all summons, notices etc., is the same as shown in the above cause title

and that of their counsel is P.MALLIKARJUN, ADVOCATE

MAHBUBNAGAR.

PLAINT FILED UNDER SEC. 26 R/W ORDER VII R.1 C.P.C.

1. The plaintiff, D1 to D6 are own sisters and brothers, they are the

children of late G.Narayana, who died in the year 2009 leaving

plaintiff and D1 to D6 as his legal heirs. The plaintiff and D1 to D6

do constitute Hindu Joint family and they are governed by Hindu law.

The plaintiff and D1 to D6 are coparceners and have equal shares in

the suit properties.


2. The D7 is the wife of D1, D8 and D9 are children of the D1 and D10

is the son of the D2, but they are not co-parceners, but they are

added as parties as some of the part of the suit schedule properties

are in their names.

3. The plaintiff and D1 to D6 are the co-owners, joint owners,

coparceners and possessors of the agricultural land bearing Sy.No.

238 extent Ac. 07-22 gts, Sy.No. 239 extent Ac. 0-33 gts, Sy.No. 240

extent Ac. 01-08 gts, Sy.No. 241 extent Ac. 0-37 gts, Sy.No. 242

extent Ac. 10-12 gts and Sy.No. 243 extent Ac. 08-11 gts, total

comes to 29-03 gts, situated at Jullapally village, from hereinafter

referred to as suit schedule property which clearly described in the

suit schedule property annexed to the plaint.

4. Originally Late Narayana was the owner and possessor of the suit

schedule property. During his lifetime for the sake convenience

mutated some extents of his lands in the names of his sons without

effecting any partition of the suit schedule property. Till 2009 the

Late Narayana, father of the plaintiff and D1 to D6, maintained the

suit schedule property.

5. While so, the Late Narayana, father of the plaintiff and D1 to D6, died

in the year 2009 leaving plaintiff and D1 to D6 as his legal heirs.

After the death of the Narayana, D1 to D3 used to supervise the suit


schedule properties and enjoyed the same jointly. The plaintiff due

to his nature of job used to reside outside the village, as such the D1

to D3 maintained the cultivation of the suit schedule properties. After

the death of the Late Narayana again the D1 to D3 mutated

remaining lands in the names of his sons in revenue records, without

any partition.

6. Few years after the death of Narayana due to woman folk, they have

been living separately in cook but they have been in joint possession

and enjoyment of the suit schedule property. The plaintiff sent lakhs

of rupees to D1 to D3 for the development of the agriculture and with

that amount they dug bore wells in the suit schedule properties. The

D1 to D3 used to maintain the cultivation of the suit schedule

property and distribute the crop share equally among the plaintiff and

D1 to D6. But since two years the D1 to D3 are not showing

accounts properly for which the plaintiff, D4 to D6 several times

requested the D1 to D3 to show the accounts properly and distribute

the crop equally, but they put deaf ear to the requests made to the

plaintiff and D4 to D6.

7. The plaintiff, D4 to D6 suspected the attitude of the D1 to D3 and

convened a panchayat on 10-06-2024 and demanded for partition

and allotment of their share in the suit schedule property, before the
caste elders and village elders. The elders also advised the D1 to D3

to effect partition and allot the share of the plaintiff and D4 to D6, for

the D1 to D3 refused to effect partition. As such the plaintiff is

entitled to sue the D1 to D3 for partition.

8. Albeit, the D4 to D6 shown interest in demanding their share in the

suit schedule property, but they did not show interest in joining as

plaintiffs, as such they are shown as defendants.

9. After refusal by the D1 to D3 the plaintiff searched for the documents

to file the suit and surprised to see that the names of D7 to D10 as

pattedars in respect of the part of the suit schedule property. It

appears that the D1 to D3 without knowledge and consent of the

plaintiff and other family members have mutated the part of the suit

schedule properties in the names of the D7 to D10. Mere revenue

entries do not confer any right on the D7 to D10 and they are not

binding on the plaintiff.

10. The suit schedule property is ancestral and joint family property of

the plaintiff and D1 to D6 and they are in joint possession of the suit

schedule property. In fact the suit property is not partitioned with

metes and bounds till today among the joint family members. The

Plaintiff and D1 to D6 are the common and joint owners of the suit

schedule property, coparceners and they have not partitioned the suit
lands with metes and bounds till today and they are in joint

possession of the suit schedule property and it is liable for partition

and allotment of 1/7th share of the plaintiff and D1 to D6 are entitled

to 1/7th share each in the suit schedule properties.

11. CAUSE OF ACTION :- That the cause of action for filing of suit

arose to the plaintiff when plaintiff the convened a panchayat on 10-

06-2024 and demanded the D1 to D3 for partition and on the same

date when the D1 to D3 refused for partition and every subsequent

date is also a date of cause of action to file the present suit.

12. COURT FEE :- That for the purpose of court fee and pecuniary

jurisdiction the relief of partition and separate possession is valued,

as follows, the Plaintiff, as per the valuation certificate, valued the

suit at Rs. 1,59,20,625/- and 1/7 share of plaintiff comes to Rs.

