III. The above named Petitioner respectfully submits as follows:


1.That the 2nd & 3rd Petitioners are legally married on 20-08-2006. Their
marriage was solemnized under Hindu rites and customs. After the
marriage both the 2nd & 3rd Petitioner’s were residing at R/o Chairman
Borayya Layout, 1st Main, Basaweswara Nagar, Chitradurga, Karntaka

2. That the 1st Petitioner submits the Government of Andhra


Pradesh recognized Sishu Gruha, Project Director Women and Child

Development Agency i.e., the 1st Petitioner as the Adoption Placement


Agency vide G.O.Ms.No.7 of 2000 Dated: 1-3-2000 to provide shelter
and also to take care of neglected and abounded children, who are
kept in the custody of 1st Petitioner. The 1st Petitioner submits that the
Government of Andhra Pradesh gave permission vide G.O Ms. No. 8 of
2000 Dt. 23.3.2000 to give children for In-Country Adoption who are in
the care and custody of 1 st Petitioner in accordance with the guide
lines issued by the Central Adoption Resource Agency from time to
time. The said guidelines were framed as per the Judgment of the
Hon’ble Supreme Court of India in Laxmi Kant Pandey case by Ministry
of Social Justice & Empowerment, Government of India. The 1 st
Petitioner has become de-facto guardian of those children who in the
care and custody of Sishu Greha.

3. The Petitioner No. 1 submits that the Child Baby Joicy kept in
care and custody of Sishu Greha Vishakhapatnam vide Ref. No.
AP15/SAA/0163 Dated: 17.12.2015 being surrendered at Sishu Greha
Visakhapatnam. The biological parent submitted relinquished deed to
the department. The Child Welfare Committee which is formed to
declare whether the Child is fit for Adoption has declared that the said
child being and surrendered is legally free for adoption vide
proceedings No. SAA/VSP/1392/2015-16 Dated 05-10-2016.

4. The 2nd & 3rd Petitioner approached the 1st Petitioner for the purpose
of taking a child in adoption to give health, education and life to under-
privileged child. Accordingly an application stating that they got
married on 20-08-2006, due to medical reasons they decided to adopt
a Female child to give love and affection and also a family to a girl
child they intended to adopt, 2nd Petitioner is working as a Lecturer and
earning an amount Rs.3,60,000/- per annum and Petitioner No 3 is
House wife. As such the 2 nd & 3rd Petitioners are economically in
position to take care and well being of Child baby Joicy, new name.

5. The 1st Petitioner has conducted the Home Study Report and it
was revealed that they have all requisite qualification for being eligible
to adopt and do not suffer from any physical, mental, financial, legal or
any other disability whatsoever. The application of the 2 nd & 3rd
Petitioners was approved by the 1 st Petitioner. The said minor child

baby Joicy was matched on line for adoption to 2 nd & 3rd Petitioners.
The 2nd & 3rd Petitioners have gone through the medical reports of the
Child Joicy and they gave consent to adopt the said Child Joicy 2 nd & 3rd
Petitioner have executed Foster care Agreement in favour of the 1 st
Petitioner on 02-08-2017 since then Child Joicy is in care and custody
of Petitioners No.2 & 3. The Petitioner No. 1 vide proceedings No.
1016/27/SAA/2017 Dt. 02.08.2017, given the child baby Joicy for
adoption pending legal formalities i.e., filing the application under the
provisions of Juvenile Justice Act before this Hon’ ble Court.

6. That the Petitioner No. 1 has given the said child baby Joicy in
adoption to Petitioner No. 2 & 3 as they agreed to take care and look
after the welfare of child which is paramount consideration. The 2 nd &
3rd Petitioner requests are genuine and proper and they have both the
financial resources and social awareness to take proper care of the
minor child. The proposed adoption is in the interest and paramount
welfare of the minor child.

IV. CAUSE OF ACTION: Cause of action for filing the Petitioner arose
on 02-08-2017 when the 1st Petitioner issued the proceedings for
adoption of the said child at Visakhapatnam.

