Articles 8 to 28: Fundamental Rights
These are basic human rights guaranteed to all citizens. They are enforceable by courts,
meaning if someone’s rights are violated, they can go to court.0
Article 8: Laws Inconsistent with Fundamental Rights to be Void
Any law that violates fundamental rights is null and void.
Constitution takes priority over all other laws.
Article 9: Security of Person
No person shall be deprived of life or liberty except in accordance with law.
Article 10: Safeguards as to Arrest and Detention
Right to know reason for arrest, and legal aid.
No illegal detention without court’s permission.
Article 10-A: Right to Fair Trial
Everyone has the right to a fair trial and due process.
Article 11: Slavery, Forced Labour and Child Labour Prohibited
No slavery or human trafficking.
No child under 14 shall be employed in a factory or mine.
Article 12: Protection Against Retrospective Punishment
No person can be punished for an act which was not a crime at the time it was
committed.
Article 13: Protection Against Double Punishment and Self-Incrimination
No one can be:
Punished twice for the same offence.
Forced to give evidence against themselves.
Article 14: Dignity of Man and Privacy of Home
Human dignity is inviolable.
Home privacy and respect is protected.
Article 15: Freedom of Movement
Every citizen has the right to move freely within Pakistan.
Article 16: Freedom of Assembly
Citizens can gather peacefully without arms.
Article 17: Freedom of Association
Citizens have the right to form unions or political parties.
Article 18: Freedom of Trade, Business or Profession
Everyone has the right to choose any legal profession or trade.
Article 19: Freedom of Speech
Every citizen has the right to freedom of speech and press, subject to reasonable
restrictions.
Article 19-A: Right to Information
Every citizen has the right to access public information.
Article 20: Freedom of Religion
Right to profess, practice, and propagate religion.
Religious institutions are protected.
Article 21: Protection from Taxation for Religious Purposes
No person shall be forced to pay any religious taxes that go against their beliefs.
Article 22: Safeguards for Religious Minorities
No religious group can be forced to study another religion.
Article 23 & 24: Property Rights
Citizens have the right to own, buy, or sell property.
No one can be deprived of property without lawful reason.
Article 25: Equality of Citizens
All citizens are equal before law.
No discrimination based on sex, race, religion, etc.
Article 25-A: Right to Education
Free and compulsory education for all children aged 5 to 16 years.
Article 26 & 27: Access to Public Places and Services
No discrimination in public places (schools, hospitals, parks).
Equal opportunities in employment in government.
Article 28: Preservation of Language, Script, and Culture
Minorities can preserve their language and culture.
Articles 29 to 40: Principles of Policy
These are guiding principles for the government. They are not enforceable by courts, but
the state must try to follow them.
Article 29: Responsibility of State
Government must take steps to apply these principles in making laws and policies.
Article 30: Non-Enforceability
These principles are not legally enforceable in court.
Article 31: Islamic Way of Life
Enable Muslims to live life according to Islamic teachings.
Promote teaching of the Quran and Sunnah.
Article 32: Local Government
Encourage local self-government and participation in decision-making.
Article 33: Discourage Parochialism and Sectarianism
The state will discourage provincialism, racism, and sectarian hatred.
Article 34: Full Participation of Women
Women should have equal rights and opportunities in all fields.
Article 35: Protection of Family and Marriage
The state will protect marriage, family, mother and child
Article 36: Protection of Minorities
Minorities should be able to freely practice their religion and culture.
Article 37: Promotion of Social Justice
Provide education, end illiteracy, promote morality, and ensure just working
conditions.
Article 38: Promotion of Social and Economic Well-Being
Ensure basic needs (food, clothing, housing).
Reduce inequality of wealth.
Provide social security.
Article 39: Participation in Armed Forces
Encourage citizens to join defence services, especially youth and women