22,74,375/- and the 3/4th of it comes to Rs. 17,05,781.25/- Since

the Plaintiff and D1 to D6 are the joint owners & co owners of the

suit schedule properties and they are in joint possession of properties

hence a fixed court fee of Rs. 200/- is payable under section 34(2)

of the T.S.C.F and S.V. Act, is paid which is sufficient.

13. JURSISDICTION:- The Hon’ble court has got both pecuniary and

territorial jurisdiction to entertain the suit in view of location of the

suit schedule properties at Yenmangandla village of Nawabpet


Mandal of Mahbubnagar District, which is within the jurisdiction of the

Hon’ble court and also value of the properties.

14. LIMITATION: The suit is within limitation as the cause of action

arose to the plaintiff on 10-06-2024, as such it is within limitation.

15. DECLARATION: The plaintiff declares that he has not filed any

similar suit against the defendants for the same relief.

PRAYER

It is prayed that the Hon’ble court May be pleased to decree the suit of

the Plaintiff as under.

A. Preliminary decree be passed for partition and separate possession,

duly dividing the suit schedule property in to 7 equal shares with

metes and bounds with reference to good and bad qualities and for

allotment and separate possession of 1/7 share of plaintiff.

B. The Advocate commissioner be appointed for partition of the suit

schedule property into 7 equal shares and plaintiff be delivered

separate possession of 1/7 share in suit property.

C. Final decree May be passed in terms of preliminary decree in respect

of the 1/7 share of plaintiff.

D. For recovery of costs of the suit.


E. The other relief for which the HON’BLE court feels that the Plaintiff is

entitled May be awarded.

I, Karralolla Kanakamma D/o Bestha Mogulaiah, age: 60 yrs, Occ:

Agrl, R/o Julapally village of Gandeed Mandal of Mahbubnagar District,

do hereby solemnly and sincerely affirm and state on oath as under.

That I am the deponent herein, petitioner in the petition and plaintiff

in the main suit, as such well acquainted with the facts of the case and

in fit condition to depose as under.

1. I, along with R1 to R6, am part of the same family, being the children

of Late G. Narayana, who passed away in the year 2009, leaving us

as his legal heirs. We constitute a Hindu Joint Family and are

governed by Hindu law. As coparceners, I and R1 to R6 have equal

shares in the petition schedule property.


2. R7 is the wife of R1, R8 and R9 are the children of R1, and R10 is the

son of R2. Though they are not coparceners, they are included as

parties since parts of the petition schedule property stand in their

names.

From hereinafter, the said properties shall be collectively referred to

as the petition schedule property, more clearly described in the

petition schedule annexed to this plaint.

5. Originally, Late Narayana was the absolute owner and possessor of

the petition schedule property. During his lifetime, for convenience,

he mutated some extents of his lands in the names of his sons

without effecting any actual partition of the petition schedule

property. Until 2009, Late Narayana maintained the petition schedule

property.

6. After the death of Late Narayana in 2009, I and R1 to R6 became the

legal heirs. Following his demise, R1 to R3 supervised and jointly

enjoyed the petition schedule property. Due to the nature of my job,

I resided outside the village, while R1 to R3 managed the cultivation.

After Narayana’s death, R1 to R3 further mutated the remaining lands

in their names in the revenue records without effecting any partition.

7. A few years after Narayana’s death, due to family circumstances, we

started living separately in different households. However, we

continued to have joint possession and enjoyment of the petition

schedule property. I also sent significant amounts of money to R1 to


R3 for the development of agriculture, with which they dug bore wells

on the petition schedule property. R1 to R3 managed the cultivation

and distributed the crop share equally among me and R1 to R6.

However, for the past two years, R1 to R3 have not been maintaining

proper accounts. Despite several requests by me, R4 to R6, they

ignored our requests to provide a proper accounting and distribute

the crop share fairly.

8. Due to suspicion about the actions of R1 to R3, I, along with R4 to

R6, convened a panchayat on 10-06-2024 before the village elders,

demanding partition and allotment of our rightful shares in the

petition schedule property. The elders advised R1 to R3 to effect

partition and allocate our shares, but they refused. As such, I am

entitled to sue R1 to R3 for partition. As such I have filed the present

suit.

9. The R1 to R3 by colluding with R7 to R10 are trying to alienate the

petition schedule properties in favor of third persons. If they succeed

in their attempt I will be put to heavy loss which cannot be

compensated later.

10. I have filed some documents to prove prima facie case which is in

my favor and balance of convenience is in my favor, if injunction is


not granted I would be put to heavy loss which cannot be

compensated later.

11. Hon’ble court has got ample and wide powers to grant interim

injunction, by dispensing prior notice, restraining the R1 to R3 and R7

to R10 from alienating the petition schedule property to others, till

the disposal of the main case.

12. PRAYER: In the circumstances mentioned above it is therefore

prayed that the Hon’ble court may be pleased to grant interim

injunction, by dispensing prior notice, restraining the R1 to R3 and R7

to R10 from alienating the petition schedule property to third

persons, till the disposal of main case, in the interest of justice.
