Don Mugagga who
sold to Smith Maali the 2nd Defendant herein at one billion Uganda Shillings.
( Acopy of the certificate of title is attached and marked “C”)
12. That the transactions on the said land by the defendants were done without my
authorization and knowledge as a beneficiary.
13. That the 1st defendant has up to date continued to profit from the deceased’s
property for his individual gain without considering the benefit of other
Beneficiaries.
14. That the 1st Defendant concealed vital information as to existence of other
beneficiaries whilst applying for letters of Administration.
15. That the 1st Defendant has also never filed any inventory to this Honourable court
since the grant of Letters of Administration.
16. That a notice of intention to sue was effectively served to the 1st and 2nd
Defendants on 03rd May 2025 but they have chose to ignore the same. (A copy of
this notice is attached hereto and marked as Annexure “D”)
17. That I pray the grant of letters of Administration to the 1 st Defendant be revoked
by this Honourable court and the same be granted to me.

FACTS DISCLOSED BY THE PLAINTIFF’S PLEADINGS
Nicholas Mwavu, is the son of the late Yoana Maria Nsimbi, who passed away on
22nd November 2022. At the time of his death, the deceased owned several
properties, including Ssese Block 70 Plot 4 measuring 87 hectares at Kabanga in
Kalangala District, land at Lungujja (Masaka Block 230 Plot 124), 30 acres at
Bubembe (Ssese Block 70 Plot 3), and 10 acres at Bunyama (Ssese Block 70 Plot
7), both in Kalangala District. She was survived by her son (the Plaintiff), her
husband (the Plaintiff’s grandfather), and her widow (the Plaintiff’s mother).
Following his death, the 1st Defendant reported the matter to the Administrator
General, falsely claiming to be the only surviving child of the deceased and asserting
that he had the family's approval to apply for Letters of Administration. The
individuals who attended the meeting at the Administrator General’s office were not
related to the deceased. Nonetheless, the 1st Defendant obtained Letters of
Administration in Probate and Administration Cause No. 009/2024 at the High Court
in Masaka. He excluded the Plaintiff, his mother, and grandfather from the process,
registered the deceased’s properties in his own name, and proceeded to sell land
comprised in Busiro Block 336, Plot 445 to Don Mugagga, who subsequently
transferred it to the 2nd Defendant, Smith Maali.
FACTS DISCLOSED BY THE 2ND DEFENDANTS’ PLEADINGS
The 2nd Defendant, Smith Maali, bought land comprised in Busiro Block 336, Plot
445 from Don Mugagga and paid one billion Uganda Shillings as consideration. He
was approached by a broker called Silver Magambo about the land and instructed
his Estates Officer, Allan Abuki, to inspect the land and advise him on what it was
like and the possible investment ventures it would be suitable for. He advised that it
was covered by a thicket, was vacant and suitable for establishing hotel business
because it commanded a beautiful scenery.
He consulted his lawyer Moses Mugezi of Mugezi & Co. Advocates and he advised
him to apply for an official search from the Land Office. He also advised the 2 nd
defendant to ensure physical inspection of the records relating to this land. Mugezi
applied for a search and obtained a Search Report showing that the land was
registered in the name Don Mugagga. The 2 nd defendant paid Mugezi to carry out
thorough physical inspection of this land. Mugezi also obtained a certified copy of
John Clever Muyiiya’s Letters of Administration from Court.
AGREED FACTS
1. The 1st Defendant obtained Letters of Administration vide Probate &
Administration Cause No. 009/2024.
2. The Plaintiff is a son of the late Yoana Maria Nsimbi whose mother and
grandfather are still alive.
3. The 1st Defendant sold Busiro Block 336, Plot 445 to Don Mugagga who sold
to the 2nd Defendant and is now the registered proprietor under Instrument
Number WBU-00236789.
4. A notice of intention to sue was issued by the Plaintiff to the Defendants on
03rd May 2025.
AGREED ISSUES FOR TRIAL
1. Whether there is just cause for the Revocation of Letters of
Administration granted to John Clever Muyiiya in respect of the
estate of Yoana Maria Nsimbi (Deceased).
2. Whether the plaintiff is a fit and proper person to be granted
