PUBLIC NOTICE
Sub: Filing of 1st/2nd Appeals under relevant sections [u/s 22(3), 28(5),
30(4), 35(5)] of NMC Act, 2019 and appeal fee thereof.
This Commission has earlier issued public notices dated 28.12.2022 and
28.08.2023 (copy enclosed) prescribing therein steps/ procedure for filing 1st/ 2nd
appeals before the National Medical Commission (NMC) under the NMC Act, 2019.
2. Despite these guidelines, it has been observed that many colleges/
appellants are still not following the due procedure for filing appeals under the
aforesaid sections of NMC Act as per said public notices. A number of appeals
received in this Commission are deficient on various counts; invoking wrong
section of the NMC Act; non-submission of all documents as per checklist
prescribed in the public notice, appeal submission to non-concerned authority etc.
which make them liable to be rejected on technical grounds.
3. In this regard, it is reiterated that all concerned may go through before
submitting any appeal to this commission against decision of any board.
4. The Commission in its 13th Meeting has decided to adopt a uniform
fee of Rs. 50,000/- in cases of appeals filed by colleges/ Institutions related to
academic year 2024-25 onwards and Rs. 5,000/- in all cases of appeals filed
by Individuals. This will revise the different amounts of appeal fee earlier
applicable for appeals in matter of different type of applications.
5. Further, it has also been decided that all appeals against the orders of
the Boards under the Commission shall henceforth be addressed to
Secretary, NMC only.
6. Therefore, all concerned colleges/ appellants are hereby informed that all
appeals against the orders of Boards under the Commission as provided under
different sections of NMC Act, 2019 may be preferred via ONLINE MODE ONLY
through email at ‘nmc_appeal@nmc.org.in’ and addressed to "Secretary, NMC"
within the stipulated time period as per the NMC Act. Appeals received through
any other mode/channel or email address will be liable not to be considered.
6. This issues with the approval of Chairman, NMC.

Apublic notice dated 28.12.2022 was hosted on NMC website prescribing therein
for filing 1st1 2nd appeals before the National Medical Commission (NMC) under the
procedure
NMC Act,20l9.
2. It has been observed that many colleges/ appellants are still not following the procedure for
filing appeals under the aforesaid sections of NMC Act as per said public notice.
3. Accordingly, all concerned colleges/ appellants are hereby again informed that all appeals
(along with relevant documents), against the orders of Boards under the Commission as provided
under aforesaid sections of NMC Act, 2019 may be preferred by Dean/Principal of the Medical
College/ appellant to the Commission by addressing to Chairman, NMC via EMAIL ONLY at
'nmc_appeal@nmc.org.in' with the requisite documents as per the attached checklist (refer
Annexure-I) and under the stipulated time period as per the NMC Act (refer Annexure-Il).
3. All the communications must contain the copy of duly filled checklist and invariably bear
the subject as under:
*1st1 2nd appeal under section. ... of NMC Act,2019 against decision of ... (Name of the
Board) ... regarding ...... (subject matter of the appeal) ......"
4. The above email is only for the pumose of submission of Appeals under aforesaid sections
of the NMC Act, 2019 and therefore no cognizance of appeal related communication would be
taken if not sent on the above email Id or addressed otherwise.
5. This issues with the approval of Chairman, NMC.