V. JURISDICTION: The minor child who is in custody of the Petitioner


No. 1 is within the territorial jurisdiction of this Hon’ble Court and this
Hon’ble Court is empowered to entertain the same. The Petitioner
herein has paid Court fee of Rs. under Art. 67(16) of A.P Court Fee
and Suit Valuation Act, 1956 which is sufficient.

VI. The 1st Petitioner is necessary party to the proceedings as per


the orders of the Hon’ble Supreme Court of India reported in AIR
1984 SC at 469 in L.K Pandey case basing on the said
judgement the guide lines were framed by the Central Adoption
Resource Agency (CARA) by the Ministry of Social Justice &
Empowerment, Government of India.

The Petitioners have not filed similar Petition in respect of the


same subject matter before this Hon’ble Court nor are any proceedings
pending.

VII. It is therefore prayed that the Hon’ble Court may be pleased to


(i) permit the 1st Petitioner to give the minor child namely Joicy New
Name: Date of Birth: 29-11-2015 in adoption to 2nd & 3rd Petitioner.
(ii) Grant any other relief or relief’s as this Hon’ble Court may deem
fit and proper in the circumstances of the case.

I, S.Padmavathi, W/o late M. Kamalakar rao aged about 45 years


Occ: C.D.P.O, Visakhapatnam-(U-I) at the office of Marripalem, Upstair
of Sishugruha, Visakhapatnam do hereby solemnly affirm and state on

1. I submitted that I am working as C.D.P.O, Visakhapatnam-(U-I) at


the office of Marripalem, Upstair of Sishugruha, Visakhapatnam with
the 1st Petitioner and have been authorised by the 1 st Petitioner to
represent the adoption matter before this Hon’ble Court. As such I am
well acquainted with the facts of the case.

2. I submit that petitioners 2 & 3 are legally married on 20-08-2006.


Their marriage was solemnized under Hindu rites and customs. After

3. I submit that the 1 st Petitioner submits that the Government of

3rd Petitioners requests are genuine and proper and they have both the
financial resources and social awareness to take proper care of the
minor child. The proposed adoption is in the interest and paramount
welfare of the minor child.

7. I submit that the petitioner Cause of action for filing the


Petitioner arose on 02.08.2017 when the 1st Petitioner issued the
proceedings for adoption of the said child at Visakhapatnam. The
minor child who is in custody of the 1 st Petitioner is within the territorial
jurisdiction of this Hon’ble Court and this Hon’ble Court is empowered
to entertain the same.

Hence, I submit and pray that the Hon'ble court may be pleased
to pass a legalization decree (i) Permit the 1st Petitioner to give the
minor child namely baby Joicy Date of Birth: 29/11/2015 in adoption to
2nd & 3rd Petitioners. (ii) Grant any other relief or relief’s as this Hon’ble
Court may deem fit and proper in the circumstances of the case.

It is therefore prayed that the Hon’ble Court may be pleased to

(i) Permit the 1st Petitioner to give the minor child namely baby Joicy
Date of Birth: 29/11/2015 in adoption to 2nd & 3rd Petitioners

(ii) Grant any other relief or relief’s as this Hon’ble Court may deem
fit and proper in the circumstances of the case.

I, S.Padmavathi, W/o late M. Kamalakar rao aged about 45


years Occ: CDPO, Visakhapatnam-(U-I) at the office of Marripalem,
Upstair of Sishugruha, Visakhapatnam 1st Petitioner do hereby
solemnly affirm and state on oath as follows:

That I am working at the Office 1 st Petitioner and have been


authorised by the 1st Petitioner to represent the adoption matter before
this Hon’ble Court. As such I am well acquainted with the facts of the
case.

1. That the above matter is filed seeking the permission of this


Hon’ble Court to give the minor child in adoption to 2 nd & 3rd Petitioners
by 1st Petitioner and i crave leave of this Hon’ble to read contents of
the O.P as part and parcel of this affidavit.
